This Privately Owned, cared for and managed Air Conditioned and Heated home is located in a quiet coastal residential area just a short stroll down the street to world famous WindanSea Beach. Our private home has 2 bedrooms and 2 full baths, and an additional livingroom pull out sleeper sofa for 5-6 staying guests. Along with a large outdoor furnished patio there is private off street driveway parking for ONE vehicle which is rare in the La Jolla beach area. Our home is located just 2 blocks from WindanSea Beach is a Private, gated air conditioned home that was remodeled and is a two bedroom two bath Cottage home located just a short walk down the street to world famous WindanSea Beach. Located in an ultra quiet coastal residential area and features updatd interiors throughout including; furniture, kitchen appliances and cabinets, bedding, linens and bathrooms and outdoor patio furniture. Highlights of our home include: 65" flat screen SMART TV wall mounted in the living room, and a 47" flat screen SMART TV wall mounted in the master bedroom both complete with cable. Premium Spectrum cable channels including Netflix, HBO, Cinemax, Showtime, Starz, TMC, TCM, and Blue-ray DVD player in the living room. Each Bedroom has Ductless wall mount Air Conditioning\Heating, a new California King size Stearn's and Forster 16 inch thick pillow top ultra comfort mattress in the Master bedroom and a Queen Size in the loft bedroom with down pillows for a 5 star hotel sleeping experience.! Private and fully furnished patio perfect for enjoying the beautiful La Jolla weather complete with outdoor furniture, dining table\Fire Chat table, and gas BBQ. (Guest pays for propane refills) Air Conditioning \ Heating throughout with ductless HVAC A fully equipped kitchen with brand new appliances perfect for preparing your meals. Deposit forfeitures and/or evictions are strictly enforced. - Our entire property boundary (Inside and out) is NON SMOKING - Our property is a NO Pet home. NO Comfort\Emotion pets permitted NO VISITOR PETS, EMOTION, COMFORT OR SERVICE ANIMAL PERMITTED. - Outdoor areas CLOSE at 9:30 PM. Just down the street are Restaurants, coffee bagel shop, local pubs, and nightlife just down the street! House Rules Terms and Conditions - Our Guest's health safety is of paramount concern. As Owner Operator of this home, we have implemented enhanced cleaning procedures that may include during the preparation of your stay to include the use of Disinfectants soaps, Lysol and Bleach where may needed. All High-touch surfaces cleaned and disinfected after each stay. Examples of high-touch surfaces include all tables, hard-backed chairs, doorknobs, handrails, light switches, remotes, bedroom wardrobe and cabinet handles, toilets, sinks, bedside tables, and all kitchen and bathroom surfaces. We've implemented a two-step approach in the cleaning of high-touch surfaces using disinfectant soap with hot water for visibly dirty surfaces then followed by disinfectants such Lysol, or Bleach based on the surface to kill germs on surfaces. ( CHECK UNDER YOUR VEHICLE\RENTAL FOR DRIPPING FLUIDS) • NO VEHICLE MAINTANANCE PERMITTED IN OUR DRIVEWAY. • Our property is suited for guests seeking a QUIET atmosphere location as it is nestled among our friendly owner occupied neighbor’s homes. Please be sure to consider this before renting with us. • We have a Zero Tolerance 1-strike rule regarding Unauthorized undeclared number of Guests, Smoking, Parties, Gatherings, Events, Excessive Alcohol Drinking, Noise Disturbances, Vulgar language heard from the public sidewalk, Over Occupancy, under stating total number of Guests sleeping at our property, or any animal being on our property at any time. Evictions and deposit forfeitures are strictly enforced. • Our property boundary (where sidewalk meets driveway) is a SMOKE FREE ENVIRONMENT. Guest is not permitted to Smoke, Vape or chew Tobacco or any other form of material on or Property Boundary (Driveway, Patios, or inside home). Guest is NOT permitted to Smoke, Vape, or transport or Store any Smoking, Vape or chewing Tobacco or any other form of tobacco or marijuana material, or vaping material on or inside our property. Any evidence of this having occurred will result in Guest being in Violation of rental agreement and shall result in: a. Eviction - Guest being ordered to vacate property immediately. b. Loss of all remaining reservation