The space The apartment is located on the top floor of the Scheuermatthof and accommodates up to 8 guests. Good to know: Access is via a shared entrance with the lower part of the Scheuermatthof. Depending on occupancy, you may meet other guests. Great for families: plenty of space, direct access to nature and many activities nearby. ● Security deposit: €400 ● Electricity charged based on usage ● Firewood included Guest access The apartment is located on the top floor of the Scheuermatthofs. The rest of the chalet can be rented to other guests. The entrance to the apartment is at the upper end of the staircase to the right. Other things to note ● Security deposit: A security deposit of €400 is required for your stay, which will be refunded in full after your departure, provided everything is in order. ● Utilities: Electricity and heating are charged at €0.35/kWh based on consumption. Firewood is provided free of charge. ● Bed linen & towels: These are already included in the price. If you wish to bring your own bed linen and towels, you will receive a credit. ● Old Black Forest farmhouse: Due to the building’s construction, the house is rather prone to noise. The holiday flat is located in the top floor. The main entrance has the low ceiling height typical of old Black Forest houses. ● Shared entrance: The main entrance and staircase are shared with guests staying on the ground and first floors of the holiday home. ● Tourist tax & guest card: In addition to the accommodation price, the town of Todtnau charges a tourist tax of €3.20 per night for guests aged 16 and over, and €1.30 for children aged 6 to 15. You will receive the digital Todtnau guest card and, on request, the KONUS guest card for free use of public transport. This is not the Hochschwarzwald Card. The rental contract is concluded as soon as the tenant declares the binding booking and the landlord accepts and confirms it. If the agreed payments are not received on time, the landlord is entitled to cancel the rental contract after issuing a reminder. In this case, a cancellation fee shall be charged in accordance with No. 3. 2. Upon request, the tenant must prove his identity and registration address to the landlord by presenting an official identification document. If the tenant does not comply with the request, the landlord is entitled to terminate the tenancy agreement after issuing a reminder. In this case, a cancellation fee will be charged in accordance with No. 3. 3. In the event of non-utilisation of the contractual services, the tenant shall be obliged to pay the agreed or customary price, less the expenses saved by the lessor. Decisive for the time of cancellation and for the amount of the cancellation costs is the receipt of the cancellation declaration by the landlord: 1. more than 60 days before the start of the rental period 50% of the rental price, 2. 60 - 31 days before the start of the rental period 70% of the rental price, 3. 30 days - 1 day before the start of the rental period 90% of the rental price, 4. in case of cancellation on the day of the start of the rental period 95% of the rental price. The usually saved expenses are taken into account in the lump sum. The lessee shall be at liberty to prove that no or lower costs were incurred in connection with the cancellation. 4. If the holiday home is not used, the landlord is obliged in good faith to let the holiday home to someone else if possible in order to avoid losses. Until the holiday home has been let to someone else, the guest shall pay the amount calculated in accordance with No. 3 for the duration of the contract. If the holiday home is re-let at a lower rental price than the original rental price, the difference shall be deducted from the re-letting proceeds. Any proceeds in excess of this shall be credited to the Tenant towards the cancellation costs in accordance with No. 3. In addition, even in the case of a complete re-letting, a processing fee of € 100 per re-letting shall be incurred. 5. In case of non-availability of the holiday home, the landlord is obliged to immediately refund any deposits paid by the guest. In the event of a cancellation by the landlord, the compensation for damages is limited to the maximum amounts according to No. 3. The tenant shall provide evidence of the damage incurred. The lessee shall be obliged to cooperate and mitigate the damage. 6. The holiday accommodation is only rented for temporary use and only for holiday purposes. The duration of the contract is agreed separately. 7. The landlord reserves the right to withdraw from the rental contract up to 6 months before the agreed date of arrival in the event of a change of ownership or the closure of a business. In this case, all payments made will be refunded. In this case, the tenant shall have no further claims against the landlord. 8. If the letting of the rented property becomes not only partially impossible due to unforeseen uninhabitability or force majeure (e.g. natural disasters), both the tenant and the landlord may terminate the contract. In the event of termination, the tenant shall be refunded the rent paid without delay. There shall be no further claim. 