Summer rentals are Sunday-to-Sunday. The house sits on a point with a double 200' lot that provides panoramic views of Lake Michigan to the north and Grand Traverse Bay to the south. It is located just north of the village of Eastport which is at the northern tip of Torch Lake. You can walk the beach forever. This modern lake house has the "must haves": - Wifi and "cable" TV - Main floor washer and dryer - Modern kitchen with all of the amenities - Central air conditioning - Log fireplace The space A warm fire and a gorgeous view ... Mix and match your skiing and winter fun and avoid the high price of slope side lodging. Now throw in a sunset lake view and a fireplace for the less avid skiers. You can be right in the middle of the northern Michigan ski resort area. 30 minutes southeast to Shanty Creek and Schuss Mountain, 45 minutes east to Boyne Mountain, an hour north to Nub Knob and Boyne Highlands, 40 minutes south to Traverse City's Holiday Mountain and only 30 minutes from quaint Charlevoix and Mt McSauba. A private sandy area with fire pit is located near the house. A large deck and covered porch overlook the lake. Enjoy a fire during the cool nights in the lakeside fire pit or the dramatic two story fireplace. Stunning sunsets, sandy beach, surrounded by trees! Enjoy the natural beauty of Lake Michigan. You can walk the beach forever - something you can't do on inland lakes. Grand Traverse Bay water frontage is constantly changing and advertising photos will not necessarily depict the beach and water as it might be during the rental period. Higher water levels reduce and could potentially eliminate beach area. The beach has pebbles and sand with a bottom of smooth rocks (aqua shoes are recommended). There are two stand up paddleboards and two tandem kayaks that can be used to enjoy the bay. There are four bikes. The home is modern with 2,000'+ square feet of living space. There are three bedrooms and a 'dormitory' plus sleeper sofa. There are two full bathrooms with tub/showers which are both accessible without entering a bedroom. The kitchen is a chef's dream. There is over 20' of counter space, a high end induction stove and top of the line cookware. The appliances are stainless steel. A gorgeous quartz countertop island with double bowl sink provides a dramatic lake view. The icemaker allows ice to be moved right to your cooler. A washer and dryer is provided on the main floor for convenience. All the modern conveniences are provided including high speed internet and "cable" TV (cable TV may not be available in the off season). There are Samsung Ultra HD TVs in every bedroom with Nexflix streaming and broadcast TV plus a 75" top of the line Samsung TV in the main living area. To keep you cool there are seven ceiling fans and central air conditioning. The bay is shallow which makes it great for young children. The master bedroom is a large loft area and the only room upstairs. It overlooks the family room and dining area (and the lake). The master bath offers a relaxing whirlpool tub. The loft can be closed for privacy but has an opening above so it is not "soundproof". The second bedroom and den/bedroom are on the main floor. Dormitory sleeping is provided on the lower level in the game 'rec room'. There is plenty of parking including space for a boat trailer. There is a boat launch 10 minutes away. There is a small grocery store with a great deli (and delicious summer BBQ) only 5 minutes away. A warm fire and a gorgeous view ... Guest access Guests will have exclusive access to the house and property. Other things to note One mature, trained dog under 70 pounds may be allowed and, if so, there is an additional fee. Contact the host before booking if you want to bring a pet. Cancellations directly or indirectly due to the COVID-19 will be subject to the Cancellation Policy even if the cancellation is a result of government restrictions. SHORT TERM RENTAL AGREEMENT This Short Term Rental Agreement (the “Agreement”) is made by and between Robert (Bob) Slaski (“Homeowner”) and the Airbnb guest (“Guest”). “Reservation Request” refers to the Airbnb online reservation request. “Payment Request” refers to the Airbnb online payment request or payment made with the Reservation Request. “Property Location” refers to the location listed in the Airbnb online listing. For good and valuable consideration, the sufficiency of which is acknowledged, the parties hereby agree as follows: 1.Property. The Property is located at Property Location. The property is fully furnished. 2.Guest Party: The Guest Party must not exceed the number of guests specified in the Reservation Request. The Property may not be sublet and the Guest must be present for the entire rental period. A maximum of three vehicles is permitted. 