Welcome to Casa Playa Conchal, in English, Shell Beach house. This unique beach house has a style all its own. With touches from Mexico and Latin America, it will delight your eyes. The house has a perfect location, half a block to the beach and one block to shopping, groceries, coffee shops and restaurants. Want more action, we are a 5-minute drive to downtown Pismo and Pismo State Beach, 7 minutes to Avila Beach, and 10 minutes to San Luis Obispo. Welcome to Shell Beach! The space We think you have just found the perfect beach house for your stay in Shell Beach. Casa Playa Conchal has it all. Stylish and packed full of charm and design. Our beach house, Casa Playa Conchal means Shell Beach house in Spanish. Casa Playa Conchal is full of natural light and will charm you from the moment you walk through the arched front door. Both bedrooms have original hardwood floors from the 40's that were just refinished. The Living room, kitchen, and bathroom have tile floors. We have designed this house thoughtfully with repurposed and recycled pieces with art and accessories from out time living in Costa Rica. The living room has a sofa with lounge to relax on and watch the large, smart TV with all the apps. We have high speed internet for those working remote and for keeping in-touch. The gourmet kitchen, fully equipped with new appliances and a subzero refrigerator, is where you can enjoy cooking. It is stocked with basic spices, staples and all small appliances to make any meal, simple or elaborate easy. There is seating around the island for meals or there is a small dining table between the kitchen and living room. The best part is the coffee/tea bar for all types of coffee preparation styles. There is even a "chorreador," a coffee making device used in Costa Rica in which hot water leaches through coffee grounds held in a cloth filter mounted on a wooden stand, you will love it. There are two bedrooms with super comfy queen beds and high end linens that feel so good. Each bedroom has a slider that leads out to the adjoining patio and back yard. There is a Jack and Jill full bathroom between both bedrooms that is light and airy with a double shower for two! Each bedroom has a closet and dresser. One of the most amazing amenities of this house is the resort style back yard. There is an outdoor shower with hot water, table and chairs for meals and a patio conversation set with a fire pit for cold evening. You will want to spend most of your time here, day or night. The yard is covered in plants and high fences making it very private. In the morning there is full sun to brighten your day and enjoy your coffee. At night you can BBQ and sit under the patio string lights which are magical. The laundry facility is located in the garage where there is an iron and ironing board. Just when you think it can't get any better, walk to the end of the street. There you will find a coastal trail and small park to sit and watch sea life and sunsets. When you are ready to branch out and explore the outlying areas, there are endless activities like wineries, hiking, golf, and farmer's markets. Try your luck at fishing of the Pismo Pier or in Avila. There is hiking and several surf spots close by and kayaking and stand up paddle right at the end of your street. If you do not bring your own bikes, there is a rental shop right on Shell Beach Road to find the bike that meets your need. What are you waiting for? Come spend a month or two at Casa Playa Conchal in Shell Beach. Guest access You have full access to the house, garage and yard. Parking is in the driveway or on the street as the garage is small. The owner has some items stored in the garage that are off limits to guest please. Other things to note Dogs are allowed with approval by owner. Non refundable pet fee $200 per month. Additional details about your rental. We require a monthly cleaning if the stay is longer than 1 month. It is our way to maintain the quality and cleanliness of our beach house. Your first month rental price includes the move out cleaning. If your stay extends beyond a month, subsequent cleanings will be charged to you separately at $200.00 per month. SUPPLIES: We have a starter set of soaps, paper towels, and toilet paper for you upon your arrival. Once those supplies are depleted you will need to purchase your own. The Villa is furnished with linens, cookware, dishes and some spices and pantry essential. This casa is for two guest only. We will consider a small dog under 45 lbs, that is an acceptable breed from our insurance company for a monthly pet fee of $200.00 Guest are permitted for up to a 3 night stay only. Below is our rental agreement with additional information. “JUST FOR TWO VACATION RENTALS,” RENTAL AGREEMENT Terms and Conditions This Vacation Rental Agreement (the “Agreement”) is made by and between Just for Two Vacation Rentals JFTR, Jolene Clarke the Homeowner, and “Renter” as of the date last set forth on the acceptance of this rental through Airbnb or the VRBO forum. For good and valuable consideration, the sufficiency of which is acknowledged, the parties hereby agree as follows: 1. Property: The property is located at: Villa Amapola, Shell Beach CAThe property is furnished and includes kitchen dishes/cookware necessities, linens, towels and basic toiletries. 