Nature's Riverside is 9 miles from Yosemite's Southern Entrance. This lovely two bedroom, two bathroom end unit has plenty of room to relax and enjoy your stay. It's set on five River front acres and is within walking distance to town. There is a cozy living room with a Smart TV & DVD player & offers a full kitchen. There is also a great private outdoor patio area with private hot tub, fire pit, Propane BBQ (gas provided) and swinging bench to enjoy the beauty of the outdoors. Experience the wonders of Nature's River properties. This home is located in a super lovely 5 unit Adult ONLY complex set on 5 acres and bordering the year round Fresno River. Surrounded by towering trees and open spaces you will love staying here. Wonderful setting to relax after a fabulous trip to Yosemite. We have taken our end unit and completely remodeled it from the ground up. Lovely hickory flooring, pine molding around all windows, hickory kitchen, simply gorgeous through and through. This unit gives you complete privacy, only car you will see or hear is your own, views of the gorgeous towering trees and mere steps away from the beautiful Fresno River. INFANTS/CHILDREN: This home is in an Adult only complex & designed with relaxation, peace & a beautiful stay in mind. If you are wanting to bring your infants/children, we do have homes available to accommodate you so please ask if those accommodations are needed. HOME PRICING INFORMATION: Although the description of this home indicates that it CAN accommodate 4 guests, we choose to offer this home at a reduced rate for couples (2 people sharing one bedroom/bathroom - see paragraph below). We do our pricing in this manner so we can offer the home to smaller groups at a lower price. COUPLES/PARTIES OF TWO: The site automatically gives you a discount when your guest count is 2 or less. The guidelines for the discount is that it is for 2 people, sharing 1 Bedroom and 1 Bathroom, ONLY the Master Bedroom and adjoining Bathroom will be open. All other Bedroom(s)/Bathroom(s) will be locked off. The entire rest of the home is yours to enjoy privately. The locked off bedroom(s)/bathroom(s) will NOT be rented out to anyone else. If your party of two is not a couple and you would like the use of a 2nd Bedroom and Bathroom there is a small $25 per night additional linen fee to compensate for lower rate we offer for couples sharing 1 room. We unfortunately have to lock off the additional rooms as we’ve had occasions where the home was booked for 2 and unpaid for guests were brought in which is unfortunate. If you have ANY questions regarding our pricing please inquire before booking your reservation to avoid any unnecessary misunderstandings. ADDITIONAL GUEST FEE’S: If your guest count exceeds 2 guests, there will be an 'additional guest fee' of $30 per person per night to compensate for the lower rate we have listed for couples, until the maximum occupancy of this home is reached. We price our home in this fashion because we want to be fair to all group sizes, small and large alike. If we only offered a ‘flat rate’ no matter how many guests, smaller groups would pay the same as a larger group and we don’t think that is fair. We feel a smaller group should pay less than a larger group. Most guests appreciate the break for their smaller group. Pets: CATS: None of our homes allow cats, no exceptions. DOGS/Other animals: No animals are allowed in this home. It's intended to be an allergen-free environment and includes animals of all kinds except legally mandated service animals with proof of service papers. If you bring a dog into our pet free home there will be an immediate fee of $250 no exceptions. OUTSIDE FIRES (Not allowed usually between May and October ASK before doing so!!): California has been experiencing a severe drought and the area is extremely dry and the potential for a Wildfire is just too high to risk allowing guests to have an outdoor fire usually between May and October (ASK before lighting one!!). This regulation is determined by our local Fire Department and the banned months could be extended at any time. If you do not find a Fire Pit or Chiminea at the home, the fire ban is in place and they are not allowed PERIOD. When the fire ban is lifted, outside fires are allowed and they MUST be in an approved Fire Pit or Chiminea. If an outdoor fire pit or Chiminea is not provided, DO NOT under any circumstances gather rocks or other materials from around the home and create your own! This does not apply to the Propane BBQ's that are provided for your cooking pleasure. DO NOT use the BBQ for anything other than cooking your meal on, they are NOT intended to be used as a 'Fire Pit' and due to the propane tank attached to them