nights with no refund given, forfeiture of Security Deposit. c. Additional service charges Guest Credit Card on file to professionally purge odors from all porous materials and or cost of replacement of furnishings that cannot be made 100% smoke odor free. Owner/ Owner's Agent may enter premises immediately at any time in the event of an emergency, or if OWNER has reasonable belief GUEST has smoked or storing smoking material on premises. • Our property is SOLELY for the exclusive use of the GUEST ONLY (Person making reservation must be staying at the property each night. • Max Occupancy (6) to include all Paying Guest's and Visitor's. Evidence of an animal having been on our property SHALL result in Guest being in violation of rental agreement and shall forfeit Security deposit and Guest shall be subject to immediate eviction, forfeiting all remaining reservation nights with no refund being given. •NO GUEST VISITOR’s Service Animal PERMITTED AT ANY TIME: Guest is NOT permitted to allow a Guest Visitor to bring any pet or Service Animal onto our property. If determined Visitor pet or Service Animal has been on property boundary, Guest shall be in violation of Rental agreement and Guest SHALL forfeit security deposit and shall be ordered to remove Visitor pet\Service Animal immediately or face immediate eviction. Any damage sustained to our property caused by pet shall be charged t Guest credit card on file with Airbnb. Any further violations SHALL result in Guest being ordered to vacate premises immediately and forfeit all remaining reservation nights with no refund given, and forfeit of security deposit. ** GUEST IS FININCIALLY RESPONSIBLE FOR ALL BROKEN OR DAMAGED ITEMS ON PREMISES AND MUST AGREE TO REIMBURSE OWNER FOR ANY DAMAGE, BREAKAGE, LOSS OR MISSING ITEMS DURING RESERVATION STAY. ** IF YOU BREAK OR DAMAGE ANYTHING YOU ARE FINANCIALLY RESPONSIBLE FOR REPLACEMENT OR REPAIR. - GUEST IS REQUIRED TO REPORT ANY DAMAGE TO OWNER IMMEDIATELY AFTER DAMAGE OCCURS AND PRIOR TO DEPARTURE. • INDOOR FIREPLACE - Indoor Fireplace is NOT permitted to be used and has been rendered INOPERABLE and closed off and Placarded as such and also stated in our listing there is NO Fireplace offered indoors. ( Use outside patio Fire Chat table. • TRASH RECEPTACLES: - Our trash receptacles located in the driveway is for household (FOOD related items only) No shopping boxs, UPS type shipping boxes permitted to be placed in our trash receptacles. - DISPOSE YOUR NON-FOOD SHOPPING PACKAGING AND BOXES ELSEWHERE. DO NOT PLACE THEM IN OUR RECEPTACLES. ZERO TOLERANCE. - Guest is REQUIRED to break down ALL boxes and FLATTEN them prior to placing in the BLUE Recycle Receptacle. ZERO TOLERANCE for failure to comply with this and Guest SHALL be charged a $50.00 Fee for miss use of our Trash receptacles. In the event city trash\recycle collection of guest's trash is REFUSED due to any reason, Guest Security deposit SHALL be charged a $75.00 Re-collection fee for city to return. • Minimum age to rent is 28. • * Cleaning fee - If only 2 guests using 1 bedroom and 1 bathroom please ask about our reduced cleaning fee. *(Subject to condition of home left by traveler at departure. Aadditional cleaning charges based on condition of property left by Guest) Excess food, Sand in property, linens, bedding, and food waste left on outdoor patio, Stained patio furniture, stained interior furniture, beach sand in house) Cancellation policy: Due to a short summer season and other holiday’s and guests booking months in advance and arriving from different parts of the world, arranging bookings and their flight travel takes months of planning to some traveling guests, (families, jobs, school schedules, flight changes) and therefore, being notified by a guest of their cancelling of just 7 or 14 days’ notice is not enough to ensure we can re-book the rental for that time period. Therefore, High Peak season: Beginning 3rd Saturday June through last Monday in May Reservations cancelled 60 days or greater than the scheduled rental arrival data will receive a 100 percent refund minus $300 Service fee. If the cancellation is less than 60 days, a refund will be made only if we can re-book the property for those dates. If the unit is re-rented at the same rate, 100 percent of the rent will be refunded minus $300 service fee. If the unit is rented at a discount, the difference will be deducted from