Located in Newport, this gorgeous home has Beach Access just a few steps from the front door. This 2 story home has some unique features including: -Fantastic view of Yaquina Head Lighthouse -A hot tub on the patio -Glass gazebo, perfect for sipping wine or hot cocoa while watching the sunset -Outdoor fire pit -BBQ -Deck -Indoor gas fireplace -Walking distance to nearby stores and restaurants The home sleeps 10 with 4 bedrooms: -2 King Master Suites -1 Queen Bedroom -2 Twins beds in one bedroom 2 Twin beds in the living room on the bottom floor (1 twin bed, 1 twin trundle) There are 4.5 bathrooms: -2 are within the King Suites -1 is a Full downstairs Bathroom -1 is a Full upstairs Bathroom -1 is an upstairs Half Bathroom Overall, this home is charming, beautifully decorated, and is very private. Come and enjoy the most beautiful and scenic area of the Oregon coast in our outstanding beachfront home! Devon West is not permitted as a short term rental. All rentals are leased for 30 day increments with discounts for longer stays *Sunday check in time is after 5 p.m. *Monday-Saturday check in time is after 3:30 p.m. *Checkout is by 10:30 a.m. every day Devon West is a privately owned home and is managed by Oceanside Homes and Design. Amenities and furnishings are subject to change at any time. If you have any further questions, please reach out to us directly, and we will be happy to answer. Other things to note Oceanside Homes and Design Rental Agreement & Property Damage Protection Clause This Vacation Rental Agreement (“Agreement”) is for rental of the vacation rental property specified in a confirmed reservation (the “Property”). This Agreement is between: (1) Oceanside Homes and Design, (“we” or “us”), acting for itself and for the owner of the Property (“Owner”), and (2) the person who is the responsible renter of the Property (collectively “Renter” or “you”). By booking your rental of the Property with Oceanside Homes and Design, you acknowledge that you have read and understand, and agree to be bound by, all terms, conditions, and policies in this Agreement. Summary of Rental Policies The property shall not be used by more than the number of adults and children listed in your reservation. Gatherings or events that exceed the maximum occupancy of the home are not permitted at any time. Guests shall leave premises in reasonably clean and undamaged condition, similar to the way it was upon their arrival. Quiet hours are from 10 p.m. to 8 a.m. Pets are not permitted unless specifically noted in your reservation. Do not cook crab or any shellfish inside the house. If extra time and/or expense is required by our housekeeping staff to remove odors you will be responsible for the expense of deodorizing the home. ($500 MINIMUM CHARGE) NO SMOKING of any kind is permitted in the home. If extra time and/or expense is required by our housekeeping staff to remove odors, you will be responsible for the expense of deodorizing the home. ($500 MINIMUM CHARGE) No commercial photography or filming is permitted on the property. Tents or other structures may not be erected. Property Damage Protection fee of $99 is included on all reservations. This fee covers you in the event of damage that may occur during your stay up to $1,500. If the damage to the home exceeds the amount of coverage, you will be responsible for the extra costs. You are responsible for, and authorize us to charge your card on file for, any additional fees of up to $1,000 for violations of any of the guest policies or for excessive cleaning required by the acts or omissions of any Occupant during your stay Rental Policies Minimum Age. You must be at least 25 years of age to rent the Property. You hereby confirm that you are at least (1) 25 years of age (2) you agree to provide us with proof of age upon request. A parent or legal guardian must accompany all guests under 21 years of age for the entire duration of the rental. Responsible Renter. As the responsible renter, you agree to be an occupant of the Property for the entire duration of the rental. All other occupants will be family members, friends, other responsible adults over 21, or accompanied by a parent or legal guardian. You agree to be solely responsible for your actions and the actions of all family members, guests, and invitees (collectively, “Occupants”) present at the Property at any time during your stay, and to ensure that all Occupants understand and comply with the Terms. Common Sense Expectations. The Property is a privately owned home, and we enforce a common sense policy. You agree to treat the Property with the same care as a reasonable person would with such a person's own residence and leave it in the same condition it was in when you arrived. To prevent theft of or damage