they could explode by doing so. Guest have access to the entire house unless using couples discounted rate, then extra bedroom(s)/bathroom(s) will be locked off. There is a coin operated small laundry room to the left of the parking area (just follow the stepping stones) and is open for guests staying 3 nights or more. Please note other guest may be using them. The Non-Coin operated ones are reserved for Housekeeping. Please observe laundry hours and do not leave laundry the washers or dryers. We are NOT responsible for any lost or missing laundry. This lovely home is walking distance to several restaurants and the YART Bus in Oakhurst which is an excellent way to see Yosemite. By booking, you agree to the following… RENTAL POLICIES for ALL NATURE'S PROPERTIES: Please rest assured that the following rules we ask you to agree on are not due to arbitrary reasons. They are due to either insurance rules and qualifications, county regulations or from past experience. Occupancy: The maximum occupancy of the Property is strictly limited to the amount of guests on your inquiry. No additional guests are allowed on the premises. If the house sleeps 10 and your party is for two you most likely paid our “couples discounted rate” which means only 2 guests are allowed in the home. The county also sets limits on how many occupants can be in the home. If our maximum occupancy is 4 on the site, then that is the maximum guest count allowed. Additional guests: If you do have friends who decide to join you then they must first be approved by Landlord and the additional charge per person must be paid before their arrival. Once the rental period begins, additional people are not allowed on premises without prior approval, and is the sole responsibility of our client to honor this.. As noted, people other than those in the registered guest party may not stay overnight in the property unless previously agreed upon with the Landlord. Guests can not and shall not sublet the property, invite others outside of their party to join them etc. Infants/Children: We classify an infant as anyone under the age of 12 months old. We have several homes that are adult only. These homes are either to small for children or on a river and are unsafe for children. These homes are: Nature's Serenity, Nature’s River Rest, Nature’s Getaway, Nature’s Riverside and Nature's Niche. Family Friendly homes: Nature's River Walk, Nature’s Bungalow, Nature's Chalet, Nature's Cottage, Natures Lakefront Oasis, Nature's Lakefront Estate, Nature's Paradise, and Nature’s Lake View Lodge. Guest acknowledges that the properties are semi child-proofed and all efforts are made to provide a safe and hazard free home. However, it is the guest’s responsibility to monitor the activities of all minor children in their care or otherwise allowed into the home or onto the property and premises. None of our homes have fences, many have stairs, some have gas stoves so it is your responsibility to ensure your child's safety. Pets: None of our homes allow for cats. We have several Dog friendly homes. They are: (all other homes have a strict No Pet Policy) ONE dog limit: Lake View Lodge, unless under 5 pounds, then two are ok. TWO dog limit: Nature's Niche, Nature’s Paradise, We do require size and breed of dog before approval. We also have a pet fee of $25 per night per pet. If you bring a dog into a pet free home there will be an immediate fee of $250 no exceptions. Our Pet Policy is: Pups are not allowed on the bed or furniture; not allowed in shower; owner picks up backyard when leaving; and pup is not allowed to be left unattended in the home unless crated. In rainy/snowy weather we ask that you wipe their feet before they enter the home. All other homes are Pet Free: These homes are intended to be an allergen-free environment and includes animals of all kinds except legally mandated service animals with proof of service papers. Check In time, Length of stay: 5pm check in: Nature's Oasis, Nature's Cottage, Nature's Lakeview Lodge, Nature's Estate and Nature's Paradise. The rental period will begin at 5pm on the check in date for these homes. 