This unique property offers rolling hills, canyons, prairies, and beautiful streams and rivers that run throughout. Our treehouse cabin sits above the creek bed and offers stunning views. Relax and unwind as you listen to the birds chirping, trees blowing, and water running down the riverbed. The entire property is available for your private use to explore and enjoy during your stay. The space Our home is furnished with modern essentials for a lovely and relaxing stay including High Speed WIFI. There is an oven, dishwasher, microwave, gas grille, and laundry room. The home is completely furnished and is outfitted with a pool table, dart board, bar area, and leisure reading material and games such as jenga. Please contact us with your plans so we can help answer all your questions. Please confirm the total guest count on booking and number of vehicles if more than 2 total. Our home's climate is similar to a cabin. There is central heat and ac but the house plays better with the natural climate and is always cooler then city temperatures. For extra warmth there are portable radiators and a virtual heated fireplace with remote built into the TV stand. The second king bed is in the upstairs loft above the dining room. A vertical ladder leads to it and is included in our listing photos. Guest access There is a gated entryway private for your access. Other things to note Please note, given that this is a nature preserve, it is not a manicured property since we follow wildlife preservation guidelines. We suggest hiking boots and rubber boots to fully enjoy the property safely. =========================== The maximum number of guests allowed on the property at any time are 4 people and must be part of the same extended family. A maximum number of 2 vehicles are allowed on the property. We can make exceptions if discussed ahead of time. Thanks! =========================== PET POLICY Furry friends are welcome and please let us know how many are coming. Pets must be kept off furniture and bedding and in the loft area. We will charge extra for pet cleaning. Please pick up after your dog by the house. If dog poop is visible we will charge. =========================== NO FIRE ARMS of any kind allowed on the property. NO SMOKING inside the home, including pipes/cigars/etc. NO PARTIES or large gatherings. NO FIREWORKS. =========================== There are 2 video cameras present - directed at the parking area in front of house. They are white and square and easily visible. Cellular service/data works well all around the property outside and within most of the house. It will tend to act funny when going from outside to inside the house and vice versa. There is a smart TV for streaming and a DVD player with included collection of movies. I (we) agree to abide by its terms and conditions and also by the terms and conditions of this Release, Consent and Assumption-of-the-Risk Agreement. WARNING OF THE DANGEROUS CONDITIONS ON PREMISES FIREARMS ARE PROHIBITED ON THIS PROPERTY. GUESTS AGREE TO ACCEPT ANY AND ALL RISKS OF INJURY OR DEATH, PROPERTY LOSS OR DAMAGE. The dangerous conditions listed below serve to warn me (us) and make me (us) aware, appreciate and understand that dangerous conditions, risks and hazards exist, both obvious and latent, both natural and man-made, that can cause serious bodily injury or death and damage or destruction of my (our) personal property. These dangerous conditions include, but are not limited to, poisonous plants; poisonous snakes, insects, and spiders; elevated blinds and stands, whether or not erected by Lessor; eroded areas, holes, uncovered wells, steep inclines, sharp and jagged rocks and hidden obstructions located both on and off roadways and trails that create rough, hazardous and dangerous driving and walking conditions; animals both wild and domestic that may be diseased and/or possessed with propensities to injure or kill; rushing and still water with perils lurking above and beneath the surface; trees and tree limbs, both dead and alive, that may fall unexpectedly without warning. I (we) further acknowledge and understand that no warranty, either express or implied, is made by the Lessor as to the conditions of any roadway or trails, building, fences, gates or other improvements on the premises, or the premises itself, that dangerous conditions do exist and that this document is sufficient warning that there are numerous dangerous conditions, risks and hazards involved on the premises, and in the use of the improvement situated thereon. Waiver and Release of Claims In consideration for the right to enter the premises, I (we) hereby waive and release all claims and agree to indemnify, defend and hold harmless the Lessor named above, his or her (or the) respective owners, heirs, agents, employees, and assigns from and against any and all claims, demands, causes of action and damages, including but not limited to court costs, judgments and attorneys’ fees resulting from any accident, incident or occurrence arising out of, incidental to or in any way resulting from the use of or my (our) exposure to the conditions of the leased premises or the Lessor’s active or passive negligent conduct thereon. Also, I (we) hereby further understand and agree to abide by all the rules, provisions and terms of the Rental Agreement as set forth by the Lessor. It is understood that I (we) will be in breach of this agreement in the event that I (we) fail to follow the rules and terms. I (we) understand that by failing to do so may void this agreement, and the agreement may then be canceled at the sole discretion of the Lessor. In that unlikely event, I (we) forfeit any present and future claims to the leased premises in regard to the remaining term of the original agreement. Assumption of the Risk I (we) hereby agree and declare that the “WARNING OF DANGEROUS CONDITIONS ON LEASED PREMISES” stated earlier serves to warn me (us) of any actual or potentially dangerous conditions that I (we) may reasonably expect to encounter on the leased premises that may cause serious bodily harm or death or cause damage to or destruction of my (our)personal property. By affixing my (our) signature(s) below or electronically, I (we) knowingly and expressly assume the risk of my (our) exposure to the dangerous conditions, risks and hazards expressed above. This assumption of the risk may be used by the Lessor as a defense in a court of law as outlined by the Texas Supreme Court in Farley v. M.M. Cattle Co., 529 SW 2d 751, against any allegations either for negligence or gross negligence for failing to warn me (us) of any dangerous natural or man-made conditions that I am (we are) apt to encounter expectedly or unexpectedly. The Severability Clause If any term, provision, covenant, release, assumption, or condition of this agreement is held by a court of competent jurisdiction to be invalid, void, or unenforceable, the remainder of the provisions shall remain in full force and effect and shall in no way be affected, impaired or invalidated. Length of Agreement This Release and Assumption of the Risk Form applies during the time that I am (we are) permitted on the leased premises, now and in the future, and until this agreement is revoked in writing. Parental, Guardian and Supervisory Responsibility for Minors and Indemnification for Injuries or Death As a parent, guardian, or custodian, I am signing this document on behalf of the minor child or minor children in my charge and agree to be specifically bound to all the terms and conditions of this Rental Agreement. In consideration for allowing minor(s) to accompany me on the leased premises, I agree to keep close supervision of the minor(s) in my watch and care at all times. I further agree to indemnify the Lessor for all present and or future claims stemming from the injury and/or death of a minor or minors in my watch and care caused by my lack of or negligent supervision. Fees I agree to pay for any and all damages to the leased premises that are caused by any negligent, reckless and or willful actions by me or a guest(s).
