IMPORTANT THINGS TO KNOW • This property is riverfront on a whitewater river. All access and use of the river is at your own risk. You must be prepared to closely watch your children (and husbands/boyfriends)! • This property used to have a hot tub. It was removed in early 2018. All references to its presence have been removed form the listing itself, but we cannot delete previous reviews which may have mentioned this. • Like all major rivers, the French Broad river canyon also serves as a transportation artery. This includes the road that this home is located on and a rail line across the river. There are no crossings, so the trains do not blow their whistles or ring bells... you'll occasionally hear the romantic rumble of the trains over the sound of the river. THE RIGHTS AND OBLIGATIONS OF THE PARTIES TO THIS AGREEMENT ARE DEFINED BY LAW AND INCLUDE UNIQUE PROVISIONS PERMITTING THE DISBURSEMENT OF RENT PRIOR TO TENANCY AND EXPEDITED EVICTION OF TENANTS. YOUR SIGNATURE ON THIS AGREEMENT, OR PAYMENT OF MONEY OR TAKING POSSESSION OF THE PROPERTY AFTER RECEIPT OF THE AGREEMENT, IS EVIDENCE OF YOUR ACCEPTANCE OF THE AGREEMENT AND YOUR INTENT TO USE THIS PROPERTY FOR A VACATION RENTAL. The French Broad River Lodge ADDRESS: 1060 Old Marshall Hwy, Asheville, NC 28804 CHECK-IN TIME is AFTER 4 pm AND CHECKOUT is 10 am SMOKING - This is a NON-SMOKING unit. Any evidence of smoking will result in additional penalties and cleaning fees. PETS - Pets are permitted in rental units only with prior approval. A $35 per day, per pet fee applies. All pets must be leashed at all times. Pet owners are responsible for cleaning up any/all pet refuse. Pets are not allowed on furniture at any time. Any evidence of pets on furniture may incur extra cleaning fees. All pets must be up-to-date on rabies vaccinations and all other vaccinations. Heartworm prevention is highly recommended. All pets are to be treated with Advantage or similar topical flea and tick repellent three (3) days prior to arrival. Fleas and ticks are common in this area and can cause harmful/fatal illness to humans and pets. All items above are the sole responsibility of the pet owner. The home owners assume no responsibility for illness or injury that humans or pets may incur while on the premises as a result of pets. PAYMENT – An advance payment equal to 50% of the rental rate is required at the time of reservation. The advance payment will be applied toward the rent. The BALANCE OF RENT is due thirty (30) days before your arrival date. DEPOSITS – Advanced deposits are held at Wells Fargo Bank, 800 Merrimon Avenue Asheville, NC 28804. Any interest accrued is credited to Dwell Placed, LLC. CANCELLATIONS – A sixty day (60) day notice is required for cancellation or changes in length of stay. Cancellations or changes in length of stay that are made more than sixty (60) days prior to the arrival date will incur no penalty. Any cancellations or changes in length of stay made within 60 days of rental will forfeit pre-payments and will remain responsible for full rent for any period of the original rental for which the home is not re-booked. MAXIMUM OCCUPANCY – The maximum occupancy is twenty (20) people. Fixed beds in bedrooms are provided for eighteen (18) guests. A double bed and a double trundle bed are built into the ping pong table for an additional two (2) guests. Linens, towels, and place settings are available for twenty (20) guests. EVENTS – Any event hosted at the property that involves more than the listed maximum occupancy shown above requires the prior approval of the owners and will trigger additional fees. Notice must be provided in advance of the stay to allow for adequate preparation (e.g., pumping septic tanks) to be able to accommodate the group. The maximum event size is for 75 total people at the property. MINIMUM STAY – This property has a variable minimum stay which will range from a three (3) night to a seven (7) night minimum stay. If a rental is taken for less than the minimum stay listed on the booking website at the time of the reservation, the guest will be charged $150 for each night less than the minimum stay. INCLUSIVE FEES – Rates include a one-time linen & towel setup. Amenity fees are included in the rental rate. NO DAILY HOUSEKEEPING SERVICE – While linens and bath towels are provided for indoor use, daily maid service is not included in the rental rate. We do not permit bath towels or linens to be taken from the rental or used in association with outdoor activities. RATE CHANGES – Rates subject to change without notice, but not after an initial payment is received. FALSIFIED RESERVATIONS – Any reservation obtained under false pretense will be subject to forfeiture of advance payment, deposit and/or rental money, and the party will not be permitted to check in. WRITTEN EXCEPTIONS – Any exceptions to the above mentioned policies must be approved in writing in advance. PARKING – Vehicles are to be parked in designated parking areas only. Any illegally parked cars are subject to towing; applicable fines/towing fees are the sole responsibility of the vehicle owner. WATER AND SEWER – This house is on a well and septic system. The septic system is very effective, however, it will clog up or be damaged if improper material is flushed. DO NOT FLUSH anything other than wastes and toilet paper. No feminine products should be flushed at any time. If it is found that unapproved materials have been flushed causing damages or a need for service to unclog the system you will be charged for the expenses. THE RIVER – You are responsible for being aware of the inherent risk and other risks associated with swimming, wading, and participating in any other activities associated with the river. Guests and their invitees assume full risk and responsibility for bodily injury, death or property damage, and expressly agree that the release below is intended to be as broad and inclusive as possible. STORM POLICY– STORM POLICY/ROAD CONDITIONS – Mountain roads can be curvy and steep. Access to this property is entirely on paved roads; however, in extreme weather, roads can be icy and four-wheel drive may be needed. The roads are maintained and plowed by the city, but priority is given to high traffic areas, so patience may be necessary. We do not refund due to road conditions except in the event of mandatory evacuations pursuant to the North Carolina Vacation Rental Act. TRAVEL INSURANCE – We highly recommend all guests purchase travel insurance. RELEASE AND WAIVER FROM LIABILITY – This unit is privately owned; the Homeowners are not responsible for any accidents, injuries or illnesses that occur while on the premises or its facilities. The Homeowners are not responsible for the loss of personal belongings or valuables of the guest. By accepting this reservation, it is agreed that all guests, and their invitees, are expressly assuming the risk of any harm arising from their use of the premises.
