RENTAL AGREEMENT SCHOOL HOUSE LAKE CABIN 15305 W County Hwy K #2, Hayward, WI 54843 RENTAL AGREEMENT Using the Airbnb and VRBO online reservation systems, Schoolhouse Lake Cabin, of 15305 W County Hwy K #2, Hayward, WI 54843 (hereinafter called the Lessors) will agree to be temporarily leased to a specified Lessee, at Stonegate Condominiums, 15305 W County Hwy K, Hayward, WI 54843. The parties agree that rental payments shall be made to Schoolhouse Lake Cabin, with all transaction details, including terms of cancellation, specified, recorded, and processed by Airbnb or VRBO online reservation systems, unless otherwise agreed upon by both parties. The parties further covenant and agree that: 1. The Lessees will not use nor permit any part of the premises to be used for any purpose other than a temporary vacation rental, including giving access to any other parties not specified in the booking through Airbnb or VRBO, without the written consent of the Lessors under penalty of forfeiture of this lease and deposit. 2. The Lessors or Property Manager may enter into and upon the premises at reasonable hours of the daytime to examine the same or to make such repairs or alterations therein as necessary for the preservation thereof, after proper notification of this intent to Lessees. 3. The Lessees will keep the said premises in as good repair as the beginning of this Lease and agree to assume financial responsibility for any damages or loss to the structure, furnishings, all amenities, and landscaping, unless damage by natural cause such as weather occurs. Costs, repair or replacement will be facilitated by debit of damage deposit and as an extra charge in addition to that, if necessary. 4. The Lessees agree that during the term of this Lease they will observe and conform to all Town Ordinances and Regulations, and the Rules and Regulations of School House Lake Cabin, as published on Airbnb and VRBO websites prior to booking, in Annex 2 of this Rental Agreement, and in the Visitor Guide provided upon arrival at the Cabin. Foremost among these regulations are specific Arrival and Departure Times, Quiet Hours, No Smoking/ No Parties Policy, Pet Fee Policy, the Care, Maintenance, and Return of Amenities as detailed in the School House Lake Cabin Visitor Guide and in Annex 1 of this Agreement, and, Approved Parking Places. Lessees are responsible for reading and understanding all Rules and agree to assume monetary responsibility for all associated fees for not adhering to all Rules and Regulations. 5. The Lessors warrant that the plumbing, heating, lighting systems, screens, and all appliances are in good working condition, and cost of repairs to any of these items will be borne by the Lessors, providing that such necessary repairs are not the fault of nor caused by negligence of the Lessees, in which event such costs or repairs will be borne by the Lessees. 6. If premises should be destroyed or become uninhabitable prior to lessees taking possession, funds received by Lessors or Agency will be returned to Lessees according to the stipulations and mediation of Airbnb and VRBO. 7. The Lessors agree to pay the cost of utilities such as water, electricity, and liquid propane, where these are involved, during the Lease period. The Lessors agree to provide linens, towels, pillows, and basic kitchen utensils, plating and cookware. Lessees are responsible for bringing comforters, blankets, and personal hygiene products. 8. Lessors will lease premises in neat and orderly condition, and use a professional cleaner to ensure cabin is ready for new guests. Lessees are responsible for reasonable cleaning up after themselves and to ensure premises, equipment, and household items are not heavily soiled or damaged at termination of Lease period, to satisfaction of Lessors or Agent. Lessees who bring pets, who have not paid a pet fee, and whose pet’s hair or dander that are picked up and discovered by post rental vacuuming will have the normal pet fee plus additional penalties removed from their damage deposit. 9. Outside ground maintenance such as lawn cutting, raking, pruning, etc will be the responsibility of Lessors, and Stonegate Condominiums. 