Sea Trail Resort--One mile to beach. On golf course. Second level, one bedroom, one bath. Linens are provided. Our trademark is our pristine three-mile-long sandy beach; beautiful sunrises and sunsets (which can be seen from the island because of our unique southern exposure) and spectacular golfing. Other unique features of our community include Bird Island, a 2000+- acre nature preserve that borders the west end of Sunset Beach and can only be accessed by land via the beach. -We have a Saturday to Saturday seven-night minimum during the summer months (June, July and August) and a three-night minimum all other times. -Access to Village Activity Center for nominal daily or weekly fee -- includes indoor and outdoor pools, hot tubs, workout facility and group activities for kids and adults. Only $110 for the week for a family of up to 6! $80 for couples. This vacation home is at Sea Trail Resort, which is about as close as you can get to the beach yet have all of the amenities of a resort. Sea Trail boasts three signature golf courses (Rees Jones, Dan Maples and Willard Byrd) just about a mile from the beach. Sunset Beach's Ingram Planetarium, which provides educational and entertaining programs for both adults and children, is just down the road. When you're ready for night life, bumper cars, and a bit of history, Myrtle Beach, SC, and Wilmington, NC, are just minutes away. And there are dozens of other areas of interest and local attractions nearby. Travel to these nearby areas and return to the luxury and quit of your own space. Restaurants with fresh seafood, grocery store, drug store, beach apparel and supplies all within one mile. Our condo is 5 minutes from the beach and is located on one of the three golf courses at Sea Trail Resort in Sunset Beach, NC. Sea Trail's courses are available to the public and rates vary from season to season. Sunset Beach is 5 miles from Ocean Isle Beach, NC, 4 miles from Calabash, NC, 15 minutes from N. Myrtle Beach, SC and 50 minutes south of Wilmington, NC. Rental Contract (Must be accepted before rental) Table of Contents I. General Terms and Conditions II. Departure Requirements III. Pet Terms and Conditions (if applicable) "THIS IS A VACATION RENTAL AGREEMENT UNDER THE NORTH CAROLINA VACATION RENTAL ACT. THE RIGHTS AND OBLIGATIONS OF THE PARTIES TO THIS AGREEMENT ARE DEFINED BY LAW AND INCLUDE UNIQUE PROVISIONS PERMITTING THE DISBURSEMENT OF RENT PRIOR TO TENANCY AND EXPEDITED EVICTION OF TENANTS.YOUR SIGNATURE ON THIS AGREEMENT OR PAYMENT OF MONEY OR TAKING POSSESSION OF THE PROPERTY AFTER RECEIPT OF THE AGREEMENT, IS EVIDENCE OF YOUR ACCEPTANCE OF THE AGREEMENT AND YOUR INTENT TO USE THIS PROPERTY FOR A VACATION RENTAL." YOU HEREBY AGREE NOT TO DISCLOSE, WITHOUT OUR PRIOR CONSENT, THE TERMS AND CONDITIONS OF THIS RENTAL AGREEMENT TO ANY PARTY INCLUDING, BUT NOT LIMITED TO, SEA TRAIL RESORT AND ITS REPRESENTATIVES. Verbal discussions prior to booking are not binding on the owner. All changes to your reservation must be communicated in writing. DISCLOSURE: You are renting from the property owner, not Sea Trail. Your contract is with the property owner. The owner, owner's agent and Sea Trail Resort will not be responsible for accidents or injury to guests, pets or for loss of money, property, or valuables of any kind. The property owner has no control over Sea Trail assets. Sea Trail may change policies and prices at will and without notice to the property owner. DAMAGES/SECURITY DEPOSIT: All reservations must be secured with a Visa or MasterCard credit card for security purposes. It is understood that any damages or missing items are the responsibility of the renter and you are responsible for all that occupy or visit the condo. CANCELLATIONS/REFUNDS: Per Airbnb Terms In the event of a mandatory evacuation due to a hurricane or other severe weather, all guests are expected to depart as directed. A pro-rated refund will be issued for the days that coincide ONLY with any mandatory evacuation. Protect yourself with trip insurance. A good site to compare trip insurance policies can be found at insuremytrip.com Refunds will not be given due to appliance, air conditioning or other mechanical breakdowns, utility outages or housekeeping issues. These items are maintained in good working order and any failures will be fixed as quickly as possible. Refunds or rate adjustments are not made for inconvenience due to construction, road repair, etc. Report any problems as soon as they occur. OCCUPANCY: Occupancy cannot exceed the number stated in your confirmation and the condo can only be occupied by the persons for whom you provide names. Activities that disturb other guests are not allowed. Any violation of these requirements will result in denied occupancy without refund of rent OR additional charges for overcrowding. Additional charges will be billed to your credit card on file. If you know in advance of your arrival that an additional person will be staying with you, please let us know. GRILLING: Resort regulations and town law prohibits grilling on the screened porches. Grilling should be done a minimum of 20 feet from the building. Extreme care should be taken in extinguishing the coals and storing the grill. Grilling is forbidden during times of high winds. SMOKING: All of our rental units are non-smoking. If you smoke in the unit, a $250 charge will be billed to your credit card. If we