If you like wine, you can taste and learn at our local winery at Catania’s winery. Stump Pass Beach State Park has a lot going for it. Sunny skies, sandy shores, great shelling, and sparkling waters are just the start. But one of the coolest things about Stump Pass Beach State Park is all of the wildlife that have made their homes at this Englewood park. Or you can hike the trails at Lemon Bay Park and Environmental Center and even kayak through the park for even a greater experience. You can access a few of these sites if you don’t mind walking but a vehicle is probably best. There are also public transportation SCAT buses that can help with your commute and private services like Uber and LYFT. **Waiver of Liability and Assumption of Risk Agreement Use of Premises** By booking the property you are hereby unequivocally agreeing to all waivers listed below. In consideration of my use of the premises, I for myself, my heirs, personal representative or assigns, do hereby release, waive, discharge, and covenant not to sue the host/owner of the property, it’s trustees, directors, officers, employees and agents from liability from any and all claims including negligence resulting in personal injury, accidents, or illnesses (including death) and property loss arising from use of premises. Assumption of Risk: Swimming pool, bikes use, and gas grill use carries with it certain inherent risks that cannot be eliminated regardless of the care taken to avoid injuries. I know and understand and appreciate these and other risks are inherent in the activity I am participating in. I hereby assert that my participation is voluntary and that I knowingly assume all such risks. The subject property has a (swimming pool) located thereon. The guest(s) will use the swimming pool at the guest’s own risk. The owners will not be held responsible for the injuries sustained by the guest and/or the guest’s occupants when using the swimming pool, and the guest will indemnify the owner for any actions resulting from injuries to guest and/or guest’s occupants. I hereby voluntarily, at my own risk, I am agreeing to sign this Waiver and Assumption of Risk in sole consideration of being permitted to use Royal Palms Florida property & swimming pool by booking the property. Indemnification and Hold Harmless: I also agree to indemnify and hold harmless the host/owner, its trustees, directors, officers, employees and agents from any and all claims, actions, suits, costs, expenses, damages and liabilities including attorney fees as a result of this use of premises. Severability: The undersigned further expressly agrees that the forgoing waiver and assumption of risk agreement is intended to be as broad and inclusive as is permitted by the law of the State of Florida and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect. I hereby acknowledge and understand that there are dangers and risks associated with the activities described above, which have been fully explained to me. I hereby agree to abide by all rules, instructions, policies, and procedures imposed by the host/owner relating to the use of the property. I hereby certify that I am of legal age and competent to execute this Waiver and Assumption of Risk, that in doing so of my own free will and accord, voluntarily and without duress, and that I do so intending to bind myself, my executor, my heirs, and administrators or assigns to the fullest extent. By reserving Bow-Tie Lux Vacation Home, guests understand the foregoing and acknowledge consent to the terms of this waiver. The rental agreement is sent with the booking confirmation and is an implied signed agreement when the property is booked as a reservation. The parties hereby indicate by their booking of our property that they have read and agreed with the terms and conditions of this Agreement in its entirety.
