NOT AN OVERNIGHT VENUE!!!! The space Thank you for entrusting us with your upcoming event. Our facility can be used for weddings, company retreats/training, family reunions, yoga retreats, High School Dances, religious organizational functions, or for any other reason as long as it is approved in advance with the owners of Davis County Venues, LLC. Event liability insurance for your event must be purchased and confirmed through your auto insurance or homeowners insurance company for the date of the event. Event insurance will need to be in place 30 days before the event. You can also get liability insurance for your event through “Event Helper,” you can G00gle them: . We cannot lease the building if event liability is not in place and Davis County Venues, LLC 2138 E 2900 N Layton, Utah 84040 is not listed as an Additional insured. Rent for the full day is $1,500, $1,400 for 4 hours, $1,300 for 3 hours, $1,200 for 2 Hours, $1,000 for 1 hour. (The $500 Cleaning/Deposit is included in these prices. There will be a built-in 2-hour set up time before your event as long as the event takes place after 8 PM on weekdays, for example, Set up would be 6:00 PM.) The full amount of the rent is taken in advance to reserve the spot and is fully refundable 30 days prior to the event. Set up on Saturdays and Sundays can take place anytime, just make sure to schedule getting into the building with Kya who can coordinate with getting the building opened and locked up. $500 damage/extra cleaning deposit is refundable if nothing is damaged and the following cleaning requirements are met. $250 will be returned if no damages occur to exercise equipment, sensory room equipment, tables, chairs, AV, Projectors, TV's, walls, etc. If we need to drywall, paint, or fix anything in our facility or if anything is stolen above the $250 amount, the remaining $250 will be used for the replacement costs, for example if the damages or replacement costs of missing items was $350 in damages to the facility, the left over $150 will be returned. $250 will be returned if the following are met upon inspection: 1. All garbage bags are removed from cans and thrown into the large garbage bin between our building and the building to the east. 2. All Floors of all rooms including the main areas, gym area, stage area, and bathrooms need to be swept and any spills need to be mopped up. (Cleaning supplies are in the cleaning closet) 3. Furniture Items put away back to the original place. Picnic tables need to be returned where they were set up in the main area, and door knobs and countertop surfaces are wiped off with disinfectant cleaner. 4. Food and drinks need to only be served from the kitchenette and are not to be used around the pool table. If the pool table is going to be used please make sure no drinks are put on the sides of the pool table as the drinks will ruin the surface of the pool table and the entire table will need to be replaced. 5. Toilets need to be wiped off and any fecal or urine will need to be scrubbed off. 6. Kitchen and Bathroom mirrors, sink, and countertops are wiped down. THE USE OF ALCOHOLIC, DRUGS, CIGARETTES, or VAPES ARE STRICTLY PROHIBITED ON THIS PROPERTY AT ALL TIMES AND WILL RESULT IN THE ENTIRE $1,000 IN DEPOSITS TO BECOME IMMEDIATELY NON REFUNDABLE AND GUESTS WILL BE ESCORTED FROM THE PREMISES. The reason this is so important to remember is that we have guests using the facility Monday-Friday 8:00-5:00 PM. Therefore if any necessary pudding, drywalling, painting, or replacing items lost or stolen from our facility will need to be done We have a large stage area for presentations, with a large screen, projector, and wifi. We also have a yoga/dance/workout room with mirrors as well as an office with a large 64-inch flat-screen TV. This facility also has a refrigerator, microwave, sink, disposal, 3 bathrooms with showers, and a washing machine and dryer. We have about 6 large circular tables, 50 chairs, 1 square table, and 5 rectangular picnic tables for serving food. To better serve you and your guests, the following policies, rules, and guidelines have been established. We ask that you adhere to the following policies. Smoking/Drug/Alcohol Policies: Absolutely no alcohol may be brought onto the premises (including the parking lot.) If any outside alcohol is discovered, it will be immediately confiscated and guests may be asked to leave. within 3 days if any spilled alcohol cigarettes, smoke smell, or drug paraphernalia are discovered during your event via cameras or after your event anywhere on the premises. Our cameras will be monitoring events at all times, if it is noticed that intoxication, excessively rowdy or belligerent behavior, or harassment of staff or other guests, we reserve the right, at our discretion, to terminate the event due to a breach of contract and the full $500 fee will be taken from the cleaning deposit if garbage on the floor, leftover food, decorations, or excessive spills, uncleaned toilet spills or stains, etc. Children: Due to the expensive sensory equipment we sincerely ask for your cooperation in supervising children. As a rule, there is no running at the event center. While outdoors, children must be accompanied by an adult and remain in the sensory room or reception area. No children will be allowed to leave the facility without being accompanied by an adult. Cancellations: In the event of cancellation the initial payment and all costs are non-refundable and non-transferable if cancellation happens within 48 hours of the event.. A final headcount will need to be provided to Andrew Brinton when booking to your event. Please note that you will be