The kitchen is fully equipped from microwave to coffee machine, juicer and toaster…all you need for breakfast each morning! Or you can simple relax on the balcony terrace overlooking the Montgo, the palm trees and swimming pool area. Bedrooms include a master with a king bed, one twin bedroom and a third bedroom with two children single beds. All bedrooms are equipped with ceiling fans as well as central heating/air conditioning. A work desk is also available in the third bedroom making it comfortable to work remotely. With two full bathrooms, there is plenty of space for everyone to keep up with daily routines. In such cases, a seasonal rental contract must be signed, which includes a security deposit. Both parties recognise the other´s legal capacity for this act. RECITALS 1. I. Whereas The Owner owns the following property which is in a perfect state of use PROPERTY: Address: Avenida de Gandia 39, Esc 5, Piso 3, Departamento A, Puerta 14 In the conditions and with the furniture and services whose description and photographs are shown at https://www.airbnb.com/rooms/633379513621156811. The Property is clean, in a perfect state of use, upkeep and fit for habitation. Moreover, the supplies and services that the property has work properly. 2. II. Both parties have agreed to the periodic lease of the aforementioned Property, by virtue of which they set forth this contract, which will be governed in accordance with the following CLAUSES 1.-PURPOSE The Owner hereby assigns the property described and the furniture described in Recital I to the Tenant, who accepts, on a temporary vacation lease and with the duration that will be indicated to the Tenant. The Tenant agrees to use the said property exclusively for vacation accommodation, with a maximum occupancy of ....... persons. For this purpose, it is hereby acknowledged that the property will not serve as the Tenant's or any of their occupants' habitual or permanent residence but will be rented on a temporary basis for tourist purposes. This lease constitutes a temporary lease for (holiday/occupational or other) reasons, pursuant to article 3.2 of Law 29/1994 governing urban leases, and under no concept or situation that occurs shall the lease that is subject to this contract be of a habitual. In relation to the use of the property, the following are strictly prohibited: o Any use other than the one described in the previous section. o Engaging in illegal, unlawful, dangerous, and/or unsanitary (or potentially dangerous and/or unsanitary) activities in the property. o Subleasing, whether in full or in part, without the prior written consent of the Owner. o Assigning the entire Contract or part of it without the prior written consent of the Owner. The Tenant is expressly prohibited from having any kind of domestic animal on the property, except with the explicit written consent of the Owner. Non-compliance with this obligation will be considered sufficient cause for the termination of the Contract, in accordance with the provisions of Article 27.1 of the current Tenancy Act (LAU). 2.- RENT AND DEPOSIT 1. Failure to abandon the Property within the agreed period will force the Tenant to pay a penalty equivalent to the amount corresponding to three times the daily rent, which may be required for completed weeks until the Property has been completely vacated by the Tenant. The foregoing without prejudice to the costs, expenses and other compensation that correspond to this party, including the fees of lawyers and attorneys, even when their intervention is not officially required, for each hour/day of delay. The Tenant must leave the property in the condition in which he found it, leaving it free of objects and belongings, with the services in perfect condition, as well as the furniture and accessories mentioned in section I, without any extension being possible. unless a written agreement is reached by and between the parties. 4.- OBLIGATIONS OF THE PARTIES 1. the Tenant hereby undertakes to maintain the Property in perfect conditions during the term freely agreed by and between the parties. 2. the Tenant shall not carry out activities at the property that are disturbing, unhealthy, noxious, illicit or contrary to the articles of association of the Community. the Tenant may not store flammable, explosive or corrosive materials on the property and/or carry out commercial or industrial activities therein. 3. the Tenant may not carry out building work or make whatsoever modification without the written permission of the Lessor. Holes may not be drilled or made in the walls under any circumstances. 4. the Owner is responsible for complementary services such as electricity, water, internet, cable t.v. etc, as well as the home insurance. 5. the Tenant also agrees to make reasonable use of the services (for example, among others, the Tenant will not leave the air conditioning/heating system on when there is no one in the house, or will not leave taps open). If the Tenant makes an unreasonable use of the servicess, the Owner may demand the payment of the extra cost that the misuse of the services by the Tenant could have caused. 6. the Tenant shall be directly and exclusively responsible for the following, releasing The Owner from all responsibility: 1. Damages caused to inanimate objects and injuries to persons resulting from installations for services and supplies to the leased property. 2. Damage, deterioration or loss to the property caused either by the Tenant, or by other occupants. 5.- WAIVERS the Tenant hereby waives the rights set forth in articles 31 to 33 of the Urban Lease Act, and therefore the rights of leasing, subrogation, or transfer, whether totally or partially, right of first refusal, redemption and right to challenge the transfer. 6.- TERMINATION CAUSES OF THE CONTRACT In addition to the causes stipulated in this Contract, the following will be considered reasons for termination of the Contract: 1. Failure to pay the rent or any other amounts that the Tenant is responsible for. 2. Failure to pay the security deposit. 3. Deliberate damage to the property or unauthorized alterations when the Owner's 4. consent is required. 5. Conducting annoying, unsanitary, harmful, dangerous, or illegal activities on the property. 6. Subleasing, in the event that it does not occur in accordance with the terms specified in this Contract. 7.- APPLICABLE JURISDICTION AND LEGISLATION The Parties to this contract hereby submit to the jurisdiction and competence of the courts and tribunals corresponding to the location of the property, expressly waiving their right to any other privilege to which they may be entitled. This contract shall be governed by the laws of Spain and, more specifically, by the current Urban Lease Act. In witness whereof, both parties ratify this contract and sign it in two counterparts and for a sole purpose, in the place and on the date ut supra. 8.- NOTIFICATIONS 1. All notifications, demands, requests, and other communications related to this Contract must be made in writing. It will be considered that they have been duly received when delivered in person or sent by certified mail to the addresses specified in the heading of this Contract, or to addresses that either party communicates to the other in writing in the manner specified in this clause. 2.
