Charming and cozy farmhouse with beautiful views of the mountains and snuggled at the end of a private country road. Located in California's beautiful Central Coast. Stunning wineries located 15-20 minutes north or south; 20 minutes from most beaches; and 15 minutes from Cal Poly. Privately driven tour option for an additional cost to wineries or to local and coastal areas, shops, and dining. But this is also the perfect place to just lounge or take in the quiet and the beauty of country life. The space The quiet home sleeps 6 - two queens, two twins. The floor plan is open, has a fully stocked kitchen, entertainment, wood burning stove, and designated work space. EZ Living Farm is located atop a small hill on three acres. Guests will have access to the entire property and all its amenities, with exception of three outer, small storage structures. There are quiet vignettes around the home; a grassy backyard and side yard; with access to the jacuzzi, hammock, and picnic table and outdoor furniture. The spacious outdoors have friendly animals; and obliges those who like leisure, safe, long walks in all directions. In the winter months, the pond fills with water and welcomes visiting ducks. In the summer or milder months, as Mother Nature permits, guests may pick fresh produce from the garden and planter boxes to enjoy in relaxing, at-home meals. Other things to note RENTER AGREEMENT AND POLICIES EZ Living Farm | Vacation Rental, Lic. 6011246 Must be signed and returned within 48 hours after booking. Please read to the end. Hello potential Renter: We are delighted that you are considering a stay at EZ Living Farm, a charming and quiet vacation destination. Prior to accepting a request to stay at EZ Living Farm, please carefully read the directions as written in, but not limited to, this Renter Agreement and Policies. These exist so you and all future guests may have the best experience. Thank you… we hope you will stay awhile. Clarification of Terms: For the purposes of this Renter Agreement and Policies for EZ Living Farm, “Guest” refers to the Renter, the Renter’s Guests, and any other entities associated with the Renter or the Renter’s Guests. The Renter is the person who booked and legally signed the reservation agreement through a listing company or any other listing source. Also, “EZ” refers to the host, owner, and employees of EZ Living Farm. The listing company or listing source has separate agreements and policies. General Policies Responsibility: Guest must be an adult of at least 25 years of age and is responsible for the rental through the entire rental period. All issuance of property access is the responsibility of guest, and no other access shall be granted to anybody over than the guest unless specified by the guest in advance of the reservation. The guest is to be present during the entire course of the reservation and if at any time the guest will not be present while the home is occupied, the guest MUST prearrange this with EZ. Payments: An equivalent of a two nights stay is taken to secure the reservation using a credit card, or as directed by the listing and reservation company. EZ does not collect payments for the reservation. Arrival: Check-in time is 4:00 PM, PST. An early check-in is possible IF the property is available but early arrivals are NEVER guaranteed. Departure: Check-out time is 11:00 AM, PST. This is strictly enforced, as the housekeeper arrives shortly after 11:00 AM to prepare the home for the arrival of the next guests. Cleaning Fee and Responsibility: There will be a cleaning fee added to each reservation. The cleaning fee is based on the size of the home and on the area’s standard fee. The home will be thoroughly inspected and cleaned after your departure. You are REQUIRED to leave the property in the same general condition that you found it. The following is REQUIRED: • All dishes must be washed or the dishwasher started • Garbage must be taken out of the home and placed in the receptacles • The property must be generally picked up and ready to be cleaned • A load of the white towels must be started • The refrigerator and freezer MUST be emptied of leftovers and other prepared foods and produce If additional cleaning is required, outside of the standards, or rearranging of furniture that you moved, appropriate charges, up to an additional $200, WILL BE charged to your credit card or payment option. Please understand that the housekeeper is not able to move furniture around and for the home to be arranged as you found it, a handyman must be called to the property. Garbage: All waste must be placed securely in the marked cans provided. Make note of the waste designation for each can. If any waste is placed in the wrong can, an additional charge of $100 will be charged to your credit card or payment option. Please understand that the housekeeper is not responsible for sorting your trash, and the local utilities company will fine all violators. The cans must be properly closed to ensure raccoons and other animals do not get into the cans, causing a big mess. If waste can is full, please leave all trash by the back sliding glass door and please contact EZ host. Pets and Animals: No pets. No Animals. Period. Guest will be charged $300 for violating this rule. The farm is home to friendly, lazy farm cats that help keep pests away. EZ is – well – a small farm. The lower farm is also home to five sheep – Loretta, Lynn, Patsy, Cline, and Johnny; one goat – Dolly (yes, their actual names); and six nameless chickens that come and go. As part of the small farm experience, you are invited to visit and feed these friendly four-legged pals. Instructions will be provided in the Welcome binder, found in the home upon your arrival. Occupancy and Vehicles: Guest agrees that: 1.) There shall be no more than the arranged number of occupants. 