2. Rental Party: The rental party shall consist of the up to two Renters, both names added to the reservation prior to booking. The maximum number of the rental party is two. The rate per night of occupancy is based on the number of nights reserved, minimum 30 days. Overnight guest are permitted with owner approval for a maximum of a 3 night stay. 3. Maximum Occupancy: The property is rented as a vacation residence only. The maximum overnight occupancy stated in Paragraph 2 above. Maximum temporary occupancy should not exceed 4 total. These limits are required by law and are for the safety and protection of occupants and property owner(s). Any child two years old and above is considered an occupant and must be included in the occupancy total. If you are found to exceed the maximum occupancy and/or maximum temporary occupancy of your property it will be considered a breach of contract and will result in immediate eviction, forfeiture of security deposit and no refund of unused nights will be given in this instance. Renter acknowledges the following State of California-Health and Human Services Agency guidance for the Prevention of COVID-19 transmission for gatherings. 4. Payments: Renter agrees to pay all rent and associated fees, accept all terms of the lease agreement and accept all liability for any damage not covered by the Property Damage Insurance and security deposit and/or beyond normal wear and tear during the term of the rental with JFTR. 5. Security of Rental contents: Rental party shall not make any alterations in or about the property including, but not limited to relocating furniture, painting, wallpapering, adding or changing locks, installing/moving antenna or satellite dish, placing signs, displays or exhibits, using screws, fastening devices, large nails or adhesive materials. Rental party shall not move or remove ANY item from the property, even on a temporary basis. The renter agrees to be charged additional fees for excessive cleaning or laundry services, repairs or replacement of any items related to the Rental party’s stay, a detailed summary of the charges and will be provided by mail/email to the Renter. The sum of item charges will be charged within one week of departure. 6. Arrival & Check-in Time: The rental begins 3:00PM and ends at 11:00AM. Early check-in or late check-out is not guaranteed. Villa Amapola is self Check-in unless otherwise stated . 7. Departure and Check-out Time is 11:00 a.m. – NO EXCEPTIONS: Timely checkout is enforced. Upon checking out, leave the keys inside the unit on the counter. If the property keys are not returned upon check-out, JFTR is authorized to charge the Renter for the costs of re-keying or replacing all locks and re-issuing keys. 8. No Show/Early Departure Policy: JFTR is not responsible for rental party’s inability to arrive on time or for rental party’s inability to remain in the property through the end of the scheduled stay. NO REFUNDS of unused nights will be given. 9. Key Box Codes/Door Codes/Keys to Property: Codes will be released only to the Renter. 10. Cancellation Policy: Cancellations must be submitted in writing and confirmed by JFTR. The cancellation policy applies unless other arrangements have been pre-agreed upon and are documented. We use the cancellation policies documented on the Airbnb and VRBO websites for stays of 30 nights STAYS GREATER THAN 30 NIGHTS: • 60 or more nights prior to arrival date - cancellation fee $750 or 25% of rental amount, whichever is greater • Between 60 and 30 nights to arrival date - cancellation fee 50% of rental amount • Within 30 nights to arrival date - no refund Renter has read and understands the cancellation policy based upon their arrival date when they sign below. 11. Refunds: This Vacation Rental Agreement is a legally binding agreement between Renter and JFTR. JFTR will make every effort to correct any problem that arises during your stay in a timely manner subject to the terms of this agreement. There will be no refunds or compensation for events out of JFTR's control including but not limited to: Acts of God, Mother Nature, acts of war or government agencies, road maintenance, power outages or water outages, construction or maintenance work in the vicinity, equipment failures, road conditions, proximity to other dwellings, business closures or area event schedule changes. 