It is collected by the establishment and passed on to the municipality. Overnight stays for work-related reasons are also subject to the tax. Guests who booked before December 31st, 2024 can be exempted from the tax upon request. This tax is compatible with the Basic Law, as the Federal Constitutional Court decided on March 22nd, 2022. The basis for this is the municipal tax legislation, regulated in the municipality's overnight stay tax statute.
