Queen size beds in all rooms. A futon in the master suite. The futon can fit up to 2 people. All bedrooms have private bathrooms. Check if you can book during during stay. Large screen Smart TV’s in family room, downstairs bedroom and the primary bedroom w/ complimentary Fubo Guest access You have access to the entire home. The garage is locked to be used for storage. The fenced in paved patio will also be available. Other things to note SMOKING AND VAPING ARE STRICTLY FORBIDDEN IN, OR WITHIN 25 FEET OF, THE PROPERTY. Evidence of smoking, such as the smell of cigarette or cigar smoke, vaping, or marijuana inside the home by the cleaning crew is sufficient basis to charge the Guest for smoke cleanup and deodorizing, AC ducts cleaning, and filters replacement, and furniture cleaning. This type of cleanup is expensive and the Guest is liable for the deep cleaning costs incurred. Guest will be charged a fee of $500 USD if there is evidence of smoking on the Property. Guest also must comply with all smoking restrictions in or around the Common Areas or Common Facilities. Pet fee is $150 and allows for up to 2 small dogs. Dog weight must be under 40 lbs. Only use the full-flush option on the toilet and press down fully until the contents of the bowl go down. There is a half-flush option that is ineffective and can result in a blockage. Also, the downstairs bathroom toilet is pressurized. If there is low pressure. Press and hold the handle down for 10-15 seconds until you hear a different noise, then continue to hold down for another 30 seconds. Give the toilet about 10 seconds after letting go of the handle and then resume use. Other method is just by pressing and tapping on the handle until it gets stuck down. The mailbox is not to be used by guests (no mailbox key will be provided to guests). Complete Stay LLC is not responsible for missing or lost packages. Complete Stay LLC associates will not grab packages for guests from the neighborhood mailbox. Occupancy The maximum number of occupants is limited to eight(8)people. For clarification, this number applies to all overnight guests, day visitors, and children. Unless otherwise approved by the property owner, occupancy over the indicated capacity may result in the immediate termination of this agreement and removal of you, other members of your rental party, and visitors from the property as well as forfeiture of all amounts paid. Check-In No keys to lose or to return! This property provides secure, keyless entry with an August Smart Lock. You can lock and unlock the door with your smartphone, using a unique virtual key, or personal entry code issued to you for the duration of your stay. In some instances, the Property Owner may be able to accommodate an early check-in request. Early check-in requests should be sent via an electronic communication channel (i.e., chat, SMS, email, etc.). Late Check-Out Approval of late-check out is dependent upon availability. Late check-out requests must be received 24 hours before your departure time. Requests should be sent via an electronic communication channel (i.e., chat, SMS, email, etc.). Please note that the maximum extension available for late check-out is up to two (2) hours after the designated check-out time. If a Guest requests a late check-out beyond the maximum extension, they will be charged an additional fee of 50 percent of the nightly rate for the day. If a Guest does not request a late check-out and does not vacate the property by the designated check-out time, an additional fee of 50 percent of the nightly rate plus 50 percent of the cleaning fee will be charged. If a Guest has not vacated the property within two (2) hours of their designated check-out time, this will constitute holding over. Extensions Approval of extensions is dependent on availability. Extensions to the rental period are granted if the property is available and the guest submits their request for an extension in writing 24 hours before Check-out Date. Additional nights are charged at the advertised nightly rate for the dates requested. If the rental period is extended, this Agreement will remain in effect for the new rental period. An extension will constitute a new rental period and any application of discounts and/or promotions will not retroactively count toward the prior stay. Holding Over Because of the nature of the Property Owner’s business, Guest understands, and is hereby put on notice that any unauthorized "holding over" of the property past the stated rental period could severely jeopardize the Property Owner’s business and cause loss of rental income from other previously booked guests, temporary and/or permanent loss of business, goodwill and reputation and, among other things, could force the Property Owner to breach an agreement with similar Guest(s) who may have reservations during Guest's unauthorized "holding over" period. In the event the Guest does not vacate the Property, Property Owner may be legally liable in damages to said, other guests. Guests should be aware that unauthorized "holding over" has been construed as a factor in establishing "malicious continuing occupation" of the property, which may entitle Property Owner to treble damages in any unlawful detained action. Guest also recognizes the unauthorized "holding over" could be grounds in court as a cause of action for intentionally interfering with the Property Owner’s prospective business advantage. If Guest shall continue to occupy the Property after Check-out Date, the Guest shall pay all damages arising out of holdover including but not limited to costs of defaults or displacement