12. House Rules: Renter agrees to abide by the House Rules attached, if applicable to property, at all times while at the property. Renter is responsible for all members of the rental party and any visiting guest to the property. 13. Alcohol/Drugs: No drinking of alcoholic beverages by persons under the legal age of twenty-one (21) is allowed. If any of the rental party is arrested for underage drinking at rental properties or if JFTR observes any of the rental party or visiting guests under the legal age of twenty-one (21) drinking alcoholic beverages, JFTR reserves the right to terminate this Agreement and evict the rental party and visiting guests with no refund. Illegal drug use is strictly prohibited and prosecuted to the fullest extend of the law. 14. Cleaning Fee: Cleaning fee is non-refundable and is applied to restoring the property to a professionally cleaned condition after rental party departure including laundering of linens. The cleaning fee is $400.00 per month for the first month and $300.00 each additional month. This fee included a cleaning every 2 weeks and a final deep clean upon departure. Not included: returning any furniture that has been moved, washing excessive kitchenware, cleaning excessive scuff marks or food/drink spills from floors and walls, laundering excessive or soiled linens, waste disposal and removal of any carpet stains that result from anything other than normal foot traffic will incur additional cleaning fees of not less than $100, based on a $65/hour labor rate. 15. BBQ & Fire Table Use: Properties with propane BBQ grills and fire tables are fueled by liquid propane or natural gas. Under NO circumstances may the rental party or visiting guests add charcoal or any derivative of charcoal to the grill or fire table. Under NO circumstances may the rental party or visiting guests use a deep fryer (ie turkey deep fryer) on exterior concrete, decks or balconies. If the rental party or visiting guests add charcoal to a propane or natural gas grill or use a deep fryer, JRTR is authorized to charge not less than $250 through Airbnb or VRBO platforms. 16. Fireplaces/Candles/Fire pit/tables: Renter agrees that no fire will be left unattended. If property is equipped with a gas fireplace that must be turned off when Renter is not in the unit. Renter agrees there will be no candles burned at all during your stay. Renter agrees there will be no cooking of food (including roasting marsh mellows) in fireplaces or fire pits/tables. Cleanup to these areas will be charged additional cleaning fee of not less than $250 to Renter’s through Airbnb or VRBO platforms. 17. Internet/ TV: Internet speed cannot be guaranteed. NO REFUNDS OR REBATES will be offered if rental party is unhappy with the availability of channel programming or Internet speed offered. The property has a smart TV to access movie and gaming apps. 18. Conduct/Innkeeper Law: Occupancy and use of premises shall not be such as to disturb or offend neighbors or residents by means of including but not limited to: parties, excessive speeding through neighborhoods, riding of ATV’s or Off Road Motorcycles/Dirt Bikes, excessive noise and/or obnoxious behavior, discharging of Firearms, BB/Pellet Guns, Paint Ball Guns, Water Guns or Fireworks (illegal in most SLO County cities) or any other noise-inducing mechanisms. Also, rental party shall not disturb, annoy or interfere with the right to quiet enjoyment of any neighbors surrounding the property. Any disturbance calls from neighbors, police department or individuals to 7SVR will automatically terminate contract and will result in immediate eviction, forfeiture of unused rental nights and the full amount of the security deposit. 19. Damage to Property: Premises are to be left in undamaged condition. Properties have been cleaned and inspected prior to rental party’s arrival. The Renter must notify JFTR if any damages or defects are noticed within 24 hours of arrival. 20. Damage Protection Insurance: You are encourages to purchase damage protection policy for longer stays. 21. Furnishings/Furniture: All properties are privately owned, furnished and equipped by us, the owner. If rental party requires special appliances or equipment, please bring them with you. Furnishings are subject to change without notice. Loss of these items, as well as damage to the property or furnishings in excess of normal wear will be charged to the Renter. Certain closets, cabinets and or rooms may be locked by the owners for their personal storage and are not included in this rental, tampering with locks will be considered a violation of agreement and result in a fee to cover damages and loss. 22. Linens: A standard supply of linens is provided in each property. Bed linens are changed at the mid-stay cleaning. As well as towels. Shampoo, bath soap, hand soap, dish soap, toilet tissue, paper towels, dishwasher and laundry detergent and trash bags are not replenished during month stay and longer rentals. We supply a starter set upon arrival and the guest will need to purchase own after that. Linens washed by the guest during their stay must only be washed with same color. White towels should only be wash and thoroughly dried alone. 