the refund. All other dates accept holidays: Reservations cancelled 60 days or greater than the scheduled rental arrival will receive a 100 percent refund minus $300 service fee. If the cancellation is less than 60 days, a refund will be made only if we can re-rent the property. If the unit is re-rented at the same rate, 100% percent of the rent will be refunded minus $300 Service fee. If the unit is rented at a discount, the difference will be deducted from the refund and there will be a $300 Service fee. TRASH NOTICE: GUEST is required to remove ALL trash, food waste, paper bags, newspapers, wrappings, food containers and ANYTHING else you the Guest brought into our property from our property when departing and place in appropriate trash receptacle in driveway. Guest is NOT permitted to use our trash receptacles to discard personal shopping trash in our receptacles (Boxes, etc.) As it fills up the containers and prevents our next Guest from having any space for their house trash. Guest is REQUIRED to Take non-food shopping trash items somewhere else any non-food trash items found causing over-flowing of trash receptacles shall result in a $75.00 charge to Guest for Trash removal fee. •Additional cleaning charges apply to guests who leave property in excessively dirty or neglected condition. • LINENS:PROVIDED AND INVENTORIED For each registered staying guest: Bath linens 2 bath towels 2 Hand towels 2 face clothes. For each bed 1 bottom bedsheet 1 top bedsheet 4 pillows with pillow cases 1 down comforter with duvet cover I, airbnb guest (Name on reservation) agree to accept the rental premises upon arrival. Owner/ Owner's Agent may enter premises immediately in the event of an emergency or to perform necessary repairs and/or maintenance or if Owner has reasonable belief that GUEST IS\HAS Smoked on premises (Inside or outside patios) or has transported Smoking material onto premises (Inside or outside patios). Owner/Owners agent may enter the premises with 24 hours’ notice for normal maintenance. 7. Occupancy (including children, infants and visitors) is not to exceed the published maximum occupancy (6) as stated on the Vacation Rentals website If more than the maximum number is found to be occupying the leased Premises, I (WE) agree that a charge of $200.00 per person per each day will be made to MY (OUR) credit card or deducted from MY (OUR) damage deposit. Additionally, this Agreement may be immediately terminated without refund at the discretion of OWNER if the maximum occupancy is exceeded and GUEST shall forfeit all remaining reservation nights and pay a lease violation penalty fee of $750.00 or equal to security deposit. 8. NO SMOKING on the Premises– For the purpose of this contract, Premises is defined as “Where the public sidewalk ends and the driveway begins”. (This means inside the home and outside on the patios or driveway Premises.) It is further understood by GUEST that no smoking\vaping product material is permitted to be transported or stored anywhere on the Premises. (GUEST is to store smoking\vaping material in their vehicle) 9. I (WE) shall be responsible for all damage or breakage and/or loss to the premises that I(WE) cause, except normal wear and tear and unavoidable casualties which may result from Occupancy. I (WE) acknowledge any loss and/or damage to the Unit that I (WE) cause will result in a charge to MY (OUR) credit card. 10. OWNER will make reasonable efforts to repair in a timely manner any damages or notable conditions reported by the GUEST that affect GUEST’s use and enjoyment of the Premises. 11. The Premises will be left in the same good and habitable condition. Any damages or notable conditions found upon arrival will be reported to OWNER within EIGHT (8) hours of Occupancy. OWNER shall provide utilities, furniture and fixtures, linens and towels and other basic amenities contained in the description listed on the website as of the date of this agreement. 11a. UTILITIES USAGE: Guest shall be provided Electricity, Natural Gas and Water free of charge up to $65.00 per every 7 night rental period. Any overage shall be charged to guest credit card on file or deducted from Guest Security Deposit. ( GUEST IS REQUIRED TO TURN OFF ALL UTILITIES WHEN LEAVING THE PROPERTY OTHER THAN (1) LIGHT MAY BE LEFT ON WHEN GOING OUT) 12. Prior to vacating Unit, GUEST is responsible to remove all trash and recyclables, ensure all dishes and cookware are clean, and return any furniture that was moved to its original position. 