Two of the guest bedrooms are positioned in the front of the home, offering luxe linens and a shared Jack/Jill Bathroom with tub/shower combo. One bedroom offers a Queen bed, while the other bedroom features two Twin Beds. The additional two large bedrooms are located on the opposite side of the home, with the Casita bedroom featuring an ensuite bathroom with tub/shower combo and direct access to the entry courtyard. This bedroom features luxe linens and a Queen bed. The Master Suite offers a California King bed, direct access to the rear patio and swimming pool, as well as massive ensuite bathroom with soaking tub, walk in shower, dual vanities, 55" flat screen TV, ROKU streaming and private walk-in closet. There are two additional fold out twin beds that can be easily rolled to any room for guest #9 and #10. They have a nice 5" memory foam mattress on each one. As amazing and activity-filled as the interior of this home is, lets not overlook the fun to be had outside..... Check in is after 3PM, and check out is 11AM. However, early check in and late check out may be available for your reservation (if we can accommodate your request, we most certainly will). ELECTRIC CAR CHARGING? There are two standard 120V outlets in the garage available for charging. (120V is a regular wall outlet) NOTE: This home has a simple remote to control the pool lights, hot tub heat on/off and jets. The hot tub is pre-set to heat to 100°F (takes about 30-60 minutes if very cold) when you turn it on at no extra cost. If you want the pool heated there is an additional charge of $75/night (please let us know in advance as during the cool season it takes about 12 hours to heat). Due to the desert sun the pool will generally be at very comfortable 85°F - 95°F without additional heat from May - Oct. Guest access The entire home and yard. Other things to note There is a house manual that gives you instruction on how to operate everything in the home including the heating and air conditioning, spa, tv and wifi. Minimum age to rent this property is 25. All guests should be over 25 unless supervised by a legal guardian on premise. Early arrival or late check out may be requested and we will accommodate if possible. Note that all owners/managers of rental properties in the Greater Palms Springs area are required to collect a 1% Tourism Business Improvement District assessment (TBID) tax on short terms stays less than 28 days beginning July 1, 2021. You will see this tax on your booking listed as "Community Fee". SWIMMING POOL USE AGREEMENT AND LIABILITY WAIVER The swimming pool and surrounding areas located at this rental property (the “Premises”) are provided to registered guests solely for personal, recreational use. By entering, accessing, or using the pool or pool area, each guest and visitor (“Guest”) agrees to the following terms and conditions, which are intended to be enforceable under California law: Assumption of Risk (California Civil Code § 1714 Acknowledgment) Guest acknowledges that under California Civil Code § 1714, every person is responsible for injuries caused by their own lack of ordinary care. Guest understands that the swimming pool involves inherent risks including, without limitation, drowning, slipping, falling, physical injury, illness, or death. Guest voluntarily and expressly assumes all risks associated with use of the pool or presence in the pool area. No Lifeguard on Duty Guest understands that no lifeguard services are provided. The property owner, host, and any affiliated agents or representatives (“Owner”) do not supervise or monitor pool activity. Guest is solely and fully responsible for the supervision and safety of all members of their party, including minors and visitors. Release, Waiver, and Discharge of Liability To the fullest extent permitted by California law, Guest hereby releases, waives, and discharges Owner from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, injury, illness, damage, or death occurring in or around the pool, whether caused by Owner’s passive negligence or otherwise. Guest understands this waiver does not apply to gross negligence, willful misconduct, or violations of statutory duty by Owner, as prohibited under California law. Indemnification Guest agrees to indemnify, defend, and hold harmless Owner from any claims, damages, losses, or expenses (including attorney fees) arising out of Guest’s use of the pool, Guest’s conduct, Guest’s negligence, or Guest’s violation of this Agreement. This includes claims brought by minors or third parties under Guest’s supervision or invited by Guest to the Premises. Mandatory Supervision of Minors California law requires continuous, competent adult supervision of any minor near a body of water. Guests must enforce this rule at all times. No child is permitted in or near the pool area without direct, line-of-sight adult supervision. Prohibited Conduct The following conduct is strictly prohibited and constitutes a breach of this Agreement: • Diving • Running, horseplay, or unsafe behavior • Use of the pool while intoxicated or under the influence of drugs • Tampering with pool equipment, gates, alarms, or safety devices • Bringing glass containers into the pool area Condition of Premises (California Premises-Liability Notice) Guest agrees to inspect the pool and surrounding area prior to use. By using the pool, Guest accepts the condition of the Premises “as is” and assumes responsibility for reporting hazards promptly. Continued use is an acknowledgment that the area is reasonably safe for Guest’s intended activities. Compliance with Posted Rules and Instructions Guest must comply with all posted rules and any verbal or written safety instructions provided by Owner. Failure to do so may result in immediate termination of pool privileges without refund. Governing Law and Venue (California) This Agreement shall be governed by and interpreted under the laws of the State of California. Any claims, disputes, or legal proceedings arising out of this Agreement shall be brought exclusively in the appropriate court in the County where the Premises are located. Acknowledgment and Binding Effect Use of the pool constitutes Guest’s acknowledgment that they have read, understood, and voluntarily accepted these terms.
