The ranch is a private oasis with historical roots dating into the early 1800's. It was the homestead of the Patton family who used its abundant waters to power a lumber mill and gristmill. The family log cabin, mill stones and chimney from the mercantile store still exist, giving this place such a rich history. Also this property and its settlers were fundamental in the foundation of the Republic of Texas, for which we are very proud! There are also 3 natural springs that originate from our land and which produce a natural and constant flow of water ( approx 750,000 gallons per day, every day!) into our creeks and lakes. This makes fishing, bird watching and nature truly come to life here at the ranch. Guest access We have 2 swimming pools & a recreation court which has tennis, basketball, pickle ball, & we have a sand volleyball court (including balls & rackets) Our springfed swimming pool has seats along the waterfall section steps on each side and is 10 feet at the deep end. Our traditional chlorinated pool is a sports pool that is 5 foot in the middle and 3 feet on each side. There are tables chairs and loungers at both of these swimming areas. We also have a mile and a half hiking trail and lots of farm animals. Our creeks and ponds are full of fish and guests are welcome to bring fishing poles (all fish must be released). These amenities are located in the middle of the Ranch in our “Commons Area”. The Tenant has been given permission to enter and use the property and the improvements located in Hill, County, Tx, known as Spring Lakes Ranch, referred to as “Ranch” (Parent company Ranch at Deer Creek LLC). Person or Persons whom the rental agreement is signed by and/or is listed on the Reservation, will be collectively referred to as “Renter” with “Guest” being only those persons on the approved reservation list. Together with their partners /agents/family, under common control of Owners, Kristi Bass and Zane Runyan, are collectively referred to as “Owners”. All other persons who do not have written permission are “Visitors” & therefore Unauthorized onsite. *Guest/Renter is aware that the Ranch is a natural ranch with inherent risks and dangers. Guest/Renter acknowledges that part of his/her interest in the use and enjoyment of the Ranch is its being in a natural condition, including the risk and dangers attendant on such use or enjoyment. Guest/Renter acknowledges that the Ranch offers many activities to Guest/Renter that contain elements of risk or danger that could cause property damage, serious bodily injury, or death to Guest/Renter or others. Such risky and dangerous activities include, but are not limited to, swimming, diving, fishing, watercraft, fireworks, basketball, tennis, campfires, and hiking. Be advised that there is no lifeguard on duty at either pool, lakes, ponds, or creeks; therefore, swim at your own risk. In addition, Guest/Renter acknowledges that various farm/ranch animals, game, wildlife, insects and plants on the Ranch also present a risk of possible property damage or serious bodily harm, injury or death to themselves or others, and caution should be used around them. Guest/Renter is fully aware, and he/she has full knowledge and accepts these inherent risks and dangers whether or not listed above. THE GUEST/RENTER UNDERSTANDS AND ACKNOWLEDGES THAT AN AGRITOURISM ENTITY, LIKE THE RANCH, IS NOT LIABLE FOR INJURY OR DEATH OF ANY AGRITOURISM PARTICIPANT, GUEST/RENTER/VISITOR RESULTING FROM ACTIVITIES, LIKE THOSE DESCRIBED ABOVE. THE GUEST/RENTER UNDERSTANDS THAT HE/SHE HAS ACCEPTED ALL RISK OF INJURY, DEATH, PROPERTY DAMAGE, AND OTHER LOSS THAT MAY RESULT FROM THESE ACTIVITIES OR THOSE RELATED TO AGRITOURISM ACTIVITIES It is the responsibility of the Renter to ensure Each Guest in the respective reservation has read, understands and agrees to these terms prior to arrival. A signed copy must be provided to the Owner prior to Guest/Renter arrival or access will be denied & no refunds will be given. The Renter is also responsible for and accepts the liability for each of the respective guest in his/her reservation, including but not limited to property damage, bodily injury or death. This Liability Release and indemnification is valid for this and all subsequent visits to the Ranch by Guest/Renter. In consideration for being allowed access to the Ranch & to engage in any activities on the ranch, Guest/Renter hereby: (1) RELEASES OWNERS FOR ALL LIABILITY FOR BODILY INJURY (INCLUDING DEATH) AND PROPERTY DAMAGE SUFFERED BY GUEST/RENTER IN CONNECTION WITH THE USE OF THE OWNER'S PROPERTY, EVEN IF THE DAMAGE/INJURY IS CAUSED BY THE NEGLIGENCE OF ANOTHER GUEST/RENTER; (2) AGREES TO INDEMNIFY AND HOLD HARMLESS OWNERS FROM ANY LIABILITY, CLAIMS OR CAUSES OF ACTION (INCLUDING ATTORNEYS FEES OR COSTS INCURRED IN DEFENDING AGAINST SUCH LIABILITY CLAIMS OR CAUSE OF ACTION) ARISING IN CONNECTION WITH GUESTS/RENTERS USE OF OWNERS PROPERTY INCLUDING (A)INJURY TO GUEST/RENTER OR ANY OF HIS/HER MINOR CHILDREN, (B)INJURY TO ANY PERSON, GUEST/RENTER/VISITOR AND THEIR MINOR CHILDREN, OR (C) DAMAGE TO PROPERTY, EVEN IF OWNERS ARE SOLELY NEGLIGENT OR STRICTLY LIABLE FOR SUCH INJURY OR DAMAGE, EXCEPT GROSS NEGLIGENCE OR WILLFUL MISCONDUCT ON THE PART OF THE OWNER; (3) COVENANTS NOT TO SUE OWNERS IN CONNECTION WITH ANY ACTIVITY ON THE PROPERTY.
