Guest access During your stay, this home becomes your private oasis. We employ a keyless entry system, allowing you to arrive at your convenience after check-in using your unique access code. There is a large driveway and parking area at the side of the house, providing ample space without the need to unhook your trailer or boat. You will have full access to the entire property, with the exception of the garage. Please note that security cameras are in place at the front door, backyard, and side of the house for security purposes only. Other things to note **House Rules and Terms of Stay** By booking and staying at our property, you agree to adhere to the following rules and policies. These rules have been established for the safety, comfort, and enjoyment of all guests, as well as in consideration of our neighbors. Failure to comply with these rules may result in additional charges or the immediate termination of your stay without refund. ### **General House Rules** 1. ** We welcome pets,** but to ensure a comfortable stay for all guests, please follow these rules: Allowed • Dogs and cats are welcome (limit: 2 pets per stay). • Service animals are always allowed, in compliance with Airbnb policy. Not Allowed • No puppies under 1 year old. • No aggressive breeds or pets with a history of biting. • No exotic animals. House Guidelines 1. Supervision – Pets must not be left unattended inside the home unless crated. 2. Furniture – Keep pets off beds and couches unless covered with a blanket you bring. 3. Cleanliness – Please clean up after your pet indoors and outdoors. 4. Noise – Excessive barking or disturbances may result in early checkout. 5. Damage – Guests are financially responsible for any damage caused by pets. 6. Outdoor Areas – Pets must remain leashed outside the property unless in designated fenced areas. 7. Bathing/Grooming – Please do not bathe pets in sinks, bathtubs, or showers. Fees • Standard pet fee: $150 per pet, per stay (collected at booking). • Extra cleaning fee may apply if excessive hair, odors, or accidents are left behind. 2. **No Smoking:** Smoking is strictly prohibited inside the home or on the property grounds. 3. **No Parties or Events:** Parties, events, or large gatherings are not allowed on the premises. Guests are expected to treat the property with respect and care, as they would their own home. Please be mindful of our neighbors, and remember that this house often accommodates families with children. Adherence to the house rules is not only requested but required for the safety and enjoyment of all. ### **Pool and Hot Tub Rules** 1. **No Lifeguard on Duty:** Use of the pool and hot tub is at your own risk. Children under the age of 14 must be supervised by an adult at all times. 2. **Shower Before Entering:** Guests are required to shower before entering the pool or hot tub to maintain cleanliness. 3. **No Diving:** Diving into the pool is strictly prohibited for safety reasons. 4. **No Glassware in Pool Area:** To prevent injuries, the use of glass containers in or around the pool and hot tub is not permitted. 5. **No Running or Rough Play:** Running and rough play are not allowed in the pool and hot tub areas to avoid accidents. 6. **Maximum Capacity:** The hot tub is limited to a maximum of 6 people at any given time. 7. **Noise Levels:** Noise must be kept to a minimum, especially around the pool and hot tub, to avoid disturbing other guests and neighbors. 8. **Health Considerations:** Guests with open wounds, infectious diseases, or who have consumed alcohol are prohibited from using the pool or hot tub. 9. **Hot Tub Cover:** The hot tub cover must remain closed when the hot tub is not in use for safety and to preserve the hot tub’s condition. 10. **Report Issues:** Any issues with the pool or hot tub should be reported immediately to management at [insert contact information]. By using the pool or hot tub, you agree that you do so at your own risk and that the homeowner is not liable for any injuries or accidents. ### **Check-Out Procedures** Before departure, guests are required to complete the following tasks: - Collect all trash and place it into the trash bins located on the side of the house. - Load and start the dishwasher with any used kitchen items. - Place all used towels in the laundry room. Lake Havasu City enforces a strict noise ordinance that requires quiet hours between 10:00 PM and 7:00 AM daily. Any excessive noise during these hours may result in complaints and possible action by local authorities. ### **Acknowledgment and Acceptance** By staying at this property, you acknowledge and agree to comply with these house rules and all local laws and ordinances. Failure to comply with any of the rules or policies outlined above may result in additional charges, legal action, and/or the termination of your stay without refund. LIMITED LIABILITY WAIVER AND RELEASE AGREEMENT This Limited Liability Waiver and Release Agreement (“Agreement”) is made and entered into as of the date of the guest’s booking confirmation through Airbnb or any other short-term rental platform, by and between [Avalon Escape LLC] (“Host”) and guest (“Guest”). 1. Acknowledgment of Risks The Guest acknowledges and agrees that the rental property located at 1035 Avalon Ave., Lake Havasu City, AZ 86403 (“Property”) is a short-term rental property and that the Guest’s stay may involve certain risks, including but not limited to: • Slips, trips, or falls within or around the Property. • Injuries or damages from the use of any amenities, such as hot tubs, pools, balconies, patios, or fitness equipment. • Unforeseen weather conditions, including but not limited to flooding, storms, or wind damage. • Use of stairs, balconies, or decks. 2. Waiver and Release of Liability The Guest agrees to the following terms: • The Guest, on behalf of themselves, their heirs, executors, administrators, and assigns, fully and forever releases and discharges the Host, their agents, employees, successors, and assigns from any and all liability, claims, demands, causes of action, or damages of any kind, known or unknown, arising out of or relating to any injuries, damages, or losses sustained during the stay at the Property. • The Guest acknowledges that they voluntarily assume full responsibility for any risks of loss, property damage, or personal injury, including death, that may be sustained while on the Property, whether caused by the negligence of the Host or otherwise. 3. Use of Property and Amenities The Guest agrees to use the Property and its amenities in a safe and responsible manner and in accordance with the Property rules provided by the Host. The Guest shall: • Follow all posted or communicated safety rules related to any amenities (such as pools, hot tubs, or fitness equipment). • Assume all responsibility for the proper use of such amenities. • Immediately report any unsafe conditions or defects on the Property to the Host. 4. Damage to the Property The Guest agrees to indemnify and hold harmless the Host for any damages to the Property caused by the Guest or their invitees during the stay. The Guest further agrees to cover the cost of any repairs or replacements due to such damage. 5. Exclusions of Liability The Host shall not be liable for: • Any personal items lost, stolen, or damaged during the Guest’s stay at the Property. • Any injuries or damages sustained from the Guest’s improper or unsafe use of the Property or its amenities. • Acts of God, including but not limited to weather-related incidents, natural disasters, or other force majeure events. 6. Emergency Situations The Guest acknowledges and agrees that they are responsible for their own safety and well-being during their stay at the Property. In case of emergency, the Guest should contact local emergency services by dialing 911 or the appropriate local emergency number. 7. Governing Law and Dispute Resolution This Agreement shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of law principles. Any disputes arising from this Agreement shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, with such arbitration to take place in Lake Havasu City, AZ. 8. Entire Agreement This Agreement constitutes the entire understanding between the Host and the Guest concerning liability and releases during the Guest’s stay and supersedes any prior agreements, whether written or oral. 9. Severability If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. 10. Acceptance of Agreement By completing a booking through Airbnb or any other short-term rental platform, the Guest acknowledges and agrees to the terms and conditions of this Limited Liability Waiver and Release Agreement.m