to furnishings or your personal property, you agree to close and lock doors and windows when you are not present at the Property and upon check-out. You and other Occupants agree to conduct yourselves throughout your stay in a manner that is respectful of and not disruptive to neighbors, traffic flow, or the community and that will not prompt complaints to Oceanside Homes and Design from police, neighbors, or neighborhood or homeowner associations. Noise audible outside the Property is prohibited between 10 p.m. and 8 a.m. The number of cars you may park at the home is limited to no more than the number of bedrooms at the home plus one. You and other Occupants agree to abide by all applicable parking restrictions and limitations, including complying with any posted parking diagram for the home to ensure proper car distribution. Maximum Occupancy. The number of people present at the Property may not exceed the maximum posted occupancy at any time. Smoking Policy. No smoking of any kind is permitted in the home. Outdoor smoking is allowed. Dispose of cigarettes in the provided outdoor smoking posts. If the home is found to have any odor related to smoking after your checkout, you will be responsible for the expense of deodorizing the home. ($500 MINIMUM CHARGE) Pets. No pets of any kind are permitted at the Property except as specifically authorized in your reservation, or bona fide service animals that we are required by law to allow. Events and Commercial Photography; Structures. Events and commercial photography or filming are prohibited at the Property without our express written permission. (If approved, additional conditions and fees may apply.) No tents or other structures may be erected on the property without our express written permission. Criminal Activity Prohibited. Use of the Property for any criminal activity is prohibited and may result in fines or prosecution. This prohibition extends to use of the Property’s Internet service, if any, for criminal activity, including but not limited to unlawful downloads of copyrighted material, including movies, music, software, or other material. We will cooperate with any investigation of alleged criminal activity at the Property during your stay. Consequences of Breach. Any failure by you or any other Occupants to comply with any of the terms above may result in a forfeiture of your rights to rent the Property, up to and including immediate eviction from the Property without refund. In addition you are responsible for, and you authorize us to bill your credit card on file for, the full amount of: Any damage or loss that occurs at the Property during your stay; A charge of up to $1,000 for violations of the pet policy, including for bringing more pets or different types of pets than specifically authorized; An additional cleaning fee of up to $1,000 for violations of any of the guest policies above (other than the pet policy) or for excessive cleaning required by the acts or omissions of any Occupant during your stay; and Any fines issued by police, other government officials or agencies, utility providers, and/or homeowner associations for violation of any law, ordinance, or rule during your stay, and any damages (which may exceed the amount of fines) that result from the violation. If any unauthorized download of copyrighted material via the Property’s Internet service occurs during the period of your stay, you agree that we may share your contact information with the Internet service provider or any other party we reasonably believe has enforcement rights. Additional Terms and Conditions Cancellation Policy. If a reservation is confirmed by payment 60 days or more prior to arrival, and is canceled 60 days or more prior to arrival, all payments will be refunded. If a reservation is confirmed by payment less than 60 days prior to arrival and then is canceled, all payments will be forfeited. However, we will make every effort to re-rent the days at the same rate; if successful, we will refund 100% of your payments. If we are able to re-rent them at discounted rates, we will refund you at the discounted rate. If you shorten your stay, there will be no discount or refund. Neither late arrival nor early departure warrants any refund of rental rate, cleaning fee, or Property Damage Protection. Except as expressly provided in this Agreement, no refunds or compensation will be given if the property is unavailable for any reason outside Oceanside Homes and Design’s control, including but not limited to, adverse weather conditions, natural disasters, mechanical failures, acts of government agencies, or utility outages. Oceanside Homes and Design advises guests to obtain appropriate travel insurance. Early Check-In/Late Check-Out. Early check-in or late