13. OWNER shall not be liable to GUEST, or invitees or any other person for any injury, loss, or damage to any person or Premises on or about the premises. GUEST shall hold OWNER harmless and indemnify and defend OWNER from and against all loss or damage occasioned by the use or misuse or abuse of any part of the premises and from or against any omission, neglect, or default of GUEST, or GUEST’s invitees. 14. This Agreement may not be assigned or the Premises sublet, and is for GUEST's use only. 15. NO PARTIES, CELEBRATIONS, EVENTS, GATHERINGS AT ANY TIME – this contract defines a party, celebration, event, gathering as any combination of the following; ANY loud noise and/or excessive drinking that is disruptive to neighboring houses and/or guests Outnumbering the maximum amount permitted (6) . I (WE) agree that a party, as defined in this agreement, will result in a $750.00 charge to MY (OUR) credit card or deducted from security deposit and an immediate eviction from the Premises with no refund given under any circumstance. Any exceptions to the No Party Clause must be approved by OWNER in writing prior to the arrival date. 16. GUEST VISITORS: NO OVERNIGHT GUEST VISITORS. I (WE) understand and agree, in the event I(WE) allow Visitors to stay overnight ( past 11:00 PM ), we are in violation of this rental agreement and Guest Security Deposit shall be charged $200.00 per night per person and GUEST may be subject to Immediate eviction forfeiting all remaining reservation nights with no refund given and forfeiture of Security Deposit. (Please contact owner to pay additional guest overnight fee) Property is monitored with exterior driveway entrance video camera 16. NO PET\DOG \ VISITOR SERVICE ANIMAL CLAUSE: Animals, birds, reptiles, or any kind of pet are NOT permitted on our property boundary at any time. Guest Visitors are NOT permitted to bring any animal or Service Animal onto the property at any time as they (Visitor) are NOT protected under ADA Title 3 Service Animal clause. In the event GUEST Visitor brings an animal onto our premises for any length of time, GUEST SHALL BE IN VIOLATION OF THIS RENTAL AGREEMENT and GUEST SHALL br subject to immediate eviction, loss of all reservation nights with no refund given and forfeiture of security deposit. ZERO TOLERANCE. 17. Rental Rate: The undersigned acknowledge that OWNER rental rates are established in the sole discretion of OWNER and determined using various criteria, including but not limited to comparable vacation rental rates in the area of the subject Premises, square footage, year built/remodeled, condition of the Premises, proximity to the beach and/or local attractions, and available amenities. The undersigned further acknowledge and agree that there shall be no adjustments to the rental rate or partial refunds due to any perception of the undersigned that the rental value is not commensurate with the rental rate established by OWNER. 18. I (WE) acknowledge that OWNER reserves the right to offer discounted rates on Premises based on ever changing market conditions and availability. If the rental rate of the Premises that I (WE) have chosen to reserve is discounted after I (WE) confirm our reservation, I (WE) will not be entitled to any type of discount of the original rental rate agreed on as per page one of this contract. 19. I (WE) acknowledge that it is MY (OUR) responsibility to thoroughly read the list of amenities and Premises description provided by OWNER for the Premises I (WE) have chosen to rent. I (WE) acknowledge that OWNER has posted a detailed Premises description and complete list of amenities on the listing website. I(WE) acknowledge that any assumptions made on MY (OUR) part and/or failure to read the Premises description and/or list of amenities will not result in a refund or discount under any circumstances. 20. I (WE) acknowledge that OWNER has provided a complete address to the home I (WE) have chosen to rent on page 1 of this rental contract. I (WE) acknowledge that with this information, I (WE) can research the local area for any and all factors that may be relevant during MY (OUR) stay. Any and all instances related to occupying a home in a suburban area will not result in a refund under any circumstances. Examples of this include (but are not limited to): local traffic conditions, neighborhood construction, city/utility maintenance, and proximity to surrounding homes and businesses. 