23. Items Left Behind: JFTR is not responsible for any item rental party leaves behind intentionally or unintentionally. We will remove all items left behind and dispose of them after 30 days of checkout. If Renter requests item(s) to be returned, Renter agrees to and authorizes JFTR to charge a $30 fee for shipping/handling. 24. Lockout: A lock-out of rental party from a property will result in a $100 service call during business hours to provide access to property if Renter is unable to pick-up an extra key at a mutually agreed upon location. A lockout after business hours will result in a $250 service call and Renter being charged accordingly. We feel we have a fail safe system with the key box out front so this should not be an issue. 25. NO SMOKING, NO VAPING – NO EXCEPTIONS! This property is a non-smoking and no-vaping property. There is to be no smoking within 20 ft of the building. If a person in the rental party is found to be smoking within the defined 20 ft parameter, the rental party will be immediately evicted. There will be no refund of unused rental nights. Renter will be responsible for rental party’s damage caused by smoking including but not limited to removal of stains, burns, odors and any replacement of furnishings damaged by the smoke. Renter agrees to pay no less than $500 for damaged goods, odor abatement and/or cleanup of cigarette butts. Any cost for smoke cleanup will be deducted from the Security Deposit or charged through Airbnb or VRBO. 26. Pet Policy: animals are NOT allowed at this property unless cleared and accepted by the owner. Our insurance has a list of pets they will not permit on the property. If an exception is made to the Pet Policy we will need a photo of your dog and by signing this agreement you are acknowledging that your pet is up to date on all vaccinations. Violation of stated Pet Policy, bringing a pet without owner consent, the following will apply: A pet on the property or premises is breach of this agreement and will result in immediate eviction, forfeiture of unused rental nights and charges not less than $500 to remove pet hair, dander or other pet-related material from furniture, linens or carpet. Any cost for pet related cleaning or replacement of damaged items will be charged to your Airbnb or VRBO account. The renter agrees by booking this property, they acknowledge that they will pay a pet fee of $200.00 per month, non refundable, and that any damage done by the animal with be paid by the renter through the Airbnb or VRBO forum. 27. Security Equipment: JFTR properties utilize cameras to monitor the exterior doors to the house and garages and utilize noise awareness devices for the protection of the property and safety of our homeowners, neighbors, employees and guests. If rental party tampers, moves or covers a security device JFTR is authorized to charge not less than $500 to renter through Airbnb or VRBO. 28. Maintenance: Rental party shall properly use, operate and safeguard the property including, if applicable, all furniture, furnishings, appliances and all mechanical, electrical, gas and plumbing fixtures and keep them clean and sanitary. Renter shall immediately notify JFTR of ay problem, malfunction or damage. Renter shall pay for all repairs or replacements caused by rental party, friends of rental party, excluding ordinary wear and tear. Renter shall pay for all damage to the property as a result of failure to report a problem, malfunction or damage in a timely manner. Renter shall pay for repair of drain blockages or stoppages, unless caused by defective plumbing parts or tree roots invading sewer lines. Renter will be responsible for the cost of any unnecessary maintenance service call charges. 29. Urgent/Emergency Service Calls: In case any equipment malfunctions, Renters shall call the owner immediately. We will arrange for repairs and initiate an urgent service call, if needed. Every effort will be made to correct any urgent situation in as little time as possible. We cannot guarantee against malfunctions of heating, electricity, water, any appliances, cable satellite, television, telephones, electronics, gas logs, grills, etc. No refunds or compensation will be given for failure of the above. 