3. Rental Period: The lease begins at 6 PM on the start date specified in the Reservation Request (the “Check-in Date”) and ends at noon on the end date specified in the Reservation Request (the “Checkout Date”). 4. Rental Fees a.Rental Fee: The Rental Fee is specified in the Reservation Request or Payment Request. b.Reservation Deposit: The Reservation Deposit is specified in the Reservation Request or Payment Request. c.Damage Deposit: The damage deposit is specified in the Reservation Request or Payment Request. d.Payment: The Payment is specified in the Reservation Request or Payment Request. e.Late Check Out Fee: A fee of $100 per hour will be charged for every hour after the designated Checkout Time that the Guest fails to vacate the property. 5. Cancellation Policy: If Guest wishes to cancel his/her reservation, the payment(s) will be refunded as follows: •100% less the Cancellation Fee if cancelled at least 60 days prior to the Check-in Date •50% of the Rental Fee if cancelled at least 30 days prior to the Check-in Date •No refund of the Rental Fee will be made if cancelled less than 30 days prior to the Check-in Date •Cancellation Fee is $500 •Cancellations directly or indirectly due to the COVID-19 will be subject to the Cancellation Policy even if the cancellation is a result of government restrictions. 6. Payment: Payment must be made as specified in the Reservation Request or Payment Request. 7. Correspondence: All Homeowner correspondence should be addressed to the address below; Bob Slaski, 1803 Rosewood Ave, Louisville, KY 40204 8. Damage Deposit: The damage deposit is for security and shall be refunded within 5 days of the Checkout Date provided no deductions are made due to: a. reasonable liquidated damages for failure to observe Rental Rules; b. damage to the property or furnishings; c. damage or loss of beach equipment including paddleboards and kayaks; d. dirt or other mess requiring excessive cleaning; e. exceeding 15 mph on the Timberlane Drive access road ($50 per speeding incident); or f. any other excess cost incurred by Homeowner due to Guest’s stay. If the premises appear dirty or damaged upon Check-in, Guest shall inform Homeowner immediately. 9. Rental Rules: Guest agrees to abide by the attached Rental Rules at all times while at the property and shall cause all members of the Guest party and anyone else Guest permits on the property to abide by the following rules at all times while at the property. 10. Access: Homeowner reserves the right to enter property or have their agents enter the property at any time with appropriate announcement to investigate disturbances, check occupancy, check damages and make necessary repairs. Guest shall allow Homeowner access to the property for purposes of repair and inspection. Homeowner shall exercise this right of access in a reasonable manner. 11. Homeowner Cancellation: Homeowner may cancel the rental agreement with the refund of all monies paid by Guest in the event the Property cannot be made available for Guest. This might occur due to extraordinary circumstances such as extreme storm damage or infestation, Township short term rental restrictions or sale of the property. 12. Restrictions: Guest shall not enter the secured basement area except for emergency use such as access to electrical panel. 13. Online Reviews: Guest acknowledges the importance of online reviews to the Homeowner’s rental business and agrees not to submit or publish a review which might adversely affect Homeowner rentals without 7 days prior notice to the Homeowner during which time the Homeowner shall have the right to reasonably remedy the basis for the adverse review where possible. An online review with a “score” of less than 5 on a scale of 5 (positive/not adverse) to 1 (negative/highly adverse) shall be considered to be adversely affecting the Homeowner. 14. Refunds: No refunds or fee adjustments will be made due to a defect in the Property’s condition unless Guest informs Homeowners of the problem immediately upon discovery and the Homeowner is unable to remediate the matter within a reasonable amount of time. 15. Beach Condition and Water Levels: Guest acknowledges that Grand Traverse Bay water frontage is constantly changing and advertising photos will not necessarily depict the beach and water as it might be during the rental period. Higher water levels reduce and could potentially eliminate beach area. The parties agree to the terms of this Short Term Rental Agreement. Guest certifies that he/she is of legal age to enter into the Agreement in the State of Michigan. HOLD HARMLESS AGREEMENT Guest understands and acknowledges that the Guest is responsible for each and every Guest Party member and is solely responsible for any property damage, accident, injury or loss sustained to any person during the rental period. Guest acknowledges that the use and enjoyment of Grand Traverse Bay, which is adjacent to the Property, particularly the use of