H1151 Rental of a vacation home in Hamilton Cove includes use of the community’s amenities (pool, spa, health club, 18-hole putting course, tennis courts, croquet court, sand volleyball court and beach area with built in barbecues and picnic tables). Some restrictions may apply. Occupants subject to Hamilton Cove Homeowners Association Rules & Regulations. This vacation home rents on a nightly basis (2 night minimum, holidays and selected dates excepted; 3 night minimum July & August). An inherent risk of exposure to COVID-19 exists in any public place where people are present. Hamilton Cove amenities, including pool, spa, gym and tennis courts will re-open at the discretion of Hamilton Cove Homeowners Association for the health and safety of the community. All CIVR guests must comply with all applicable State of California, County of Los Angeles and City of Avalon laws, orders and protocols including the State of California COVID-19 Industry Guidance: Hotels, Lodging and Short Term Rentals. ----- This property is in a residential community and is only suitable for quieter groups. NO smoking, NO parties/events. NO pets allowed per HOA rules. You must be 25+ years old to rent this property. No daytime visitors allowed. Please make sure you are comfortable with these policies before booking. Violations of these rules will result in immediate eviction with no refunds. Property Management provided by Catalina Island Vacation Rentals. Check-in office: 212 Catalina Avenue. All check-ins outside of normal business hours must be arranged with our office in advance. This property is professionally managed by Catalina Island Vacation Rentals. The guest/tenant is required to submit a signed rental agreement(s) within 48 hours of an accepted Airbnb reservation. - Responsible party (YOU) must be 21 years or older per city laws to sign the rental agreement. Failure to submit this signed agreement within 48 hours will result in a cancellation of the reservation. - The city of Avalon has set the maximum occupancy to 2 people per bedroom TERMS & CONDITIONS OF RENTAL: - Violation of any rules/ordinances listed below may result in fine(s) and/or immediate eviction. Renter agrees that any such fines will be charged to the credit card on file: -All cancellations subject to a $75 cancellation fee regardless of time frame. - No pets allowed per HOA rules ( fines up to $3,000) - No house parties: An unauthorized party or event at the property will lead to your immediate removal from the property. The city of Avalon has strict vacation rental ordinances regarding parties and any violation can result in fines up to $3,000. Your cooperation is appreciated. - No outdoor music allowed at any volume at any time of day (This includes any music, at any volume, on any device such as a cell phone) any indoor music which can be heard from the street OR from the neighboring property is prohibited. - No smoking indoors. Smoking is strictly forbidden anywhere inside the house. If smoking outside, please make sure to use an ashtray and collect all cigarette litter. - Occupants must not exceed the number of people advertised. (Per city law) - GOLF CARTS: Not all properties offer a golf cart. Drivers must be 21 years of age with a valid driver's license. If the use of golf cart is abused or the rules violated, you will forfeit the use of the golf cart for the rest of your stay. Fines also may be assessed against your credit card or security deposit. - Please do not place hot or wet plates or cups directly on furniture, use coasters. HOUSEKEEPING & MAINTENANCE: - Guest/Tenant must notify upon check-in or within 24 hours of any housekeeping complaint or property maintenance issue. - Please DO NOT attempt to fix anything yourself. Call us immediately if maintenance is needed. Broken/Missing items: we much prefer that you report to us any items broken or missing upon your departure. We understand that accidents happen and would appreciate your honest cooperation if something went wrong while at the house. BEFORE YOU LEAVE CHECKLIST: - ALL trash should be tied in garbage bags and put in your trash receptacle outside of the building prior to departure. Excessive trash left at the property may incur extra charges. - Dishes – Please clean and put away all dishes and cookware. If the home has a barbecue grill, please clean it after use. Please clean up any obvious messes. Additional cleaning fees may be incurred if the property is left in disarray. - Please do not re-arrange the house décor or move furniture. - Close and lock all doors and windows. Please make a special effort to check all sliding glass doors to ensure they are properly locked. - Make sure to turn off all lights, electronics, and thermostats. - Return all sets of keys and pool passes provided, to our office: 212 Catalina Ave in Avalon. -- Binding Golf Cart Agreement Renter agrees that violation of any portion of the golf cart agreement may result in use of the golf cart being revoked immediately and without notice. Renter agrees to operate the golf cart safely and responsibly. Renter agrees to be legally and financially liable for any costs of repairs to the cart and for the loss, damage and/or injuries to my person or property as well as the persons or property of others, regardless of fault. Renter agrees to inspect the golf cart immediately upon arrival and report any concerns of damage or disrepair to management immediately, and that any damage not reported upon check in will be attributed to renter, and for repairs to be charged to the credit card on file. Renter agrees to be financially responsible for all moving or parking violations which occur during their rental, with the cost of such violations plus a $25 accounting fee to be charged to the credit card on file. Renter agrees to return the golf cart to the rental property immediately upon completion of the rental period. Renter agrees that they will fill the tank with gas prior to their departure. Should the tank not be left full, renter agrees to pay a $55 convenience fee to refill the cart (this will include the cost of gas) Renter agrees that this amount will be charged to the credit card on file. Renter acknowledges that the golf cart is subject to the same laws and regulations pertaining to motor vehicles. Renter therefore agrees that the golf cart will be operated in accordance with the laws of the State of California and City of Avalon, including but not limited to observing posted speed limits, traffic laws, and not driving the golf cart while under the influence of alcohol or drugs. Renter agrees that only persons 21 years of age or older, with a valid driver's license and current automobile insurance shall be permitted to drive the golf cart. Renter agrees not to exceed the maximum occupancy of the golf cart. Renter agrees to notify CIVR in the event of mechanical failure of the golf cart. Renter acknowledges that the golf cart is complimentary and not included in the price of the rental. In the event of a mechanical failure CIVR will make every reasonable effort to have the golf cart repaired. Renter agrees that inability of CIVR to affect these repairs during the rental will not entitle guest to any monetary compensation or reimbursement for alternate transportation, and that CIVR will not be able to provide a replacement cart. Renter agrees to hold harmless, defend and indemnify Catalina Island Vacation Rentals, Inc. and the owner of the golf cart for any and all damages and claims of any nature whatsoever that may arise from the use of said golf cart during the time of the rental period, including but not limited to claims for damages to the golf cart itself, renter's person or property, and/or the persons and property of others.