10. For Cabin Maintenance Issues, Guest Questions concerning Amenities, and for Emergencies, the local Point of Contact is the Schoolhouse Lake Cabin Property Manager, Aleda McFarren: contact info in Welcome Book 11. All the covenants and agreements herein contained, in Annex 1 Rental of Monarch Fishing Boat, in Annex 2 Rules and Regulations, in the Visitor Guide to include all Rules and Regulations, and on the Airbnb and VRBO websites, be for the benefit of and shall apply to and bind the said parties hereto, their respective heirs, executors, administrators, successors and assigns. ANNEX 1 Release of Liability and Rental Agreement for Monarch Fishing (Jon) Boat **ALL RENTERS AND DRIVERS OF THE MONARCH FISHING (JON) BOAT MUST BE AT LEAST 21 YEARS OF AGE, SHALL NOT PERMIT THE OCCUPANCY OF THE BOAT TO EXCEED FOUR PERSONS OR 700LBS AT ANY GIVEN TIME, AND AT NO TIME SHOULD PERMIT THE BOAT TO LEAVE SCHOOLHOUSE OR DURPHEE LAKES. THEY WILL ALSO ENSURE THAT THE BOAT BE RETURNED IN THE SAME STATE OF MOORING WITH RAIN COVER AS WHEN RECEIVED** Upon arrival to the Cabin, the Property Manager, Aleda McFarren, on behalf of the LESSOR, will conduct an inspection of the Monarch Fishing (Jon) Boat (herein after referred to as the Boat) in the presence of the Lessee, and will provide the Lessee instruction on how to operate the craft including the outboard motor. After the above has been performed, and if no objections or conflicts are identified, all parties agree to the following stipulations: The Lessor agrees to lease the following boat, outboard motor, and equipment: 1970 Monarch Flat Bottom Fishing (Jon) Boat 2018 Suzuki 20hp 4 Stroke Outboard Motor, with electric start and fuel injection 2016 Minn Kota Endura 40lb thrust Trolling Motor w deep cell battery THE LESSEE CERTIFIES THAT HE/SHE HAS EXAMINED THE CRAFT AND EQUIPMENT AND FINDS IT ACCEPTABLE AND SUITABLE FOR THE PURPOSE FOR WHICH IT IS LEASED. THAT HE/SHE WILL OPERATE THE CRAFT IN ACCORDANCE WITH ALL SAFETY RULES AND REGULATIONS AS POSTED IN THIS AGREEMENT AND ACCORDING TO THE STATE OF WISCONSIN BOATING REGULATIONS, AND FURTHER CERTIFIES THAT HE/SHE HAS READ AND UNDERSTANDS ALL SAID RULES AND REGULATIONS. LESSEE AGREES TO REPORT ANY ACCIDENT, MALFUNCTION OR BREAKDOWN OF RENTAL CRAFT TO LESSOR IMMEDIATELY IN ACCORDANCE WITH THE FOLLOWING: This certifies that the LESSEE is experienced and capable in all aspects of the handling and operation of the Boat and Motor such as the one rented above. Lessee agrees the Boat will not be occupied by a greater number of persons that is shown in this rental agreement. AND THAT WATER SKIING, TOWING, AND/OR NIGHT OPERATION OF RENTAL BOAT AND MOTOR IS FORBIDDEN, NO EXCEPTION, The Lessee authorizes the Lessor to debit the Lessee Damage Deposit and require additional fees as needed for any damages or loss of equipment. The Lessee acknowledges he/she has carefully examined the craft and finds it suitable for the purpose for which it is leased, and that other equipment is in suitable and acceptable condition: that he/she will maintain both craft and equipment in a safe, dependable condition while in he/she has custody. The Lessee herby agrees that he/she is renting, operating or using the equipment provided by Lessor at his/her own risk. The Lessee agrees that he/she is voluntarily participating in all activities related to the rental, operation, or use of the rental equipment. The Lessee assumes full responsibility for the risks of personal injury, accidents or illness, including drowning, and/or death; and any resultant expenses from any of the foregoing risks and assumes all risk injury, illness, damage or loss that might result, regardless of the cause. By accepting the rental, the Lessee voluntarily releases, forever discharges and agrees to indemnify and hold harmless the Lessor from any and all liability of any nature for any and all injury or damage arising from personal injuries sustained by the undersigned or any minor children under the undersigned’s custody, care, and control, as a result of any and all activities related to the rental, operation, or use of equipment provided by Lessor. regardless of the cause. ANNEX 2 Rules and Regulations for School House Lake Cabin #2 *NO Pets No Parties No Smoking No Guests No RVs or ATVs Quiet Hours 9 PM - 9 AM Pool hours: 9am – 9pm, Memorial Day to Labor Day Please park in designated areas (only: directly behind concrete slab/grill and to left of it, behind tree). Your boat trailer/boat can be parked behind the pool. Please wash all of your dishes, kitchenware, tableware, and put away. Row boat #2 w blue stripe is yours to use; please return, upside down, at shore Kayak must be returned to trailer behind pool Stand Up Paddleboard must be dried-out, deflated, and packed back in carrying case Paddle Boat must be returned where it was found Early check-ins and late check outs must be negotiated Fee for dishes not being washed/food residue: 25$ Fee for improperly-returned boats and/or kayak 25$ Fee for unauthorized late check-outs or early check-ins: tbd *Our NO Pet Policy is strickly enforced. The cabin belongs to an HOA that prohibits guest pets. If a guest is found to have brought a pet to the property we wil be forced to immediately cancel the reservation without refund and the potential of a request for additional fees.
