Important Notice: Punta Mita HOA Noise Regulations To ensure a peaceful and enjoyable environment for all residents and guests, the Punta Mita Homeowners Association has recently implemented updated noise-control rules that all visitors must follow. Please note the following requirements during your stay: • Outdoor noise must be kept to a minimum at all times, including music, gatherings, and amplified sound. • Quiet hours are strictly enforced from 10:00 PM to 8:00 AM. No loud music, parties, or high-volume activity is permitted during this time. • Speakers must remain inside the villa, with volume kept at a level that cannot be heard beyond the property line. • Any event, celebration, or outside entertainment must receive prior approval and comply fully with HOA guidelines. • Failure to follow these rules may result in fines issued by the HOA and/or interruption of your stay. Area Construction. Guest acknowledges that construction activity is currently underway on the neighboring lot immediately adjacent to the Premises (Casa Del Faro) and may continue for an extended period, currently anticipated to last approximately up to eighteen (18) months, although the schedule is determined solely by third parties and may change without notice. Guest further acknowledges that additional construction activity may occur within the Punta Mita Development and Punta de Mita area generally, all of which is outside the control of Owner. Guest understands and agrees that intermittent construction-related noise, presence of workers, or other temporary disturbances may occur during permitted construction hours established by the Punta Mita community, which are typically Monday through Friday from 8:00 AM to 6:00 PM and Saturday from 9:00 AM to 1:00 PM, with no construction permitted on Sundays or community-designated holidays, subject to modification by the Punta Mita Master Association from time to time. Guest understands and agrees that such construction shall not affect the term or enforceability of this Agreement. Guest hereby waives any and all defenses, claims, actions, demands, damages, liabilities, losses, costs, or expenses against Owner and Owner’s Agents and Representatives arising from or related to such construction activity, including but not limited to inconvenience, disturbance, or interruption of enjoyment of the Premises, and/or injury to persons or property resulting therefrom, and agrees to indemnify, release, and hold harmless Owner and Owner’s Representatives from any and all responsibilities which may arise out of or in connection with such construction work.