have to move a party to another condo because you have smoked in the unit, you will be liable for loss of rent, relocation costs and the $250 charge. ENERGY CONSERVATION: You agree to practice good energy and water savings techniques as detailed under the topic 'Energy Conservation' on this webpage. MAIL: Mail is not delivered to our condos. You will need to obtain a Post Office box. TELEPHONES: Our condos do not have land line telephones. Please bring your cellphone or purchase a TracPhone to use during your stay. TRASH DISPOSAL: Please deposit your trash in the dumpster located in the gray/blue wood enclosure behind Club Villa building 24. PLEASE DEPOSIT ALL TRASH INSIDE THIS BIN PRIOR TO YOUR DEPARTURE. KEYS: Entry doors are equipped with combination locks so keys are not required. ENTRY DOORS ARE NOT SELF LOCKING AND WILL ONLY LOCK IF YOU PRESS THE LOCK BUTTON ON THE LOCK'S KEYPAD, WHICH IS LOCATED ON THE EXTERIOR OF THE DOOR. HEATING AND AIR CONDITIONING: Please keep all entry/exterior doors closed when the heat or air conditioning system is on. If any door leading to the outside is left open for more than 15 minutes, the heating or air conditioning unit will turn off and will not restart without the assistance of a heating/cooling technician. You will be billed for all expenses incurred to restart the heating/air conditioning system. PESTS: Occasionally, you will see a bug inside, usually dead. Our POA treats the inside and outside of the condo buildings periodically. Keep any pests outside by making sure the entry doors are always closed. MAINTENANCE/REPAIRS: Please notify the owner of your condo for maintenance and repairs during your stay and upon departure. Spare light bulbs for the bathroom vanity and other lamps are in the condo and these can easily be replaced without the use of a stool or ladder. Under no circumstance should you handle a broken compact fluorescent light (CFL). CFLs contain mercury and must be handled and disposed of with extreme care. LINENS: You may bring your own bed and/or bath linens. We also provide linens at no charge with your rental-a savings to you of $40 to $150 depending on the number of bedrooms. Four sets of bath linens will be under each bath vanity or in the dryer. All linens are of average quality and will be in clean and good condition when you arrive. If you require new or Pima cotton towels/facial cloths, etc. or 1000 thread count sheets, then please bring your own. Replacement linens are not available during your stay. Do not take bath towels to the beach or to the pool. Missing linens will be billed to the credit card on file. REFRIGERATORS: Please leave the temperature setting in the refrigerator and freezer set to medium (3). After being filled with room temperature food, the refrigerator may take up to 24 hours to reach its optimum operating temperature. To expedite the cooling process, minimize the amount of non-perishable cans or bottles you place in the refrigerator. PETS AND ALLERGIES: Some of our units are pet friendly. In the event of an allergic reaction by someone in your party, we take no responsibility since we cannot control guests bringing pets into our units without our knowledge-a violation of our rental agreement. LATE CHECK-OUT POLICY: Check-in is at 4:00 p.m., and check-out is at 11:00 a.m. A late checkout fee of $50 per hour per bedroom will be charged to the credit card on file if the unit is not vacated on time. PERSONAL PROPERTY/ITEMS LEFT BEHIND: A good faith effort will be made to find and return items left behind upon request. You agree to pay a charge of $25.00 plus shipping and packaging costs for items returned. If the item is not found, you agree to pay $25.00 for efforts expended on your behalf looking for the item(s). DIRECTIONS: We want you to get to your condo without getting lost. A GPS or automated map system will not (at this time) generate DOOR TO DOOR directions so please do not ask for a street address. Use our directions and eliminate the hassle of delaying your arrival after a very long trip. INTERNET USE TERMS & CONDITIONS: Secure wireless internet access for PERSONAL use only is free. We reserve the right to modify or terminate the service for any reason and without notice. THE SERVICES AND PRODUCTS ARE PROVIDED ON AN "AS IS" BASIS AND YOUR USE OF OUR SERVICE IS AT YOUR OWN RISK. OWNER DOES NOT WARRANT THAT THE SERVICES WILL PERFORM AT A PARTICULAR SPEED OR WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE from hackers. UNDER NO CIRCUMSTANCES SHALL THE OWNER BE LIABLE FOR INCIDENTAL, CONSEQUENTIAL, INDIRECT, OR SPECIAL DAMAGES OF ANY NATURE. These Terms and Conditions will be governed by and construed in accordance with the laws of the State of North Carolina. These terms constitute the entire agreement between the parties and supersede and replace all prior understandings or agreements, written or oral, regarding Internet use. END OF GENERAL TERMS AND CONDITIONS II. VILLA DEPARTURE REQUIREMENTS The departure requirements stated below are mandatory and non-compliance of any item will result in an additional charge. A list of these requirements will be found on your refrigerator. These requirements will take no more than 10-15 minutes. Without your assistance, our cleaners will not be able to get the unit ready for the next group of arriving guests. Use the vacuum cleaner during your stay. If your vacuum cleaner has a canister