check-out may be available; additional charges may apply. If you do not vacate by check-out time (or late check-out time as agreed by Oceanside Homes and Design), you authorize us to bill your credit card on file for a late departure fee of up to one night’s rental and we may remove all Occupants and their personal property from the Property. Housekeeping may enter the Property at the time of check out regardless of whether all occupants have left. Arrival/Departure. Check in time is 3:30 PM PST Monday-Saturday and 5:00 PM PST on Sunday. Check out time is 10:30 AM PST. No early check- ins or late check-outs, unless stated in writing in your confirmation. Maintenance or Housekeeping Issues; Property Conditions. The Property is provided as is, and we are not responsible for the interoperability or unavailability of any amenities. You agree to contact us as soon as you notice any maintenance or housekeeping problem, or any potentially hazardous condition, at the Property, or if any incident occurs at the Property that is related to such a problem or condition. We will take reasonable and appropriate steps to remedy any reported problem as soon as practicable. We may enter the Property at your invitation to remedy any problem you report, at reasonable times and with reasonable notice to inspect, maintain, or repair the Property, and to address any situation that we reasonably deem an emergency that threatens persons or property. You acknowledge that if the Property has access to amenities that are shared with other properties, such as a shared pool, hot tub, parking lot, beach access trail, or fitness center, that the availability and condition of those amenities is outside Oceanside Home and Design’s control. Property Damage Protection Policy. By agreeing to the Rental Agreement with Oceanside Homes and Design, and as part of your full payment of your rental fee including the Damage Protection Insurance, you have coverage for accidental damage to home furnishings or loss of keys that could occur to a rental property during your stay. If the damage to the home exceeds the amount of coverage, $1,500, you will be responsible for the extra costs. If the stay is canceled at least 24 hours before you arrive, your $99 policy fee will be refunded. This coverage does not apply to any additional housekeeping charges over the usual and customary, due to your failure to follow our check-out instructions or to comply with common sense expectations set forth in Section 3 (Common Sense Expectations) above. Additional fees may be charged if the following conditions are not met: No damage is done to the home, its landscape, or its contents, beyond normal wear and tear. Guests shall leave premises in reasonably clean and undamaged condition, similar to the way it was upon their arrival. In the event the Guests leave the unit in a condition that cannot be made ready for the next guests, the Guests will be responsible for lost rental revenue. No charges are incurred due to contraband, collection of rents, or fees for services rendered during the stay. Food is removed from the refrigerator; all debris, rubbish and discards are placed in the dumpster; and soiled dishes are placed in the dishwasher and started. At least one load of laundry is started. All keys are left in the lockbox and (or) the Property is left locked. All charges accrued during the stay are paid prior to departure. No linen, equipment, and/or personal property is lost or damaged. No early check-in or late check-out has occurred, except by explicit written permission from Oceanside Homes and Design. Neither the renter nor anyone associated with the rental party is evicted by the owner (or representative of the owner), the local law enforcement, or any security company employed by Oceanside Homes and Design Thermostat is turned to 66°F upon departure All interior and exterior lights are turned off upon departure All blinds are left open upon departure Any moved furniture is replaced to its original location. Couches, tables, chairs, lamps, etc. Bed sheets and towels are brought to the laundry room as described in the guest binder All trash from in the home is placed into the appropriate garbage and/or recycling bins outside. Left Items. If you happen to leave an item, we can send your items to you for a $25 handling fee, plus the cost of shipping. We will hold on to unclaimed items for one week. After that, they will be donated. Shellfish. Do not cook crab or any shellfish inside the house; it creates an odor extremely difficult to remove. If extra time and/or expense is required by our housekeeping staff to remove odors (particularly seafood and/or smoke) you will be financially responsible for those costs. $500 minimum charge. Hot tub. There are certain