9. The tenant is responsible for compliance with any restrictions resulting from official orders, ordinances or other legal provisions and which affect the stay, unless they are expressly addressed to the landlord. If, due to the aforementioned restrictions, not all of the intended participants are able to take part in the stay, this shall not entitle the hirer to reduce the rent or to withdraw from the hire contract free of charge. If the Hirer withdraws from the rental contract due to such restrictions, half of the cancellation costs shall be credited as a price reduction (special discount) in the event of an equivalent new booking in accordance with No. 3. In the case of cancellation costs amounting to 30%, a maximum of 15% of the regular booking price can be credited as a special discount, in the case of 60% a maximum of 30% of the booking price, etc. The special discount is non-payable, non-transferable and can only be credited once. 10. The landlord may terminate the tenancy without notice if the tenant or the tenant's guests, despite a warning, endanger others through their behaviour, cause considerable disturbance or otherwise behave in breach of the contract. If the landlord terminates the tenancy agreement in accordance with No. 10, the tenant shall be obliged to pay damages. 11. The use of the furnishings of the holiday home, in particular the use of the hanging chair, is expressly at your own risk. Before use, make sure that the hanging chair is securely anchored and has no damage. The hanging chair is not suitable for swinging or turning. The hirer is not liable for personal injury, damage to property, theft or loss suffered during or as a result of a stay. Excluded from this is the liability of the lessor due to intent or gross negligence. 12. The landlord is not liable for inconveniences or disruptions caused by influences outside his direct sphere of influence or by third parties, provided that no essential contractual obligations are affected. The liability of the landlord for simple negligence is excluded, provided that no essential contractual obligations are violated. This exclusion of liability does not apply to defects in the rented property that were already present at the time the contract was concluded, or to damage caused by wilful intent or gross negligence on the part of the landlord or resulting from injury to life, limb or health. 13. The total price stated in the rental agreement plus the agreed ancillary costs (e.g. electricity/heating current according to meter consumption: €0.35/kWh) represents the basic rental price for the rental and use of the holiday accommodation. The tenant is authorised to use the rental property with up to the maximum number of persons stated in the rental agreement. Additional persons (including day visitors) must be registered with the landlord in advance. The landlord reserves the right to refuse to accept unregistered persons or persons in excess of this number. Unless otherwise agreed, the average price per person and day specified in the rental agreement shall apply as an additional rental price for additional persons. This is reduced by 50% for children between the ages of 4 and 17. Differing prices for additional persons on booking portals such as Airbnb or Booking only apply to the persons specified at the time of booking. 14. You have the possibility to access the internet via the PC set up in the living room (if available) and via W-LAN. Internet access is free of charge. The landlord is not liable for the availability, suitability or reliability of the internet access for any purpose. The use of Internet offers or programmes which violate legal prohibitions, morality or the rights of third parties (rights to names, copyrights, data protection rights, etc.) is not permitted. In particular, the retrieval or offering of content that glorifies violence, incites hatred or is protected by copyright is not permitted. The same applies to the sending of e-mails. 15. The tenant is responsible for clearing snow and ice. The tenant is liable to the landlord and third parties for any personal injury or property damage resulting from this, unless this is due to intent or gross negligence on the part of the landlord. In shared areas, all tenants involved are equally obliged to take responsibility for traffic safety and to coordinate with each other. 16. The parking of vehicles in front of the house is not permitted due to the danger of roof avalanches in snowy conditions. The tenant is liable for any personal injury or damage to property resulting from this. 17. Smoking in the holiday home and bringing animals is not permitted (exception: small dogs in the holiday home Im Birkenweg by arrangement). The landlord may refuse to accept unregistered animals. If the landlord tolerates unregistered animals, an additional fee of €50 per animal per day shall be deemed agreed. Any additional cleaning costs exceeding this fee shall be borne by the tenant. If the smoking ban is disregarded, the deposit paid will be forfeited in full. In addition, the tenant must bear the full cost of any additional cleaning required to remove the odour. Further claims for damages by the landlord remain unaffected by this. 18. The rental property is not handicapped accessible. In the holiday home "Scheuermatthof" there are restrictions on the ground and upper floors due to a ceiling height of approx. 