2.) Any tenant that uses the home who was not included in the reservation arrangement will be added to the rental cost of the home at the rate of $50 per night per person. 3.) There shall be no more than three vehicles allowed to park on the farm and there shall not be any parking outside of the farm’s fenced areas. We Supply: This home is equipped with and set up as a fully furnished property that includes linens, blankets, pillows, towels, as well as a fully equipped kitchen, TV, furnishings, and décor. THERE WILL BE AN EXTRA CHARGE OF $300 TO YOUR CREDIT CARD OR PAYMENT OPTION FOR REPLACING THESE ITEMS IF ANYTHING IS FOUND TO BE DAMAGED OR MISSING – NO EXCEPTIONS. Initial supplies include hand soap, dish soap, clothes detergent, paper towels, toilet paper, trash bags, and basic surface cleaning materials. The kitchen is stocked with baking ingredients, condiments, and some spices; there are other food items and food preparation items. If the supplies run out during the course of your stay, it is up to the guest to provide and/or replace these items for the remainder of the stay. Most guests graciously “pay it forward” when supplying the kitchen with spices, cooking items, and such; you are not required to do so, and you will not be reimbursed for these items. We Do Not Supply: EZ will not provide personal toiletries such as, shampoo, conditioner, body wash or soap, body lotion, shower cap, nor toothpaste and such. Liability Guest’s Liability: Guest agrees to accept liability for any damages caused to the property (other than normal wear and tear) by guest, including, but not limited to, landscaping, misuse of appliances, and/or equipment furnished. If damages are in excess of the rental agreement, guest agrees to reimburse EZ for costs incurred to repair/replace damaged items. Sleeping Capacity/Disturbances: Guests will be required to vacate the farm and forfeit the rental fee for ANY of the following: • Occupancy exceeding the sleeping capacity stated on the reservation confirmation • Using the premises for any illegal activity, including, but not limited to, the possession, serving or consumption of drugs or alcoholic beverages by or to persons less than 21 years old • No use of illegal drugs by person of ANY age • Causing damage to the premises rented or to any of the neighboring properties • Any other acts which interfere with neighbors’ right to quiet and enjoyment of their property • Use of firearms or any other weapons that cause harm or death • Mistreatment or harm to EZ resident animals • EZ is located at the end of a country, dirt road, the speed limit is STRICTLY enforced Release and Assumption of Risk: To the fullest extent allowed by law, guest, on behalf of guest and guest’s heirs, successors, assigns, and family members hereby release EZ and their respective employees, agents, heirs, successors, and assigns of and from, and voluntarily assumes the risk of, any damages and claims for economic losses, bodily injury, or property damage suffered by guest or guest’s family members or guests arising from the use or occupancy of EZ, the condition of EZ, or exposure to any condition on or about EZ. This release and assumption of risk covers consequential economic losses, including loss of vacation time, wages, travel expenses and other damages. Decks, Stairs, Grounds, Outer Buildings, Jacuzzi, Hammock, Swings, Wood-burning Stove: The guest is fully aware that the deck, stairs, grounds, outer buildings, hammock, swings, jacuzzi, and wood-burning stove can be dangerous. The deck, stairs, and grounds, jacuzzi, hammock, and swings can be slippery when wet, and the wood-burning stove can be very hot to the touch when in use. EZ’s deck and stairs do not have railing or handrails. EZ’s grounds are pebbly, uneven and have an incline in some areas. The outer buildings are not to be used by the guest, except for the lower barn. The lower barn houses the food for the farm animals; it also has a loft with an open, barn staircase that is wobbly and does not have a handrail. Again, EZ Living Farm (EZ) is a farm. While using the jacuzzi, hammock, swings, and the wood-burning stove, use extreme precaution and strictly follow the instructions in the Welcome binder. The hammock has a maximum weight capacity of 200 pounds and only one person at a time may use it. The swings have a maximum weight capacity of 150 pounds and only one person per swing at a time may use it, as well. Injury is likely to occur to anyone who is not careful and does not properly use these listed in this section, but not limited to other features, amenities, or structures, and does not follow the instructions for intended use. Guests must adhere to the normal use of these areas and amenities with full knowledge of the above facts and warnings. The guest accepts and assumes all risks involved in or related to the use of the deck, stairs, grounds, outer buildings, jacuzzi, hammock, swings, and wood-burning stove. Terms of Use Guest agrees to abide by the following: • No loud music or voices emitting from the property later than 9:00 PM • Certain locked cabinets, closets or chests are designated as EZ’s private storage, and are NOT to be disturbed by guest • Guest shall behave in a safe and respectful manner • Guest shall NOT smoke indoors OR outdoors (Guest WILL be charged $500 for violating this rule – NO EXCEPTIONS.) • Do not litter • Turn out lights when you go to bed, ESPECIALLY outside lights; this disturbs the neighbors (the home has nightlights throughout) • If you have children, please make sure they do NOT cause a disturbance in the neighborhood Management Access: Guest agrees to allow EZ and/or assignees the right to enter for the following: 1.) To make necessary or agreed repairs scheduled in advance. 