kayaks, paddleboards and water toys, presents inherent risks. Guest agrees to take utmost care with respect to water safety and hold Homeowner harmless and assume responsibility for all risks associated with the use of Grand Traverse Bay. Guest acknowledges that there is no lifeguard so Guest and Guest party member swim at their own risk. Guest assumes all risk of injury or other loss resulting from any recreational activity and will hold Homeowner harmless. Guest hereby agrees to indemnify and hold harmless from any claim, including those of third parties, arising out of or in any way a result of the Guest’s use of the premises or items therein. Guest understands and acknowledges that emergency services are provided by the Banks Township Fire and Rescue which is a volunteer service and understands that response to requests for emergency service can be limited. Guest understands and acknowledges that property has stairs and guest is capable of safely using stairs when needed. Guest understands and acknowledges that Homeowner cannot be held responsible for acts of god such as weather. Homeowner cannot be held responsible for the failing of any other company due to said company’s error or service interruption {i.e. electricity, cable, wireless provider, etc.} or acts of neighbors such as construction, road repair and maintenance. However, Homeowners will take all reasonable actions possible to remedy any issue as quickly as possible. NO REFUNDS OR ADJUSTMENTS OF RENTAL FEES WILL BE MADE FOR ANY OF THE ABOVE CONDITIONS. NO REFUNDS WILL BE GIVEN FOR STORMS OR WEATHER. RENTAL RULES 1. Smoking: Guest must not smoke inside the house. Smoking is allowed outside only. A $250 cleaning fee will be charged if smoking occurs in the house. 2. Maximum Number of Guests: Guest must not allow occupancy other than as specified in the Guest Party set forth above. Any person on the property is the sole responsibility of Guest. At no time shall there be more guests than the maximum occupancy (currently limited to 10 guests). 3. Working Order: Guest must keep the Property and all furnishings in good order. 4. Appliances: Guest must use appliances only for their intended purpose. 5. Private Road: Guest must observe the speed limit of 15 miles per hour on the private road. Guest must not operate ATVs on the road. Guest must use caution if walking or cycling on the side of the road. The Property is accessed by a private unpaved windy road. It is recommended that guests walk along the beach. While the road is regularly maintained, there are situations, particularly in the winter, where safe travel on the road may require special vehicle capabilities such as four wheel drive. 6. Emergency Service: Guest must provide their own telephone which is capable of contacting emergency services. 7. Housekeeping: Guest must not remove towels from the house. There is no daily housekeeping service. While linens and bath towels are provided, daily maid service is not included in the rental rate. 8. Septic: Guest must not discard items into toilets that would damage the septic system. The septic system is very effective; however, it will become plugged and damaged if improper material is flushed. No diapers or sanitary napkins are to be placed in the toilet. 9. Gas BBQ grill: Guest must use the gas barbeque grill safely and not use it if unfamiliar with how to safely use it. 10. Water Safety: Guest must observe water safety and use kayaks, paddleboards and water toys safely with a life jacket. Kayaks, paddleboards and water toys are provided for the enjoyment of the Guest and Guest Party. Water toys should not be used in lieu of life jackets. Equipment may only be used at or adjoining the Property. Several life jackets are provided for Guest use. Grand Traverse Bay, immediately adjacent to the Property, is generally shallow near the shore but any water can be dangerous to small children or in special circumstances. Care must be taken to ensure that life jackets are used. There are often slippery rocks in the water that should be avoided. Aqua shoes are recommended. 11. Pets: Guest must not have pets at the Property except with prior approval and completion of a Rental Pet Addendum. A $250 fee will be charged if unauthorized pets are allowed on the Property. Pets must be kept under control at all times. 12. Campfires: Guest must use only designated fire pits for campfires. Campfires must be attended at all times and fully extinguished when departing. 13. Noise: Guest must maintain quiet beginning one hour after sunset. At no time can there be activities that are loud enough to disturb neighbors. 14. Bathtub/Shower Use: Guest must use bathtub/showers for normal bathing only. No hair dyes, tanning lotions or other pigmented substances are to be used. Pets must not be bathed in the tub/showers. 15. Fireworks: Guest must not have fireworks on the property.