4pm check in: All other homes under the Nature's Properties umbrella. The rental period will begin at 4 pm on the check-in date. Early arrivals: All early arrival requests must be approved in advance. Requests must be received at least one day prior to your arrival for scheduling purposes. You can confirm your arrival time or arrange for an earlier check-in time by sending a text message or by messaging us via the site. Approval of an early check-in is entirely dependent upon whether or not the home was occupied the night before your arrival and our Housekeeping schedule. Check-out time: All Nature's properties rental period ends at either 10 or 11am on the check-out date. **PLEASE NOTE: During our Peak Season (May-Sept) and on Holiday weekends when we are at capacity, our housekeeping staff can and often times will show up at 11am to clean the home for the next guest**. Guest who stay past 11 am will pay for the housekeepers time while she waits for you. Check-out Guidelines: 1. Guests shall vacate the premises no later than 10 or 11am on the date stated in this agreement. Exceptions or extensions must be approved in advance, preferably no later than the night before your check-out date. Send a text or message us via the site to see if a later check-out time is possible. Approval of a late check-out is dependent upon the home being occupied the day of your departure. 2. Guest agrees to comply with check-out guidelines posted in guest book located in the house. 3. Check-out Procedures - Individual rentals may have variations, but overall: **Do not strip beds. Simply make it clear which were used, if applicable. **Place all damp or wet towels either in bathtub, laundry basket or on the washer. **Do your dishes or place in the dishwasher and start the cycle before leaving. **Leave the home as you found it, return furniture where it was if you moved it and place it in its original state etc. **Turn off Air Conditioning/heating before leaving. **Ensure all windows & all entry doors are closed and locked before leaving. **Turn off all lights and appliances. **Return the key to the lockbox. 4. A text message letting us know you have left would also be appreciated. Minimum Stay: Each property's minimum stay is indicated in its listing. Longer minimum stays may be required during holiday periods. Fees, Payments, Rental Rates, Check-out, Refunds, Cancellation, Contract Violation: Cleaning Fee: Guests are charged a one time cleaning fee for the total visit. Reservation Deposit: To secure your reservation, the deposit must be paid in advance. The County requires collection and payment of an 11% (eleven percent) tax on all transient occupancies.13% in Mariposa County. Payments: All payments are processed online with credit card unless other arrangements have been made. All funds must be received 7 days prior to your reservation date. Please note, all funds are held by the site you booked on. We do not receive payment until your enter our home. All refunds and security deposits are returned through the site. Other Fees and Fines: 1. Guest shall pay for any damage done to the premises over and above normal wear and tear. 2. Guest shall pay for any excessive cleaning due to abnormal use. 3. Guests shall pay for maintenance and repairs should the premises be left in a lesser condition. 4. Guest agrees Landlord shall deduct above fees and fines from the security deposit prior to refund and may charge guest’s credit card for costs above that amount. Cancellations and Refunds: Guests MUST initiate any cancellation request. We are not allowed to cancel a reservation without being penalized. If you need assistance doing so, you will need to call the site and they will help you with the cancellation. Travelers Insurance: We highly suggest that you purchase Travelers Insurance to protect yourself from any of the unforeseen emergency situations mentioned below that do not warrant full refunds on our part. . A partial refund may apply if home is able to be re-rented. 1. There shall be no refunds due to shortened stays or ruined expectations because of weather conditions, guest’s work obligations, or other commitments. There are no refunds for low water levels in Lake, slip out of water as we cannot control these items. 2. We occasionally experience power and wifi outages and other shortages beyond our control. We report outages as each occurs. No refunds or compensation will be given for any outages. 3. All Refunds are subject to transaction fees from credit card or other financial agencies, and we are not responsible for covering these transaction costs. Airbnb Cancellation Policy: Set by airbnb If guest wishes to cancel, the rental rates will be refunded as follows: 100% refund for cancellations within 48 hours of booking IF the check-in date is at least 14 days away. All homes have a specific cancellation policy located on listing of home. If we are able to re-rent any nights during your stay we will refund you what we were able to rent the home for per night up to your nightly fee. Violations: Should guests violate any of the terms of the rental agreement, the rental period shall be terminated immediately. No payments will be refunded. Guests waive all rights to due process if they fail to vacate the premises upon termination of the rental period. Provisions and Accommodations: 1. Property manager or Landlord is available for any questions or concerns you may have during the hours of 8am - 9pm unless there is an emergency. Please CALL, not text, for any after hour emergencies. Phone # provided once reservation is confirmed. 