to subsequent guests. Additionally, the Guest shall pay Property Owner the greater of double the Guest’s current rent or double the rent for the subsequent period at the advertised rate, whichever is greater. In addition, Property Owner will charge $100 USD per hour for every hour past the designated check-out time. Eviction Property Owner, or agents of the Property Owner, will have the right to enter the Property when Guest has abandoned or left the Property or when eviction is necessary due to breach of this Agreement. ALL guests, members of the rental party, and visitors must vacate the Property within 60 minutes of the Property Owner or agent of the Property Owner's arrival to notify of eviction. If Guests are present when the Property Owner or agent arrives, up to sixty (60) minutes will be allotted to immediately remove all personal property and exit the Property. If Guests are not present or personal property is not removed within sixty (60) minutes, the Property Owner or agent will photograph, inventory, and store said property. Charges above the eviction fee may apply if items are required to be removed by the Property Owner or agent. The primary Guest must claim any stored personal property within three (3) days. If not claimed, the personal property will be sold or donated. Rental Rules Guest agrees to abide by the House Rules (attached to this Agreement) at all times while at the Property, and shall cause all members of the rental party and visitors to abide by these rules at all times while residing at the Property. Please review these terms and conditions carefully, as violation(s) may result in additional fees or the immediate removal of you and other members of your rental party from the Property without refund. Further, violation of any law or ordinance by any individual at the Property during your reservation will result in the immediate removal of the Guest and other members of the rental party from the Property without refund. Use and Care Guest will use the furnished house in a legal, safe, reasonable, and clean manner without causing intentional damage to the Property or its furnishing. Guest expressly acknowledges and agree that this Agreement is for transient occupancy of the Property and that Guest does not intend to make the property a residence or household. This Agreement is only for the licensed use of the Property for the approved reservation dates. It is expressly understood and agreed that this is a short-term Property and is not a lease or other long-term residential tenancy agreement. It creates no Rental rights to the Guest, anyone in the rental party, nor visitors and no rights to renewal or for recurring usage. Guest agrees that they will be present at the Property for the entire duration of the reservation and that they will be responsible for the actions and behavior of each person present at the Property during the rental period; this includes ensuring each individual in your rental party or otherwise present at the Property is aware of and in compliance with the terms identified in this Agreement. Guest acknowledges that use of the Property and amenities such as pools, fitness equipment, play areas, and the like may be potentially dangerous and involve risks if improperly used, particularly with regards to children and such use is at Guest’s own risk. Illegal Use Guest shall use the Property for legal purposes only and any other non-legal use, such as but not limited to, illegal drug use and distribution, abuse of any person, harboring fugitives, parties and/or large gatherings, etc. shall cause termination of this Agreement with no refund of rents or deposits and immediate eviction. Guest will not use the Property in an immoral or offensive manner nor violate any law or ordinance. Condition of Property The Property Owner has, to the best of their ability, given an accurate description of the property and its condition. The cleaning staff has cleaned and sanitized the Property before your occupancy. Guest understands that it is considered as reserved "sight unseen." The Property is routinely checked for deficiencies and damage. All electrical, plumbing, and appliances should be in working order. The failures of operation of certain extra amenities, such as TVs, games, or the Internet and WiFi service are not a basis for any refund. Property Owner will make every effort to have these items repaired as soon as possible but does not guarantee that they will be repaired during the Guest’s occupancy. If you notice any problems, hazardous conditions, housekeeping issues, or maintenance issues, please notify the Property Owner immediately upon Check-in. We will do our best to attend to the problems but may not be able to address everything immediately, especially over holidays and weekends. If the Property Owner does not receive notification of issues/problems within 24 hours of check-in, the Property Owner shall assume the Guest has conducted their inspection and found the Property and its furnishing to be in good condition. Under no circumstances will any of the rental money be refunded or returned because of the condition of the house if deficiencies are not reported within 24 hours of check-in. The Guest agrees to hold the Property Owner harmless from any liability for the condition of the house. Guest hereby acknowledge that if the Property has access to shared amenities, the repair and maintenance of such shared amenities may not be within the Property Owner’s responsibility or control. Check-Out Procedures Guest is responsible for completing check-out procedures in the provided guest welcome