30. Right of Entry: Owner and and its representatives have the right to enter the property, at any time, (a) for the purpose of making necessary or agreed repairs, improvements, decorations, alterations, for maintenance or to supply necessary or agreed services; (b) to verify that rental party has complied with the terms of this Agreement; or (c) Owner and Owner’s representatives have the right to enter the Property, upon reasonable notice, to show the property to prospective or actual purchasers, renters, tenants, mortgagees, lenders, appraisers or contractors; (d) in case of emergency. 31. Listing Information: Information on the listing of this property is as accurate as possible but cannot be guaranteed. Rates, furnishings, fees and taxes on listing are subject to change without notice. Please call or email to confirm information prior to booking. 32. Indemnification and Hold Harmless: Renter and rental party shall be solely responsible for any property damage, accident or injury to any person or loss sustained by any person, including loss of money, jewelry and other items of personal property, arising out of or in any way related to rental party’s use of the premises or the items of personal property provided by JFTR. Renter shall inspect and be familiar with proper use and application of such items prior to using them. Renter and rental party hereby agree to INDEMNIFY, defend and hold harmless agent(s) and its employees, owners and officers /or property owner from all claims, disputes, litigation, judgments, costs and attorney fees resulting from loss, damage or injury to Renter, rental party or guest of rental party from any and all claims including those of third parties, arising out of or in any way related to rental party’s use of premises or the items of personal property provided therein. Renter hereby agrees to hold JFTR, its contractors, owners and officers and/or property owner, harmless and to indemnify same against any and all claims that arise pertaining to any event during the course of rental as a consequence of any acts or omissions of JFTR, its employees/contractors, its officers and /or owner. We recommends that Renter carry or obtain travel insurance to protect rental party and guest of rental party. Renter or his/her personal property, including vehicles, are not insured by JFTR or property owner against loss or damage due to fire, theft, vandalism, rain, water, criminal or negligent acts of others or any other cause. Property owner does not insure against personal injury to rental party or guest of rental party due to any reason other than the condition of the property. Renters assume the risk of injury or other losses relating to any recreational activities and will hold owner and its agents harmless with respect thereto. 33. Joint and Individual Obligations: Should there be more than one renter, each one shall be individually and completely responsible for the performance of all obligations under this Agreement, jointly and individually with every other renter. 34. Refusal of Service: JFTR reserves the right to refuse service to anyone. Our property will be leased without regard to race, color, religion, sex, national origin or handicap. Due to liability issues, the owner is unable to provide prospective renters with keys to preview properties. 35. Licensee of Owner: Renter is a licensee of the property owner and not a tenant; renting the premises in no way constitutes the Renter acquiring interest in the property. 36. Violation of Agreement: A material breach of this Agreement by renter party, which, in the sole determination of the owner results in damage to the premises, personal injury to Renter, rental party or guest of rental party, a breach of the peace, a nuisance to others or a violation of criminal law or local code, shall be grounds for termination of rental party’s tenancy. Violation of any of the rules contained herein will result in IMMEDIATE EVICTION with NO REFUNDS of unused rental nights. 37. Disputes: This Agreement shall be governed by and interpreted in accordance with the laws of the State of California and be treated as though it were executed in the County of San Luis Obispo, State of California. Any action relating to this Agreement shall be instituted and prosecuted only the San Luis Obispo County Superior Court, California. Renters specifically consent to such jurisdiction and to extraterritorial service of process. 38. Date Accepted: I have read the terms and conditions and understand and agree to abide by them. The parties agree to the terms of this Rental Agreement, as evidenced by receipt of security deposit. This agreement is executed per the electronic timestamp and signature of this Rental Agreement. By requesting a reservation with Jolene Clarke for Villa Amapola or Casa Playa Conchal, you have accepted and agree to the terms of our rental agreement.