2. Property comes complete with most everything you need. Landlord provides reusable towels, pillows, blankets, sheets, basic kitchen utensils, plates, cooking wear and other common items. If there is any specialty item you need during your stay please make sure to bring it. 3. One-time use goods such as toilet paper, hand soap, dish detergent, laundry soap, body wash, conditioner and shampoos are also provided. 4. There is no daily housekeeping service. Linens and bath towels are included, but daily maid service and fresh linens are not provided in the rental rate. Please do not take bath towels or linens outside the home. 5. Spices, Coffee, Tea and other basic pantry items are NOT supplied. Some guests choose to leave items they have purchased behind for the next guests use, so please bring whatever you need with you to the home. Rules, regulations, limitations: NO SMOKING: All homes are Smoke Free. This includes the use of any other tobacco products (cigars, chew, etc.) or smoking products or devices (vaping etc) . No exceptions!! Violation will cause a $200 credit card charge. Smoking, however, is permitted outside the home as long as the item is extinguished in a sealable water bottle or other appropriate container with enough water to completely extinguish it. Outdoor Fires: Outdoor fires can only be made in approved outdoor Fire Pits or Chimeneas. If you do not see one at the property that means the Fire Ban is in place and no outdoor fires are allowed. DO NOT build your own with items located around the property. Not even the smallest “campfire.” The surrounding area is very dry and fire danger is at an all-time high. A fire ban is usually in place during the months of June through late October or until we get our first heavy rain. Again, if the Firepits and/or Chimeneas have been removed you can NOT have a fire outside. Please also do NOT use the BBQ as a fire pit. There is a propane tank attached to it and doing so could cause an explosion. Parking: Parking is limited to guest vehicles. Vehicles are to be parked in designated parking areas only. Parking on the road is not permitted. Any illegally parked cars are subject to towing; applicable fines/towing fees are the sole responsibility of the vehicle owner. Trash: Guest are cautioned not to leave trash outside because it attracts wild animals. Please deposit all trash in trash bins provided (located in the garage if applicable). All trash placed in the outside trash cans MUST be in a plastic trash bag. Do not throw any ‘loose’ garbage in them. Firearms: Guns and all firearms are expressly not permitted at or in the property. Fireworks: Fireworks and other hazardous materials shall not be used in or around the property. ALL fireworks, including ‘Safe and Sane’ are banned in the area. Parties: Parties are NOT ALLOWED! Violation of this section will trigger a $250 credit card charge. WiFi: Guests are provided with Internet access through password-restricted WiFi. 1. Do not provide password to non-guests. 2. Do not download illegal content. 3. Do not use Bit Torrent clients or any peer-to-peer networking tools. These programs will instantly upload and become active once wifi code is entered on your device. Please delete program before entering password or DO NOT USE this device. Bit Torrent is primarily used for illegally downloaded programs and will create an instant piracy violation = 100% loss of your security deposit. 4. Guests are responsible for violations of copyright of other access/downloading of off-limits material on the Internet. Abide by all Laws: 1. Guest shall use the premises only in a careful and lawful manner. 2. Guest shall use the property for legal purposes only. Other use, such as but not limited to, illegal drug use, abuse of any person, harboring fugitives, etc. shall cause termination of this agreement with no refund of rents or deposits. Guest Responsibilities: 1. Good Neighbors - Guests shall be good neighbors and behave in a civilized manner and shall be respectful of the rights of the surrounding property. 2. Guests shall not create noise or disturbances likely to disturb or annoy the surrounding neighbors. Creating a disturbance of the above nature shall be grounds for immediate termination of this agreement and guests shall then immediately vacate the premises. 3. Quiet hour starts at 10pm to 8am. 4. Please be courteous when using the Hot Tub (if applicable) during quiet hours. 