2.) To supply services agreed upon. 3.) In case of emergency, we reserve the right to enter at any time for the purpose of safe keeping or prevention of further damage. Note: Please notify EZ if you will be absent from the property for more than 24 hours. Items Left Behind: EZ is not responsible for articles left in the home. If items left behind are found in the home, they can be shipped back to the guest. EZ requires a credit card or payment option for payment in order to ship items to the guest. This service is provided on a two-week schedule. Owner Responsibility: 1.) EZ will give the guest the right to occupy the home per agreement. 2.) EZ will provide and maintain appliances. EZ will not be liable for interruption of these services that is beyond the control of EZ. Also, EZ is NOT responsible for interruption of electricity, water, internet, or gas beyond the control of EZ. Please promptly notify EZ of any problems. Termination of this agreement because of these interruptions is on a case-by-case basis. Guest Responsibility: 1.) Guest will notify EZ of any defects or problems either found upon arrival or caused by guest during the stay. 2.) Use the unit as a place to live; you may not use it for any filmmaking, photo shoots, unlawful, improper, or offensive purposes. Guest MUST wear appropriate swimwear while using the jacuzzi. 3.) Furniture is not to be moved within or out of the rooms or home. 4.) No parties within the farm or home. 5.) No pets or animals allowed in the home or on the farm. 6.) No smoking inside or outside the home or farm. 7.) Please remove your shoes within the home and leave them near outside doors, or as instructed by EZ. 8.) Please obey all home and farm rules, if and when posted in the home or on the farm. Disclaimer: 1.) Guest hereby acknowledges that Atascadero, California is in a rural area and in an area susceptible to wildfires. Please see the Welcome binder for emergency numbers. 2.) EZ recommends traveler’s insurance for any unforeseen circumstances. Unfortunately, EZ is not responsible for any noise pollution including construction outside of the farm. Noise pollution is rarely a concern at EZ. 3.) Weather is hot during the summer but quickly cools at night; and it can get below freezing during the winter; check the weather in the area prior to traveling to EZ. 4.) Environmental Disclosure: Every person reacts differently to various pesticides, chemicals, and molds. Neighbors of EZ may also use pesticides, chemicals that may affect a person that is sensitive to pesticides and other chemicals. Due to the natural environment of Atascadero, many homeowners use pesticides to comeback pests in their home. Homes that have not been diligently cleaned and aired out on a regular basis may be subject to mold. If guest is sensitive to pesticides, chemicals or molds, guest is urged to investigate this issue prior to arrival to Atascadero. EZ is not an expert in pesticides, chemicals or molds and is not qualified to make recommendations or determinations concerning possible health or safety issues. Hold Harmless: EZ shall not be obligated to guest for any loss incurred by guest from acts or actions beyond EZ’s control, including weather, loss of power, acts of terrorism, accident, or natural disasters. Lost or forgotten items in or on EZ are the responsibility of the guest. EZ shall not be responsible for their value but shall endeavor to retrieve them and return them. By Signing This Renter Agreement And Policies By signing this Renter Agreement and Policies, the guest acknowledges that they have thoroughly read the Renter Agreement & Policies in its entirety and understands all the content within this Renter Agreement and Policies. Furthermore, the guest acknowledges the following: Guests for themselves and their respective heirs, personal representatives, successors, and assigns, hereby release EZ, officers, agents, employees, sureties, insurers, indemnitor, attorneys, successors, and assigns from all claims, demands, or cause or thing whatsoever resulting from or in connection with EZ of this rental agreement or contract, including without limitation any claim, demand or cause of action for personal injury or death and any and all loss, liability, cost and expense resulting from any claim, demand, suit or cause of action which may be asserted. Additional rules and requirements may be posted or provided in the Welcome binder, located in the home or farm. Agreement to this contract is an assurance to follow the rules posted in the home or farm you are renting. Summary of additional charges if in violation of ANY part of this Renter’s Agreement and Policies: • Moving furniture - $200 • Not placing garbage in correct designation can - $100 • No pets or animals - $300 • Additional occupants not listed on the reservation agreement - $50 per night per person • Damaged or missing items of any value - $300 • Smoking inside the home or outside on any part of the farm - $500 • Please note again that a guest’s rental fee may be forfeit for additional violations; please see Page 3. REMEMBER THAT YOU WILL BE RENTING A PRIVATE HOME. IT IS EXPECTED THAT IT BE TREATED WITH THE SAME RESPECT YOU WOULD LIKE SHOWN IN YOUR OWN HOME. Prior to finalizing your reservation, this Renter Agreement and Policies will be sent to you; it must be signed by the legal guest, dated, and returned to EZ.