health risks associated with using a hot tub. Use of this equipment is at your own risk. Anyone with a health concern should seek the advice of a medical professional before using a hot tub. Children should always be supervised; children are more susceptible than adults to overheating, and should not stay in the hot tub for more than 5 minutes at a time. Pregnant women should exercise caution and consult a medical professional before using the hot tub. Please do not use the hot tub if you have an open wound, skin condition, or infection. You will incur a fine of $200 if bodily fluids are found in the hot tub. Our maintenance provider sanitizes, refills, and replenishes chemicals in the tub prior to your arrival. Please do not adjust or tamper with fixtures and settings, including filters. DO NOT ADD ANY CHEMICALS, SOAPS, OILS, BUBBLES, OR OTHER SUBSTANCES TO THE HOT TUB, AS THIS MAY CAUSE DAMAGE TO THE UNIT, AND YOU WILL BE LIABLE FOR CLEANING AND/OR REPAIRS. Hot tub covers are for insulation purposes and are not designed to support a person or persons. Do not stand or sit on the hot tub cover as it may break. Always have 2 people (one on each side) when removing the hot tub cover. Remember - when not using the hot tub, leave the cover on so the hot tub will stay warm, and secure the straps to keep the cover in place if the wind comes up. ANY DAMAGES TO THE HOT TUB COVER WILL BE CHARGED TO THE PERSON WHOSE CREDIT CARD SECURES THE RESERVATION. Fire pit. If there is a fire pit on the premises. Please use extreme caution when in the area of the fire pit, stay aware of the wind direction and force, and closely supervise children at all times. Please close all doors and windows on the ocean side of the house to keep smoke out; once in the house the odor is very difficult to eliminate, and you may be financially responsible for the cost of smoke removal. Choice of Law and Venue for Disputes. Unless otherwise specified in any Unit-Specific Terms, if the Property is outside of the continent of Europe, this Agreement shall be governed by the law of the State of Oregon, U.S.A, without regard to its conflict of laws provisions, and both parties consent to the exclusive jurisdiction and venue of the state and federal courts of Multnomah County, Oregon, U.S.A. Limitation of Liability. TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO CASE SHALL OCEANSIDE HOMES AND DESIGN, OWNER, NOR THEIR RESPECTIVE AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR OWNERS, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR EXEMPLARY DAMAGES, OR FOR ANY DAMAGES FOR DEATH, PERSONAL OR BODILY INJURY, EMOTIONAL DISTRESS, OR DAMAGE TO PROPERTY, ARISING OUT OF OR IN CONNECTION WITH YOUR STAY AT THE PROPERTY. THIS LIMITATION APPLIES TO ALL CLAIMS FOR DAMAGES WHETHER BASED ON A THEORY OF WARRANTY, CONTRACT, TORT (INCLUDING ORDINARY NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, EVEN IF OCEANSIDE HOMES AND DESIGN HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE AND EVEN IF THE LIMITED REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE. Indemnity. You agree to hold harmless and indemnify Oceanside Homes and Design, Owner, and their respective affiliates, officers, directors, employees, agents or owners for all from and against any claims, losses, costs, expenses, damages and liabilities, including reasonable attorney fees, for property damage, personal injury, or monetary loss resulting from your actions or omissions, and the actions or omissions of other Occupants, during your stay, including, but not limited to, in the case of bodily injury, death, and property damage, whether or not caused by the negligence of Oceanside Homes and Design, Owner, and their respective affiliates, officers, directors, employees, agents or owners. Substitution of Property. On rare occasions, due to ownership changes, properties being removed from rental use, or a need for extensive repairs or maintenance, the Property may not be available for rental on the dates of your reservation. In this unlikely event, Oceanside Homes and Design reserves the right to substitute a comparable property. If comparable accommodations are not available, you will have the option of (1) selecting from other available properties (in which case you are responsible for, or will receive the benefit of, any difference in cost) or (2) receiving a full refund of your reservation payment. In the event of a substitution of rental properties, all Terms in this Agreement, plus any Unit- Specific Terms specific to the substituted property, shall apply to your stay in the substituted property. A breach of any of the above terms may result in a forfeiture of your rights regarding this rental property, including eviction from the premises without refund.