charged for the number of guests above the specified amount of 75. Any changes to the guest count must be made by written request and $25 charge will be added per person. If guests exceed 75 allowed guests the full $500 fee will be taken from the cleaning deposit and you will have broken the Forecode and police will be called to evacuate your event. No other food or drink items should be brought into the venue except for personal consumption. To ensure the cleanliness of the bride’s and attendants’ gowns, we ask that no food or drink be in the bride’s and attendants’ rooms. Davis County Venues, LLC makes a special effort to provide the facility, however, Davis County Venues, LLC will not be responsible for the non-alcoholic beverages or food that is consumed during your event. It is up to you and your hired caterer to stay in compliance with state and county food safety practices, we cannot guarantee your food will be safe or desirable to take home. Due to the high variability in the food served and your individual timeline, the final decision concerning "leftovers" will be determined by you and the caterer, and Davis County Venues, LLC will not be liable for any event. Decorations & Deliveries: You are welcome to bring any and all personal decorations that include items such as the following: trousseau, photos, guestbook, party favors, etc. Any personal decor will not be allowed to be taped, pinned, or screwed into any walls, ceilings, or floors. We do have a large gold framed ring that you can use to decorate (seen in photos of prior events below) however, any pinning, taping, or nailing up decorations to walls is absolutely not allowed and the full $500 fee will be taken from the cleaning deposit if this occurs. If you are wanting to bring in decor, it will need to be discussed with and approved by our coordinator. Please be sure to take home anything that you bring in. (For example Decor, Wedding Cake, Floral Arrangements, clothing items, etc.) We do not allow silly string, confetti, rice, glitter in any form, birdseed, foam peanuts, or other similar items. Anything left by the wedding party or guests will be considered a donation or thrown away. The full $500 fee will be taken from the cleaning deposit if this occurs. Final Decisions: All set-up, timeline, layout catering, and design decisions must be made in advance and outside of the timeline. For instance, if you are renting the facility from 6:00 PM on Friday until 8:00 AM on Saturday, which would be the normal booking timeline for a wedding, you will not be able to start setting up until 5:30 PM no exception will be granted. If there is an attempt to start setting up before 5:30 PM or have everything completed and cleaned up by the 12:00 pm time frame the full $500 fee will be taken from the cleaning deposit if this occurs. Sidewalk Usage: During events, we ask that everyone please remain on the pathways or sidewalks which may or not be shoveled. Guests are not allowed to walk/run on the flower beds grass, climb on the trees, or throw trash anywhere in the facility parking, or lawn surrounding the facility. To the degree we are able; our staff will be monitoring this via security cameras behind the scenes. We reserve the right to assess a charge for damage to the landscape, including any damage to the curbs or overloading the garbage bin at the end of the long driveway between the buildings. Garbage must be packed out and if our dumpster is used the full $500 fee will be taken from the cleaning deposit if this occurs. Music and Audio-Visual: There are sound systems/TVs available for your use. We are happy to assist you. However, Davis County Venues, LLC will not be held liable for any malfunctions or “mistakes” during the event. We suggest you hire a professional DJ/musician. Davis County Venues, LLC will also not be held responsible for any technical issues with slide shows, ceremony music, or videos. Noise Ordinance: Because our venue is located in a commercial area and there may be other events going on next to our facility, we have a noise ordinance that is strictly enforced and will result in your $500 being immediately due. Absolutely no band or DJ is allowed to play music outside. If a band or DJ is playing music outside the event will immediately be shut down and the event will be canceled the full $500 fee will be taken from the cleaning deposit if your party doesn’t stop after a warning text or phone call comes from the owners of Davis County Venues, LLC. Outside Vendors: You will be responsible for your own photographer, florist, disc jockey, etc. If you choose to use outside Vendors, Davis County Venues, LLC is to be held harmless from any and all claims or personal damages resulting from the outside Customer's use of the facility including, but not limited to; lost or stolen items, personal property damage or loss, personal injury or accidents (including traveling to or from the facility). If there is any tampering with or disabling of the onsite cameras the event will immediately be shut down and the event will be canceled. The full $500 fee will be taken from the $500 cleaning deposit if this occurs. For additional headcount needs over 75 people, the full $500 fee will be taken from the $500 cleaning deposit if this occurs the event will immediately be canceled. If the amount is uncertain please estimate but be warned this is a strict fire code requirement and you are putting your guests in danger of criminal charges for not observing this policy. If we notice via our cameras that additional people over the estimated amount came to the event police will be called and your guests will be evacuated. All