We hope you have an enjoyable stay. Please read this document in its entirety and indicate your agreement with the terms by clicking on the “I agree” icon. Putnam County Georgia Short Term Rental (STR) Ordinance- Revised September 1, 2023. IMPORTANT MUST READ Putnam County’s Board of Commissioners approved a new law for Short Term Rentals that is substantial and serious in its scope. For example, the ordinance states, “Violations of this chapter shall be punishable by a fine not to exceed $1,000 and/or six months confinement in the Putnam County Jail and shall be subject to the following suspensions:” 1) If a renter is cited by the Sheriff for violation of the law, the renter will be fined, and the owner shall be punished with a fine not to exceed $1,000 2) If a renter is cited by the Sheriff for violation of the law, the renter shall be fined, and the owner shall be punished with a fine not to exceed $1,000 AND the owner’s Short Term Vacation license shall be suspended for 30 days 3) If a renter is cited by the Sheriff for violation of the law, the renter shall be fined, and the owner shall be punished with a fine not to exceed $1,000 AND THE OWNER’S SHORT LICENSE SHALL BE SUSPENDED FOR TWELVE MONTHS This new Ordinance applies to all Short-Term Rentals in Putnam County. Since the Ordinance states that if a Renter violates the law and will result in the Owner subject to a fine, STR Certificate suspension and could include six months confinement in the county jail, we stipulate in this document that the Renter agrees that if THEY break the law, and are cited by law enforcement or County authorities, the owner will charge them any fine that Putnam County charges the owner due to the renter’s law breaking. We do not want to see any problems with our renters and hope they enjoy their stay. Nor do we wish to be subject to penalties based on renter behavior. Therefore, here are the major components of the Putnam County Short Term Rental Ordinance that our guests need to be aware of: 1) Licensees shall not allow occupants to violate federal, state, or local law, statute, or ordinances. 2) The licensee must furnish the renter of a copy of this ordinance and a contract specifying the terms of the rental which will include the maximum number of persons allowed on the premises at and time. Said contract will also specify the maximum number of allowed vehicles allowed on the property at any time during the rental period. Said contract will further prescribe the maximum number of boats or vessels that may be docked. The property owner, agent, or occupant of the short-term vacation rental, when requested to do so, will present a copy of the rental contract to the Sheriff, Deputy Sheriff, fire marshal or official, or Code Enforcement Officer. a) A full copy of the Putnam County Short Term Rental Ordinance is included in the welcome binder that you will find when you check in. b) A copy of Renter’s Agreement, which you have signed electronically that you agreed to the terms, is included in the welcome binder that you will find when you check in. c) Sixteen people is the maximum number of people allowed in our cottage and on the premises. (NOTE: The STR ordinance specifically states, “THE PRESENCE OF MORE PEOPLE ON THE PREMISES OF A SHORT-TERM RENTAL THAN THE MAXIMUM NUMBER SPECIFIED IN THE RENTAL CONTRACT SHALL BE A VIOLATION OF THIS ORDINANCE AND THE PERSON(S) NAMED IN THE RENTAL CONTRACT SHALL BE SUBJECT TO BEING CITED FOR SAID VIOLATION.”) d) Eight vehicles is the maximum number of vehicles allowed on the driveway. At no time are any vehicles allowed to park on the street or on the grass. e) Two boats are the maximum number of watercrafts allowed to be tied up to our dock. 3) It shall be unlawful for any occupant of a short-term rental to make, continue or cause to be made or continued any excessive, unnecessary, or unusually loud noise which disturbs the peace or quiet of anyone in the neighborhood or which causes discomfort or annoyance to any reasonable person of normal sensitiveness. ALL ELECTONIC DEVICES WITH SPEAKERS MUST BE OPERATED WITHIN ENCLOSED CONFINES OF LTHE PRIMARY RESIDENCE BETWEEN THE HOURS OF 10:00pm and 9:00am. 4) Dog barking that disturbs the comfort or repose of any residential neighborhood shall not be allowed. 5) PARKING- No person occupying a Short-Term Rental shall park any vehicle on any street or road, nor park on another person’s property, or block any driveway on any other person or property owner. 6) No renter shall go upon any adjacent properties unless specifically authorized in advance and in writing by the owner of the short-term rental property. 7) Any, and all pets at the premises must be leashed or contained, always. 8) The premises may not be utilized for any special event. No additional people are allowed on the premises than are cited by the STR license. 9) No renter shall be allowed to place, site, or occupy any recreational vehicles or campers on the premises during rental. 10) The use of fireworks is prohibited at all Short-Term Vacation Rentals. The final piece of the Short Term Rental Ordinance we seek to highlight is this- “The Owner’s agreement to use his or her best efforts to assure that use of the premises by short term vacation occupants will not disrupt and will not interfere with the rights of neighboring property owners to the quiet enjoyment of their properties and will abide by all other short term vacation rental regulations, and will abide by any and all regulations established by this code.” In essence, by accepting this Renter’s Agreement you are agreeing to respect your neighbors and respect the law. If any renter violates any law or in other ways is rude or belligerent to neighbors or law enforcement officers, the renter agrees that the owner shall have the right to direct the renter to immediately vacate the premises. The renter also agrees that in the event of the case of eviction due to unlawful or unacceptable behaviors that the