1.90 - 2.00 m, in some places only approx. 1.70 - 1.80 m. In the holiday property ‘Im Birkenweg’, the room-saving staircase to the children's room is very steep. 19. The tenants must treat the holiday home and its furnishings with care. Any damage to the property, furnishings or missing items must be reported to the landlord immediately. The landlord may demand compensation. For damaged items, the repair costs or the replacement value will be charged. This also applies to any damage or missing furnishings subsequently discovered to have been caused by the tenant, as well as to any costs arising from the rearrangement or reconfiguration of furnishings. 20. On departure, the holiday home is to be handed over broom-clean. This includes normal cleaning of the kitchen. The dishes must be washed and put away. The rubbish must be sorted according to local regulations (recycling/yellow sack, glass, paper, compost, residual waste) and placed in the garage. It is compulsory to use the yellow sacks provided for recycling material. Costs arising from gross soiling or inadequate waste separation are to be borne by the tenant and will be charged against the deposit. 21. Telephone calls to the German landline network are free of charge. Calls to foreign countries, mobile phone networks and special numbers (0180, ...) are subject to a charge. The number ranges 0137, 0900 and 0190 are blocked. Any costs incurred for chargeable telephone calls are to be borne by the hirer. 22. In case of a booking via a travel agent (e.g. AirBnb, Fewo-Direkt), the rental terms and conditions presented here shall apply in principle. These take precedence over any deviating provisions of the agent (e.g. cancellation policy, liability, etc.). In the case of payments of the rental price via an intermediary, the payment shall only be deemed to have been fulfilled upon receipt of the money by the lessor. 23. To prevent vandalism and theft, as well as to inform the landlord about the arrival and departure process in the context of contactless rental, the entrance area to the holiday property is recorded with a security camera. The recordings are stored for 4 weeks. Responsible person according to DSGVO: Wolfgang Morgenthaler, Im Laimacker 22, 79249 Merzhausen. By entering into the tenancy agreement, the tenant agrees to the storage of the recordings. 24. The exclusive place of jurisdiction is the Lessor's place of residence. 25. The invalidity of individual provisions of the rental agreements shall not result in the invalidity of the entire rental agreements. === House Rules Scheuermatthof (as of August 2026 v12) === == Arrival == * Read or photograph the meter reading "holiday home ground floor/ground floor/barn" (HT & NT meter reading in each case) and the meter reading "holiday home ground floor" twice at intervals of 10 seconds (because the display of the NT/HT tariff changes) for your own records. The landlord reads the values via the internet. * Please sign the PDF registration form – which you have printed out yourself and brought with you – by hand on the day of arrival, make any necessary changes, and then send a photo of it to the Whats-App group. * The beds may only be used with bed linen and fitted sheets. Sleeping bag users must also use a fitted sheet for hygienic reasons! * Document/photograph technical defects and missing items and report them immediately to vermietung@scheuermatthof_de. == In winter == * In the kitchen on the ground floor there are two central ground stoves, which are fired with wood or coal. Likewise in the barn and in the living room of the holiday flat. These may only be lit by the supervisor. When refuelling, put logs in, do not throw them in! * Do not unplug the anti-freeze heaters in the toilets! Switch off the heaters or turn them to the frost protection setting. * Allow the ash from the stoves to cool and empty it into the compost bin (brown bin). Under no circumstances pour it into the garden, in front of the house or onto the snow! * You are obliged to clear and grit the access paths, the street and the yard in case of snow or icy conditions. The parking of vehicles in front of the house is not permitted due to the danger of roof avalanches in snowy weather. The tenant is liable for any personal injury or damage to property resulting from this. == Your stay == * Use slippers on the wooden floors in the living area. * For fire safety reasons, smoking is absolutely prohibited in the entire building and on the wooden balcony. * Animals are not allowed in the house. * The Scheuermatthof is a wooden house. Candles, tea lights, incense and open fires in the house are strictly prohibited. * Safety nets are attached to the bunk beds as fall protection. The safety nets do not offer 100% protection against falling out. Children