21. Guest shall not be entitled to cancel the reservation with less than 60 days notice unless the Premises becomes unavailable because of Premises sale, fire, mandatory evacuation, eminent domain, construction delays, lack of utilities, or act of nature. Upon cancelation by Guest 60 days or more from reservation date, Owner\Manager will refund all funds received to date from Lessee within three (7) business days of notice of cancellation. 22. Internet Usage. Owner provides Internet acces as a free ammenity and does NOT guarantee service reliability due to weather, outage event. I(WE) hereby understand and agree that OWNER makes Internet access available for GUEST’S legal usage only. I(WE) further understand and agree by OUR using OWNER’S internet service to engage in any form of copyright infringement is ILLEGAL and is expressly prohibited by Time Warner Cable corporation’s Acceptable Use Policy and I(WE) will not engage in any of the above. Furthermore, I(WE) understand and agree that I(WE) will not use OWNER’S Internet service to download, upload, store, view or file share any copyright infringement material. Furthermore I(WE) understand and agree that Child Pornography is a form of child sexual exploitation. U.S. Federal law defines child pornography as any visual depiction of sexually explicit conduct involving a minor (persons less than 18 years old). Images of child pornography are also referred to as child sexual abuse images. Federal law prohibits the production, distribution, importation, reception, or possession of any image of child pornography. I(WE) have been made aware a violation of federal child pornography laws is a serious crime, and convicted offenders face Federal Prison sentences, fines, and severe statutory penalties. Therefore, I(WE) further understand and agree the Viewing of, or Downloading, Uploading, storing, trading, Posting, or Sharing any form of CHILD PORNAGRAPHY content is ILLEGAL and I(WE) shall not engage in any of the above. I(WE) have been informed and that ANY copyright infringement, or violations of any of the above during our reservation period ( GUEST Check in date and time GUEST Check out date and time) WILL result in I(WE) being in VIOLATION of Rental Agreement and I(WE) agree to pay a penalty fee in the amount of $750.00 which shall be deducted from OUR Security Deposit. I(WE) hereby agree to reimburse OWNER for any fine, fees levied by Internet carrier related to OUR IILLEGAL copyright infringement activity. Furthermore, I(WE) agree and are aware OWNER shall cooperate and provide relevant identifying information about I(WE) and OUR allegedly infringing conduct to requesting third parties, including the copyright owner, its representatives or their agents, and any law enforcement agencies. I(WE) hereby further understand financial penalties levied by Internet carrier and or Copyright owner can and are as high as $3,000 USD per instance(Movie, photo, file) of illegal copyright download, upload, traded or shared material. I(WE) have been made aware and understand OWNER will comply with any and all agencies requests while investigating any of the Illegal activity above. I(WE) hereby accept full and sole responsibility of any of the above should it occur during our reservation check in date\time and reservation check out date\time. I(WE) hereby hold OWNER harmless and Indemnify OWNER against any and all claims arising out of OUR Internet usage activity. Including without limitation, Expenses, Judgments, Fines, settlements, and any other amounts actually and reasonably incurred in connection with any liability, suit, action, loss or damage arising or resulting from OUR participation in Internet Usage. 23 - Late Check-Out \ Check-out Requests Check-out time is by 10:00 AM. Late Check-Out Requests beyond 15 mins of Check-Out time (10:00 AM) are subject to a $75.00 per each 15 mins beyond Check-Out time rounded to the next 30 mins. Failure to vacate premises by 1:00 PM shall be considered holding over and Guest shall be charged a holding over charge of 1.5 times the nightly rate for each night and SHALL subject to evition. Driveway entrance is monitored by video Security Camera PLEASE ENSURE YOU HAVE READ, AND AGREETO COMPLY WITH THESE TERMS BEFORE BOOKING YOUR RESERVATION.