book, posted in the Property, and attached to this Agreement. Check-out procedures include loading and starting the dishwasher, taking out all trash, emptying the refrigerator, securing all doors and windows, and leaving the unit clean, damage-free, and in good shape for the next Guest. Any extra cleaning or excessive trash removal will be billed to the tenant at a minimum fee of $50 USD. Keys Failure to return the key before check-out will result in a $30 USD key replacement fee. Parties Parties and large gatherings are NOT permitted at this Property. Any special occasions such as weddings, receptions, family reunions, or increase of occupants (guests not registered on the registration form) must be disclosed at the time the reservation is made and is subject to advanced approval. Firearms The Guest, persons in their rental party, and visitors are not allowed to keep firearms, explosives, combat knives, bows, and other weapons on the Property. Violation of this term shall be grounds for immediate termination of this Agreement and immediate eviction from the Property. Fireworks Guest agrees that fireworks and other hazardous materials shall not be used in or around the Property. Violation of this term shall be grounds for immediate termination of this Agreement and immediate eviction from the Property. Utilities Electricity, water, and internet will be provided by the Property Owner. Fubo or Google TV will be provided to guests. No refund of rents shall be given for outages, content, lack of content, or personal preferences concerning cable TV service. High-speed wireless internet is provided as a convenience only and is not integral to the agreement. No refund of rents shall be given for outages, content, lack of content, speed, access problems, lack of knowledge of use, or personal preferences concerning internet service. Child Proofing Guest understands that no special efforts have been made to “childproof” this house, and accepts the risk of harm to any children on the Property. These risks are not limited to, but include, falling down the steps, access to the pool, adjacent street, cleaning supplies, and plants in the house, patio, and street that might be poisonous if ingested. THE SUPERVISION AND SAFETY OF ALL CHILDREN ARE THE DIRECT RESPONSIBILITY OF THE GUEST OR CARETAKERS OF ANY CHILDREN ON THE PROPERTY. Furnishings The Property is fully furnished to include appliances. Furnishings are subject to change without notice. Furniture, bedding, mattress pads, utensils or any other property supplied with the Property must not be taken out or transferred from one property to another. These items are owned by the Property Owner and are part of this Agreement. The Guest is responsible for taking good care of the furniture, furnishings, appliances, and anything else inside and outside of the Property. The Guest will be responsible for paying for any repair or replacement of these items if they are damaged, accidental or intentional, by the Guest, persons in their rental party, or visitors during the rental period. Quiet Enjoyment The Guests and their rental party shall be good neighbors respecting the rights of the surrounding Property Owners and Visitors. Neither Guests, persons in their rental party, nor their Visitors shall create noise or disturbances likely to disturb or annoy the surrounding Property Owners or Visitors. Creating an ongoing disturbance of the above nature shall be grounds for immediate termination of this Agreement and immediate eviction from the Property. Quiet hours start at 11:00 PM local time where indoor and outdoor noise should be kept to a minimum. Quiet hours end at 8:00 AM local time. Force Majeure In the event, your stay at the Property becomes impossible for any reason outside the Property Owner’s control, including natural disasters, fire, evacuation orders, or other acts of government agencies, the Property Owner may choose to cancel your booking and issue a partial or full refund or booking credit of the amounts paid. For purposes of clarification, no refund or credit is due (or will be made) to you for inclement weather unless the Property Owner initiates the cancellation. You and your rental party must comply with any mandatory evacuation order. There shall be no refunds of rents due to shortened stays or ruined expectations. The owner is not responsible for the relocation of the Guest should the house become non-habitable due to acts of God, such as wildfire, floods, tornadoes, earthquakes, and natural disasters, and the Owner is not liable for the costs of finding alternative accommodation or for damages because alternative accommodation cannot be found. The Property Owners recommend the purchase of trip insurance that would protect Guests from monetary loss from such an event. Insurance Guest is encouraged to purchase traveler insurance in case of unforeseen circumstances, accidents, or other issues that may prohibit Guest from traveling or fulfilling rental terms. Additionally, the Guest’s personal property is not covered by the Property Owner’s insurance policy against loss, theft, and negligence. Possessions Guest must contact the Property Owner within 48 hours after departure to inquire about items left behind in the Property. Items left behind by the Guest will be held for the Guest and every reasonable effort will be made to contact the Guest for return. The Property Owner shall not be held liable for the condition of said items. If items are not claimed within three (3) business days of contact from the Property Owner, the items shall become the property of the Property Owner. If Guests