under the age of 6 must not use the bunk bed. Children under the age of 6 - especially toddlers - must never be left unattended with the bunk beds. * Do not disconnect any cables from the TV sets/amplifiers or change the configuration. You can connect your own devices to the free cables. In case of changes, we charge a minimum of 50 € for a technician's intervention. * The lifting unit in the Staufen bathroom does not tolerate wet wipes, tampons, sanitary towels, nappies or similar. These must go into the waste bin! The costs for the plumber for a blocked lifting system are at least 200 €. * Charging electric cars at the standard Schuko sockets in the holiday property is not permitted. == Fire protection when grilling and making a fire == The Schwarzwald-Chalet Scheuermatthof is a wooden building that is more than 200 years old. For fire protection and insurance reasons, particularly strict rules apply to open fire:* '''Barbecuing and lighting a fire only at a minimum distance of 8 meters and only on the natural stone terrace next to the house!''' The grill, the fire bowl or the fire basket must be set up on the terrace at the maximum distance from the house at the edge. Never light a fire directly on the natural stone terrace/lawn or place the grill directly on the lawn. Otherwise we have to charge for replacing the stones or clearing the wild fireplace and reseeding the lawn. * '''No fires in the courtyard in front of the Scheuermatthof!''' Fires in front of the entrance area are not (!!!) allowed under any circumstances. Even if the fire is permanently supervised, a sudden gust of wind can cause flying sparks that are blown under the roof and, in the worst case, ignite cobwebs, leftover leaves or similar in the attic. * Charging and storing e-bike batteries in the home is not permitted for fire safety and insurance reasons. == Noise protection and night rest from 10 p.m. to 8 a.m. == * The general night-time rest period is from 10 pm to 8 am. Avoid loud music and noises at the start of the night's rest, e.g. by switching off the outdoor speakers and subwoofers, refraining from loud singing, closing the windows and reducing the music volume. * For noise protection reasons, the operation of sound equipment brought along, in particular active speakers in the outdoor area, is not permitted. Exceptions to this are possible after consultation with the landlord. * The area on the natural stone terrace is better shielded by the house from the valley than the area directly in front of the house. It is therefore advisable to stay on the natural stone terrace after 10 pm rather than in front of the house. * If neighbours, residents or other guests complain to you about a possible noise nuisance or anything else, remain solution-oriented, polite and compromise. == The outdoor area and surroundings == * The fenced meadow above the Scheuermatthof is traditionally used for species-appropriate suckler cow husbandry. Do not climb over the fences. In the worst case, the mother cow or the bull will attack you to protect the calf. Use the path in front of the Scheuermatthof to get up to the viewing chair. * The tall grass in the meadow on the mountain side is mown by a farmer and fed to animals. Playing, lying down and otherwise trampling the meadow is only allowed up to the boundary marked with a post. * Balls, Frisbees or similar that have flown onto the roof: leave them there! Stepping on the slate roof is prohibited. It may only be done with special roof ladders, otherwise the slates will break. == On departure == * Return moved furniture, games, objects etc. to their original places. This applies in particular to the benches & tables in the garden. The tables/benches with the rubber pads on the ends of the tubes belong in the common room, the others in the barn. * Collect rubbish, empty bottles & glasses from the rooms. * Empty all refrigerators completely. Dispose of food leftovers in the organic waste bin. Leftovers that have not yet been opened can remain in the refrigerator. Do not throw food scraps & jars into the residual waste! * Turn off emptied refrigerator and leave refrigerator door / freezer compartment open. * Grill used? Barbecue cleaned? Put the swivel grill cleaned in the barn. The small barbecue and the fire bowl to the left of the main entrance. Ash and charcoal leftovers to cool in the ash bucket and then in the brown compost bin. * Wash the dishes, dry them and put them away in the cupboards. * Leave the kitchen broom-clean, i.e. sweep or mop once. Wipe the kitchen with oven, hob and worktop clean. * Take rubbish bags and yellow sacks to the rubbish bin by the garage. Be sure to observe the sorting rules (yellow sack, organic waste bin, paper, glass, residual waste). No glasses and bottles in the residual waste, no plastic & no packaging in the residual waste. Food scraps must be thrown in the brown organic waste bin, not in the residual waste. * Put bottles and jars in the glass containers in the "Schwimmbadweg". * Finally, make a check of the flat and check that all windows and outside doors are closed to prevent damage in case of rain.