final packages, headcount, and signed agreements are due 48 hours prior to your event. If for some reason Davis County Venues, LLC isn’t able to cover the damages done to the facility with the full $500 cleaning fee additional charges will be communicated via text or email. If the assessment of the damages is made and communicated to you via text or email, you will have 3 days to pay. After the 3 days, an additional 100.00 per day will be added to your invoice each day until full payment has been received and your lack of payment will be sent to all three credit bureaus via our collection department as well as you could be arraigned with a small claims charge for vandalism, theft, or disorderly conduct. Send-off Celebrations: If Sparklers or Roses are used, all sparklers and roses must be swept up from the parking lot, and thrown away. No confetti, rice, silly string, birdseed, foam peanuts, or other similar items are allowed anywhere within the venue. Sparklers must also be used away from the building and any painted or vinyl surfaces or outdoor floor mats. Car decorating is also allowed but please advise those likely to be involved to use good judgment. Davis County Venues, LLC reserves the right to charge the full $500 fee from the cleaning deposit if any damages occur to the grass, stucco, or glass of the facility. Smoking (and Vaping): In compliance with the laws set forth in the State of Utah Davis County Venues, LLC maintains a smoke-free environment. Smoking is not allowed anywhere within 75 feet of the facility or the buildings. Please use proper etiquette in disposing of your cigarettes and/or cigars. If any infractions are discovered via camera the full $500 fee will be taken from the cleaning deposit if this occurs. Davis County Venues, LLC, Andrew and Tresa Brinton, The Trustees of the Davis County Venues, LLC, Andrew and Tresa Brinton will not be responsible for any damages made by your 3rd party entities doing business at our facility located at 772 E 700 S Suite 4 Clearfield Utah 84015 and the employees, officers, volunteers, and agents. Customer GUIDELINES: POLICY Vending at Davis County Venues, LLC, Andrew and Tresa Brinton, have the authority and responsibility to interpret and regulate this policy. ADVERTISING All advertising at, online, or other social media platforms for Customer sales must be approved by Davis County Venues, LLC, Andrew and Tresa Brinton. No signage/advertising may be posted on the walls, poles, benches, fences, balconies, doors, windows, or any other landscape or architectural feature. Any Customer advertising their event with the media is asked to submit a copy of the press release to, Davis County Venues, LLC, Andrew and Tresa Brinton, 772 E 700 S Suite 4 Clearfield Utah 84015. Davis County Venues, LLC reserves the right to charge the full $500 fee will be taken from the cleaning deposit. CANCELLATIONS We are unable to cancel your reservation due to inclement weather, covid, etc. You will be charged the full price for a booking if not canceled within 48 hours in advance and notice is given in writing to Davis County Venues, LLC, Andrew and Tresa Brinton, 772 E 700 S Suite 4 Clearfield Utah 84015, or via booking site. DAMAGES Organizations using Davis County Venues, LLC, Andrew and Tresa Brinton facility located at 772 E 700 S Suite 4 Clearfield Utah 84015 as well as its surrounding parking area shall safeguard and care for the property, and the person signing the agreement assumes responsibility for payment of damages resulting from their misuse of the property. The organization or person using the property shall guarantee orderly behavior of any and all persons using the property and shall be liable for any property damage to the buildings, furnishings, fixtures, theft of equipment or other property. Davis County Venues, LLC reserves the right to charge the full $500 fee from the cleaning deposit if this occurs. EMERGENCIES All accidents must be reported immediately to Andrew. EQUIPMENT You may use tables, chairs, ball pit, swings, basketball hoop, yoga mats exercise, and audio-visual equipment, however, if any are damaged, Davis County Venues, LLC reserves the right to charge the full $500 cleaning deposit or any damages to tables, chairs, ball pit, swings, basketball hoop, yoga mats exercise, and audiovisual equipment. LOCATION Vending areas may not party, break bottles, or leave trash in, around, or outside in the parking lot of the facility located at 772 E 700 S Suite 4 Clearfield Utah 84015. Davis County Venues, LLC reserves the right to charge the full $500 fee will be taken from the cleaning deposit if this occurs. ON-SITE A member of your organization must be present during the stated date(s) and time(s) while at the event and designated in writing to Davis County Venues, LLC, Andrew and Tresa Brinton facility located at 772 E 700 S Suite 4 Clearfield Utah 84015 or email 48 hours prior to the event. PARKING Parking must not exceed 50 parked cars and may not be parked at the facility until after 5:30 PM. Davis County Venues, LLC reserves the right to charge the full $500 fee will be taken from the cleaning deposit if this occurs. UNLOADING AND LOADING Unloading and loading of equipment may take place however, cars or trucks must not block adjacent parking lot access and roadway/walkway parking is prohibited. Davis County Venues, LLC reserves the right to charge the full $500 fee from the cleaning deposit if this occurs. RULES: • Use of the entire facility (Except the storage room and Office) • No Catering is offered • No additional Tables or Chairs Provided • Decorations: Linens, Centerpieces, and Other Decor