Please park in driveway, do not park on front lawn. *Winter weather disclaimer. The pool heater is maintained at 80 degrees. However the air temperature will impact the pool water temperature. This is especially true when temperatures fall below 60 degrees. POOL WAIVER AND RELEASE: Guest acknowledges he is renting the Residence for valuable consideration received and there is a pool on the premises. Guest acknowledges notice by Owner of the inherent risks associated with use of said pool and that no lifeguard is on duty nor is any supervision provided. Guest assumes any and all risk associated with the use of said pool and the surrounding area and understands that any and all use of the pool shall be at his or her own risk. Guest has been made aware of the inherent risks associated with access to and use of the pool. Guest and Owner wish to memorialize Guests full assumption of risk and release of liability and future claims at time of booking.Guest fully releases and covenants not to sue the Owner or management from any and all liability for any injuries or death to Guest, Guest’s family, household members, guests, invitees or other persons on the premises during their stay, that result, directly or indirectly from access to or use of (accidental or otherwise) the pool. Guest further agrees to indemnify and hold Owner and Management harmless from any loss, liability (accidental or otherwise), attorneys’ fees, damage or costs that may incur arising out of or related to, access to or use of the pool by the Guest, Guest’s family, household members, guests, invitees or other persons on the premises, whether caused by negligence or otherwise. Guest fully understands that access to and use of the pool involves risks and dangers of serious bodily injury, including death, and understands that access to and use of the pool shall be at his own risk. Guest fully accepts and assumes all risks and all responsibility for losses, costs, and damages Guest incurs as a result of access to and use of said pool and surrounding areas. Parties understand this waiver is intended to be as broad and inclusive as permitted by the laws of the State of Florida and agree that if any portion is held invalid, the remainder of the waiver will continue in full legal force and effect. Parties also agree that any dispute shall be required to be resolved by binding arbitration. If the parties cannot agree on an arbiter, each party shall select one arbitrator and both arbitrators shall then select a third. The third arbitrator so selected shall arbitrate said dispute. The arbitration shall be governed by the rules of the American Arbitration Association then in force and effect and the applicable General Laws of the state of Florida. Guest hereby agrees to all of the above if property is booked by said party.