request to have items returned to them, the Guest shall be responsible for the trip fee ($50 USD), shipping, handling, and packaging costs. Subletting Subletting is not allowed. The Guest agrees not to assign or sublet the Property or any part of it and shall not assign any interest (in whole or part) to this Agreement or any rights hereunder. Repairs/Damage The Property Owner will deliver Property in clean and working order. Guest shall maintain the Property in a good, clean, and ready-to-rent condition except for normal final service cleaning and laundering of bed linens and towels. Even in cases where a cleaning fee is charged, the Guest is expected to leave the Property in a clean, neat, and orderly condition and respect the Property Owner’s requests regarding check-out procedures (attached to this Agreement). Guests shall pay for maintenance and repairs should the Property be left in a lesser condition. Guest agrees that the Property Owner shall deduct costs of said services from the security/damage deposit before its return if Guests cause damage to the Property or its furnishings. Guest may be responsible and liable to Property Owner for damages above the security deposit for damages or loss caused by the Guest, their rental part, or their visitors. Access Guest shall allow Property Owner, or agents of the Property Owner, access to the Property in case of an emergency; for purposes of repair, inspection, maintenance; to supply necessary or agreed service; or upon central alarm events (i.e., smoke, fire, low temperature, or break-in) or if Property Owner has a reasonable belief that there is any imminent danger to any person or property. Property Owner, or agents of the Property Owner, shall exercise the right of access in a reasonable manner by giving at least 12 hours notice before entry (unless in case of emergency). Violation of this clause by Guest is a default under terms of this agreement and Guest shall be responsible for any costs of enforcing this clause or damages resulting from limitation to access contrary to this clause. Falsified Bookings If your booking was made under false pretense, including, but not limited to, a falsified name, age, or size of party, you will be subject to immediate cancellation of your reservation, termination of this Agreement, removal from the Property, and forfeiture of all amounts paid. Liability Guests shall hereby indemnify and hold harmless the Property Owner for any liabilities, damage, cost, or expense whatsoever arising from or related to any claim in connection with your use and/or occupancy of the Property, including, but not limited to, any claim or liability for personal injury, damage, fines, penalties, loss of personal belongings, or theft of property, which is made, incurred, or sustained by you and/or anyone using the Property during your stay. You and anyone using the Property during your stay accepts and assumes all risks involved in or related to the use of third-party transportation vendors, the pool/hot tub, activities participated in while on the Property, or amenities provided at the Property, as applicable. Guest expressly recognize that any insurance for property damage or loss that the Property Owner may maintain on the property does not cover the personal property of Guests and that Guests are encouraged to purchase insurance if such coverage is desired. Mediation and Arbitration If you have a dispute that arises from or relates to this Agreement or the Property, and if the dispute cannot be settled through direct discussions, you agree to try first to settle the dispute by mediation administered by the American Arbitration Association under its Commercial Mediation Procedures. If the dispute is not settled by mediation, you agree to submit all unresolved disputes, controversies, or claims to binding arbitration in Florida administrated by the American Arbitration Association per its Commercial Arbitration Rules. If the parties agree, the mediator involved in the parties’ mediation can serve as the arbitrator. Any award of the arbitrator against the Property Owner cannot exceed the total amount paid for the Guest’s booking at issue. You expressly waive all claims above and agree that your recovery shall not exceed this amount. Any such award shall be in satisfaction of all claims by you against the Property Owner. Judgment on any award rendered in such arbitration can be entered in and enforced by any court having jurisdiction. Attorney’s Fees Guests agree to pay all reasonable costs, attorney's fees, and expenses that shall be made or incurred by Property Owner enforcing this agreement. Governing Law This agreement is governed under the laws of the State of Florida. Amendment This agreement can only be changed or modified with written consent or permission from both the Property Owner and Guest. General Terms If any section, clause, paragraph, or term of the Rental Agreement is held or determined to be void, invalid, or unenforceable for any reason, all other terms, clauses, or paragraphs herein shall be severed and remain in force and effect. This Agreement shall be binding on and inure to the benefit of the parties hereto and on each of their heirs, executors, administrators, successors, and assignees. This Agreement or any rights hereunder may not be assigned (in whole or part) by you. This Agreement is taken in full compliance with federal, state, and local Fair Housing Laws, without regard to race, color, religion, sex, country of origin, handicap, or familial status. This Agreement becomes binding you’re your signature and receipt of your initial payment.