will be your responsibility • Set-Up and Take-Down of Event will be your responsibility • Use of AV System • Camera will be used to Oversee Your Event While You are Enjoying Your Party • Cleaning and Serving Staff will be your responsibility • Cake Cutting Service will be your responsibility Liability Waiver: Please read this document carefully, as your physical or electronic signature indicates that you have agreed to sign away your rights. In consideration of being permitted to use “Davis County Venues, LLC's” facilities and participate in any program, event, or activity affiliated with "Davis County Venues, LLC," whether or not located on “Davis County Venues, LLC" premises, I agree to the following: 1) Release - For myself and anyone who claims by and through my stead, I forever release and promise not to sue "Davis County Venues, LLC", its owners or clients, and/or any other person using the facilities at for Davis County Venues, LLC who are in any way associated with "Davis County Venues, LLC", to the maximum extent allowed by law, from any and all liability, claims, demands, damages, or any other legal responsibilities in any way related to any action of any "Davis County Venues, LLC" owner, client or other staff while participating in any "Davis County Venues, LLC" programs, events, or activities. This release includes without limitation any and all claims, foreseeable and unforeseeable, relating to physical or other injury, death, or damage to myself and anyone with me at the time of the incident. I also agree to release and hold Davis County Venues, LLC harmless from their negligence or negligent instruction, supervision, inspection, or maintenance of the property, automobile, or facility that I am using at, or driving to the Davis County Venues, LLC Facility located 772 E 700 S Suite 4 Clearfield Utah 84015. 2) Indemnification - I forever agree to indemnify and reimburse "Davis County Venues, LLC" for any and all damages, liabilities, claims, foreseeable and unforeseeable consequences relating to physical or other injuries, death, or damage to myself and anyone with me at the time of the incident that may incur due to my presence or actions, or the presence or actions of members of my family or my household, or individuals I invite with me during any activity, or while using the facilities at any facility, or while driving to any Davis County Venues, LLC facilities, especially located at 772 E 700 S Suite 4 Clearfield Utah 84015 or it's Owners Andrew and Tresa Brinton or any of their employee's vehicles parked at 772 E 700 S Suite 4 Clearfield Utah 84015 on after, or anytime during or before your event. I also Release - For myself and anyone who claims by and through my stead, I forever release and promise not to sue "Davis County Venues, LLC", its owners or employees, and/or any other person using the facilities at for Davis County Venues, LLC who are in any way associated with "Davis County Venues, LLC", to the maximum extent allowed by law, from any and all liability, claims, demands, damages, or any other legal responsibilities in any way related to "Davis County Venues, LLC's” or participating in any program affiliated with "Davis County Venues, LLC", whether at 772 E 700 S Suite 4 Clearfield Utah 84015 property or elsewhere, including but not limited to damages or liability resulting from the negligence of "Davis County Venues, LLC" for instance for a slip on black ice while walking to or front the facility located at 772 E 700 S Suite 4 Clearfield Utah 84015 to the maximum extent allowed by law. 3) Inspection - I agree that participation in any program affiliated with "Davis County Venues, LLC" is an acknowledgment that I have inspected the premises, facilities, equipment, and programs and that I find them to be safe for my observation, use, and participation. I make this acknowledgment for myself, my personal representatives, heirs, assigns, and next of kin. Employee Confidentiality Statement 4) Regardless of Location - I understand that while using the facilities at "Davis County Venues, LLC location 772 E 700 S Suite 4 Clearfield Utah 84015 I will take full responsibility for any on and all other off-site activities (parking lot included), regardless of where Davis County Venues, LLC's programs or activities take place. 5) Medical Consent - If I should suffer injury or illness, I take full responsibility for this action. Further, I agree to be fully responsible for the cost of any such medical treatment. Additional damages to the venue will result in additional charges for repairs or extensive cleaning as deemed necessary by the venue management. In the event that the cancellation happens within 30 days of the event, in addition to the upfront weeknight or weekend payment, a down payment of $500.00, and a headcount payment ($10 per person) cancellation fee of $500 will be issued. In the event of cancellation within 30 days of the event, the above charges apply and the cancellation fee of $500.00 is due immediately. The customer agrees that any of the above charges will automatically be made to the bank account and routing number Davis County Venues, LLC has on file for the Customer. Catering: Outside catering is allowed no in-house catering is offered. A final headcount will need to be provided to your event manager 30 days prior to your event. Please note that you will be charged for the number of guests specified, even if the guest count is lower than anticipated. Any changes to the guest count must be made 30 days in advance ($10 per headcount). No other food or drink items should be brought into the venue except items for personal consumption.