5. Guest will not cause or allow any undue noise, upon registration of a call or complaint of same to the police department, agent or Landlord will automatically have the right to give the guest notice to vacate without legal action. 6. Security - Guest must close and lock all doors when away from the property, no exceptions 7. Cleanliness - Guest shall maintain the premises in a good, clean, and ready to rent condition except for average use of premises. Keep the property and all furnishings in good order. Only use appliances for their intended uses. 8. Do not cook fish or otherwise very spicy or pungent food indoors — nothing that the next tenant would notice! An outdoor gas grill is provided. Guest is responsible for any pots and pans damaged during their use. If you notice a damaged pan, please leave it out on the counter so we can replace it. 9. Power Conservation - Utilities are included in the rental price. However, guest agrees that Air Conditioning shall not be set below 75 degrees, heat shall not be set above 78 and the fan setting shall be “Auto”. Please always recover hot tub when not in use. 10. Doors and windows shall be closed when either the heat or air conditioning is in operation. Temperature will be further regulated when guest leaves property for the day. Do not leave the house cooled to 75, 85 is cool enough to be made comfortable again as soon as you return. We strive to provide very fair pricing on all homes, high, unnecessary utility bills cause us to have to raise our rates, which we would hate to do. 11. Septic - The property is on an effective septic system — however, it will clog if improper material is flushed. DO NOT FLUSH anything other than toilet paper. This specifically means no sanitary napkins, tampons, other feminine products or baby wipes, etc. If it is found that such products have been flushed and clog the plumbing, you could be charged all fees incurred to repair. Landlord Access and Inspections: 1. The Landlord or management and its agents have the right to enter and inspect the premises without prior notice at any time to enforce the terms of this agreement. This includes entering to turn off air conditioning or heating if left on high while guest is away. 2. Guest shall also allow Landlord access to the property for purposes of repair. Landlord shall exercise this right of access in a reasonable manner and with prior communication to the guest. 3. Hot Tub (if applicable, Not ALL homes have a hot tub) is maintained between each guest(s) stay and will be treated every 2 - 3 days on extended stays or upon guests requests, typically in the morning. If you notice the hot tub needs servicing during your stay, please let us know asap. Advisories and indemnification: Hot Tub (If one is at your rental): *Use at your own risk*. Landlord is not responsible for injury or loss of life associated with its use. It is the guest’s responsibility to learn about safety precautions, warning signs of water conditions and safety procedures concerning the use of the hot tub. The Hot tub is sanitized, refilled and chemicals replenished prior to your arrival, therefore, it may not be warm until later that evening. If you plan to use the night of arrival, increase the temperature to no more than 102° as soon as possible. 1. Guest agrees to have a responsible adult supervising minors while they use the hot tub. No children under the age of 12 permitted in the hot tubs at any time unless accompanied by a parent who assumes all liability and risks incurred. 2. Guest is hereby notified that hot tubs can be dangerous and guest accepts fully the risks involved. 3. Guest is further responsible to adhere to the rules posted next to the hot tub. 4. When using the hot tub, remember there is a certain health risk associated with this facility. 5. Do not stand on the hot tub covers. Hot tub covers are for insulation purposes and are not designed to support a person or persons. They will break and you may be charged for replacement. 6. When not using the hot tub, the cover must be put back on so the hot tub will stay warm. Grills: Guest are advised that the property contains a propane gas grill, and will seek help from management if the proper operation of such items is not fully understood. Accidents from use of the gas grill are the responsibility of the guest, not the Landlord. Many grilles self igniters do not work. Please use lighter sticks provided. Turn gas on and light immediately. Do not let gas just run. When done, please close off propane tank. Fire extinguisher: The property has a fire extinguisher installed in or near the kitchen area. These fire extinguishers were fully charged at the last inspection. It is the duty of the guest to inform management immediately