renter forfeits all of the rental payments made on the remaining days of their contract. Rental Guidelines A) The rental fee is due in full before arrival and will be charged to your credit card via the Vacation Rental by Owner (VRBO) or Airbnb websites. a. A cleaning fee of $375 will be charged. b. A damage/security deposit of $1,000 will be charged by VRBO at the time of your reservation. The deposit will be returned to you after your stay and after the cottage and property have been inspected for damage, lost items, theft or conditions that result in excessive cleaning (i.e. stains requiring dry cleaning/professional cleaning) or repairs beyond normal wear and tear. If any of the above do occur, an appropriate amount will be withheld from the damage deposit to cover the costs. For Airbnb, if damage, theft, or conditions that result in excessive cleaning costs, an insurance claim will be filed the for the appropriate cost. B) Removal of trash- It is the responsibility of the renter and agreed upon by the renter to remove all trash from the cottage at the time of check-out by taking it to the Putnam County Convenience and Recycling Center, conveniently located at 154 Sammons Parkway, Eatonton. The Convenience Center hours of operation are M, W, Th, F, Saturday from 7:30 – 6:00. The Center is closed on Tuesdays and opens on Sunday at 1:00. For renters who check out on a Tuesday or Sunday, all trash should be taken to the Convenience Center the day before check-out. Prior to check-out the trash can be stored in the garbage bins in the garage. C) General Cleaning before check-out a. All dishes, silverware, pots, and pans, etc. should be placed in the dishwasher, then cleaned. b. All food should be removed from the premises. D) Upon check-out all sheets and comforters should be left on the beds, indicating they were used. All towels should be left in the laundry room. E) Upon check-out, renters shall ensure that the stereo receiver in the living room, the stove, oven, and grill are all turned off. Maximum Occupancy Putnam County has granted us a Short-term Vacation Rental business license that stipulates a maximum of 16 people can stay at our cottage. This also means that no more than 16 people can be on the premises at any given time. This also means that no “events” can be held where other people come to visit the cottage- even for a short time. For example, other people are prohibited from coming to the cottage for pre or post wedding parties, picnics, parties, etc. Renters who violate the maximum occupancy rule shall forfeit their entire security deposit of $1,000. Respect of Neighbors and Property A) Renters agree to respect neighboring properties and their owners and will not use, tread upon, park, or trespass on said properties. B) Outside music or loud noise are not allowed past 10:00 pm. C) Renter agrees to use common sense with respect to daytime noise levels. D) NO LARGE PARTIES OR EVENTS ARE ALLOWED ON THIS PROPERTY. E) Use of fireworks on any part of the property, including the dock, are prohibited. Applicable laws A) Renter agrees to abide by all requirements of the chapter, and other Putnam County ordinances, state, and federal law, and that such violation of any of these rules may result in the immediate termination of the agreement and eviction from the premises, as well as potential liability for payment of fines levied. Parking A) The maximum number of cars/SUVs/Pickup trucks allowed in the driveway is eight. B) All cars/SUVs/Pick-up trucks must be parked on the driveway. At no time are these vehicles allowed to park on the grass lawn or in the street. C) No recreational vehicles or trailers are allowed on the premises. This prohibition includes but is not limited to RVs, ATVs, Campers, Boats, Jet Skis, boat trailers and large trucks (those with >6 wheels). Smoking Policy Renters agree that no smoking of any kind of material will take place inside any part of the cottage. If this policy if broken and extra costs are incurred to the owner for additional cleaning/air freshening or damage (ie. cigar/cigarette burns in furniture, rugs, flooring, etc.) the cost of the repair/replacement/cleaning will be deducted from the damage deposit. Smoking is allowed in outside spaces. Marine Equipment A) The use of the Owner’s boat is strictly prohibited. B) The use of the canoe, kayaks, water floats is allowed. Lifejackets should be worn by all users of said equipment. Use of any part of the Kollross Cottage and Property Renters agree to accept and be held accountable for all liability with respect to using the cottage, and its contents therein, the dock, the grill and the land on which the property is located. The Owner is not responsible for any accidents, injuries or illnesses that occur on the premises or its facilities. Use of any part of Lake Oconee Renter agrees to accept all liability related to using the waters of Lake Oconee. Septic System The Kollross Cottage incorporates a septic system that services only this property. Renter agrees to flush no materials other than that produced by a “number one” or “number two” and the use of toilet paper. Cleaning Service Upon check-in, we advise the renter that all beds will have clean sheets, pillowcases, and comforters/bedspreads on them. We also advise that we provide one set of towels for each person in the agreed upon number of renters initially set by renter and approved by the owner. There is no daily cleaning provided by the owner unless special accommodations have been agreed upon. Pet Policy Pets are not permitted. Check-in/Check-out Check-in time is after 4:00 p.m.- Keys for the cottage and the basement storage area are located in the lockbox on the front door. Renter will be provided the code to the lockbox approximately one week before check-in, along with the address of the cottage. Check-out time is 10:00 a.m. on the final day of the renter’s stay. Keys to the cottage should be returned to the lockbox on the front door.