with a filter, please empty the canister. DO NOT dispose of the filter. Remove all trash and deposit it in the dumpster behind Club Villa 24 (in the gray wood enclosure). Please install new trash bags in each receptacle. Kitchen bags are under the kitchen sink. Dispose of all bath soap. DO NOT FLUSH IT DOWN THE COMMODE. Bed and bath linens: If you do not bring your own linens, please do the following: Wash a load (per washer) of bed and bath linens. Wash the sheets and pillowcases first; towels, second. When complete, place these in the dryer and start the dryer. Start a second load of wash. You don’t need to wait for the linens in the dryer or second load of wash to finish before departing but if you are, please move the items in the washer to the dryer and start the dryer. Fold any dried items and place them on the beds. DO NOT wash bedspreads, comforters, mattress covers, dust ruffles, pillow shams, blankets or colored bath mats. If a bed has been slept in, do not make it up. Wash and return dirty dishes to their original arrival location(s). Do not leave at checkout time with a load in the dishwasher. If you have moved furniture, move it back to its original location. Clean big spills in the refrigerator, boil overs on the stove/oven and microwave. Replace any supply items that were depleted during your stay (toilet paper, laundry and dishwasher detergents, trash bags). Upon departure, call or text (24/7) the property owner at 937-477-8344 and leave a message stating your unit number and departure time. This will allow us to schedule our cleaning crew in a timely manner. END OF VILLA DEPARTURE REQUIREMENTS III. PET TERMS AND CONDITIONS (Skip this section if you are not bringing a pet.) Approval ALL PETS MUST BE APPROVED IN ADVANCE. To be approved, dogs must be at least 2 years old, of select breeds, spayed/neutered and crated at all times when you are away from the condo and at night. If a pet is found on the premises without prior approval, you will be billed a $300 non-refundable charge and the pet must be removed immediately OR the condo must be vacated and all rent will be forfeited. Your dog must be on a leash at all times per the Town of Sunset Beach pet ordinances. For a complete list of pet ordinances, go to sunsetbeachnc.gov Vaccinations You certify that any and all pets occupying the condo are current on their vaccinations/shots and each has had a flea treatment no more than 2 weeks prior to arriving at Sea Trail. You also certify that your dog(s) will be bathed no more than one week prior to arriving at Sea Trail. PLEASE BRING YOUR PET'S VACCINATION RECORDS WITH YOU; local veterinarians may not treat your pet without these records. Damages Call owner at 937-477-8344 to report pet-related damages that exist upon your arrival. You assume total financial responsibility for your pet in the event damages are done to the condo, resort property or persons in the condo or elsewhere. You should check your homeowner's insurance policy to verify if it covers dog bites. You will be charged a minimum of $100 or actual costs, whichever is more, for additional cleaning due to the following: pet hair on the bed(s), pet hair anywhere on the sofa(s) or chairs, visible pet hair on the floor, urine or waste and pet odors. Sheets, blankets, bedspreads, comforters, etc. that smell will be disposed of and you will be billed for the replacement cost of each item. If your pet establishes a favorite sleeping place in the condo, take good care to clean this area. You will be charged actual repair costs and/or replacement costs (includes replacement item, labor and procurement time) for the following: chewed items, bite marks on the furniture, chewed rattan/wicker strapping, pushed out and/or torn screens, food/pet stains on the carpet, bent blinds, buckling wood floors due to pet water spills, chew marks on blinds, scratched paint marks on the inside of the entry doors and other visible damages. If the unit is un-rentable for the next arriving guests, you will be responsible for lost rent and the cost of relocating them to another condo. Other concerns Under no circumstances should you arrive at the condo, leave your pet and go shopping. Your pet needs to get used to unfamiliar surroundings in your presence. When your pet is left alone, it is a mandatory requirement that he/she should be crated. NO EXCEPTIONS. In no instance should you allow your pet to have free run of the condo. A pet left alone in our condo when they aren't left alone at home can yield disastrous results. Do not place your pet’s crate near the entry door or the windows. The radio or TV should be turned on to keep your pet entertained. If your pet is noisy and others complain, you will be asked to vacate the premises and all rents will be forfeited. PET FOOD AND WATER SHOULD NOT BE LEFT OUT OR LEFT UNCOVERED DURING THE DAY AND NIGHT. FOOD AND WATER OF ANY TYPE WILL ATTRACT PESTS FROM THE OUTSIDE. Place your pet's food and water bowls on a mat or newspaper on a non-carpeted area to prevent spills and subsequent damage to laminate. ALWAYS CLEAN UP AFTER YOUR PET-THIS IS A TOWN OF SUNSET BEACH ORDINANCE. Walk your pet away from lawns, flower beds, and other public areas. Never take your pet into a dining area, pool area, bar, or lounge. BEACH ACCESS: FROM THE FRIDAY BEFORE MEMORIAL DAY THROUGH LABOR DAY, PETS ARE ALLOWED ON THE BEACH ONLY BEFORE 8 AM AND AFTER 6 PM.