should the fire extinguisher become less than fully charged. Guest agrees to use the fire extinguishers only for true emergencies. Fire alarm: The property has fire alarms installed and they are believed to function properly at the time of rental. Tenant will notify management without delay if a fire alarm “chirps” or has a low battery condition. Carbon Monoxide Detector: The property has a carbon monoxide detector installed on the property it is believed to function properly at the time of rental. Tenant will notify management without delay if the alarm “chirps” or has a low battery condition. Security: Guest shall see to their own security while in the property by locking doors, windows, etc. when it’s prudent to do so. The Landlord is not responsible for the loss of personal belongings or valuables of the guest. Valuable items left behind by guests will be held for the guest and every reasonable effort will be made to contact the guest for return. If items are not claimed for longer than 1 month they shall become the property of the Landlord. The Landlord shall not be held liable for condition of said items. Cable/Satellite: Cable & Satellite TV may or may not be provided in the home. The service level has been chosen by the Landlord. No refund of rents shall be given for outages, content, lack of content, or personal preferences with regard to the Cable/Satellite service if provided. Internet: Wireless internet is provided as a convenience only and is not integral to the agreement. No refund of rents shall be given for outages, content, lack of content, speed, access problems, lack of knowledge of use, or personal preferences with regard to internet service. Storms: No refunds will be given in the event of a rainstorm, snow or any other act of nature. Mountain roads can be curvy and steep and there is limited snow removal in the neighborhood. However, the main roads are well maintained. We highly recommend four wheel drive and/or chains during the snow months. We do not refund due to road conditions. Release of Responsibility and Liability, Legal Rights: The Property is privately owned. The Landlord is not responsible for any accidents, injuries or illness that occurs while on the premises or its facilities. 1. By accepting your reservation, it is agreed that all guests are expressly assuming the risk of any harm arising from their use of the premises or others whom they invite to use the premises. 2. Guest releases Landlord of all responsibility for any negligence/accidents that could be possibly incurred during guest’s stay, including guest’s friends, family, or other people allowed into the home or on the premises. 3. Guest agrees to not file any claim, action or lawsuit against Landlord, its representatives or agents, for costs or damages arising from guest use of the property. 4. Guest hereby acknowledges using the property for the purpose of short-term rental in “as is” condition, at guest’s own risk. 5. All guests, guest’s friends, family, or other people allowed into the home or on the premises, shall hereby indemnify and hold harmless the Landlord against any and all claims of personal injury or property damage or loss arising from the use of the premises regardless of the nature of the accident, injury or loss. 6. Guest agrees to indemnify and save harmless the Property, its Landlord, managers, representatives. Employees, and neighbors from any and all liability, negligence on the part of either party, loss, damage, injury or death resulting from the use of the property, its fixtures, or contents. 7. Guest agrees to be held liable for all actions of guest, guest’s friends, family, or other people allowed into the home or on the premises, whether they be registered or unregistered occupants, at all times, and by doing so hold harmless Landlord, its managers, representatives or employees, from any and all claims arising from their guest’s use of the property. 8. Guests expressly recognize that any insurance for property damage or loss which the Landlord may maintain on the property does not cover the personal property of Guests, and that Guests should purchase their own insurance for Guests and Guests if such coverage is desired. 9. In case suit shall be brought by Landlord for failure to vacate said premises, or for the recovery of the provisions of this agreement, or for any obligation of Guest arising under this agreement, the Landlord shall be entitled to recover all of the costs in connection therewith, including but not limited to reasonable attorney fees, whether or not the action proceeds to judgment. 10. Guest agrees that legal conflicts will be handled by binding arbitration, and will be carried out in Madera County, California.
