The stunning coastline is only about a 30-minute car ride away and many other attractions are within an hour. Relax on the breezeway, porch, or by the open fire pit. 🐝 The space This is a small, detached single family dwelling and not connected to any other units. There is a detached laundry room/shed that locks and is great for bike storage or other sporting equipment. The yard features an outdoor patio with fire pit and Adirondack chairs and an outdoor kitchen area with a doggie wash station! All under a huge tangled Oak tree. Indoor/outdoor living with comfy breezeway and sitting area with TV and Foosball, giving a little extra space to hang out and relax in the above-ground hot tub. Enjoy a spa-like atmosphere! Air-conditioning provided in summer months as relief for unusually hot days, but we ask that you please be respectful and conservative in use as we typically enjoy a mild climate. For liability reasons, ONLY REGISTERED GUESTS MAY ENTER THE PREMISES. Failure to do so will forfeit your reservation without any refund Guest access The entire property: outdoor covered breezeway, porch, laundry shed, outdoor patio and gardens. Other things to note Upon making their reservation, all guests agree to register any guests over 18 years of age entering onto the property and to sign required documents: Liability Waiver, Covid Waiver, Hot Tub Waiver. Guests agree to read, understand and adhere to the Liability Waiver at the end of my listing Description. No unregistered guests are allowed on the property without prior permission (just ask) and host reserves the right to cancel the reservation immediately in the event a guest brings unauthorized visitors. No parties. Maximum occupancy is 4 people. While my home is “pet friendly”, all guests must ask permission to have a pet during their stay and must register the pet/breed and sign a pet policy & waiver. Please check with your host before bringing pets. Linens and pillows are high quality, hypoallergenic covers and plenty of extras. Rigid cleaning regimen with hospital-grade disinfectant and steam-cleaning. Liability Waiver: You understand that use of the property and grounds is at your own risk and that special risks may be involved with wildlife, streets with no sidewalks or lights, stairs, uneven rock patio and narrow walkways. You accept full responsibility for any bodily injury arising from outdoor areas, any additional guests or events and hold owner harmless. You understand there are potential dangers that patio swing and other outdoor areas present to children who are not carefully supervised, as well as the danger to any person hiking or using the swing if a person has health risks, or if a person uses swing, BBQ or fire pit while intoxicated or using any kind of drugs or medication, or while pregnant. You agree to be fully and solely responsible for any accidents you may incur. You understand the risks discussed above and agree that you will assume all responsibility for yourself and for the consequences of those in your party. You agree to waive any claim whatsoever against owner for accidents or claims arising from additional unauthorized guests, or events. All Airbnb Guests in my party acknowledge and agree that they have read and understand this waiver. You acknowledge and agree to surveillance camera (exterior only) for security, and consent to any video evidence that camera captures. No refunds or settlements will be issued without the prior written consent of the owner/host. This rental is privately owned and the owners are not responsible for any accidents, injuries or illness that occurs while on the premises or its facilities. The Homeowners are not responsible for the loss of personal belongings or valuables of the guest. By accepting this reservation, it is agreed that all guests are expressly assuming the risk of any harm arising from their use of the premises or others whom they invite to use the premise. Upon booking a reservation, guests agree to the terms of this liability release and to sign a hold harmless agreement, hold as well as waivers for hot tub and/or pet agreements within 5 days prior to occupancy. I understand and agree that access and use of the premises and hot tub are explicitly for registered guests. No unregistered guests are permitted on the property without prior written consent and liability release signed by any person over 18 years of age. Any violation of this house rule may result in immediate removal from the property. Hot tub is an added amenity and currently with the COVID 19 restrictions on service providers, we cannot guarantee that a spa technician will be immediately available in the event of a malfunction. Guest will be entitled to a maximum of $25 refund if this amenity is not able to be used. Any refund amount higher than this is at the sole discretion of the owner/host and evaluated on a case by case basis. In the event the hot tub is damaged by guest and deemed to be caused by user error, guest will be responsible for repair fees paid to a qualified spa technician. Hot Tub Waiver: RELEASE & WAIVER OF LIABILITY AND INDEMNITY AGREEMENT for HOT TUB USE IN CONSIDERATION OF the risk of injury that exists while SOAKING IN the HOT TUB (hereinafter the “Activity”); and IN CONSIDERATION OF my desire to participate in said Activity and being given the right to participate in same; I HEREBY, for myself, personal representatives, executors, administrators, assigns, guests, children, heirs, and next of kin, (hereinafter collectively, “Releasor,” “I” or “me”, which terms shall also include Releasor’s parents or guardian if Releasor is under 18 years of age), knowingly and voluntarily enter into this WAIVER AND RELEASE OF LIABILITY and hereby waive any and all rights, claims or causes of action of any kind arising out of my participation in the Activity; and I HEREBY release and forever discharge Nancy Krantz - located at 247 S McKnight Rd, Newbury Park CA 91320, (hereinafter “Nancy”) her affiliates, managers, members, agents, attorneys, staff, volunteers, heirs, representatives, predecessors, successors and assigns (collectively “Releasees”), from any physical or psychological injury that I may suffer as a result, direct or indirect, of my participation in the Activity. I HEREBY acknowledge that upon entering the hot tub area, I will continuously thereafter, thoroughly inspect such area. My continued presence constitutes an acknowledgment that I have inspected this area and find and accept such areas as being safe and reasonably suited for the purposes of the Activity. I further agree and warrant that if, at any time, I feel or think anything to be unsafe, I and all guests will immediately leave the area and advise Nancy. I am voluntarily participating in the Activity and I am participating entirely at my own risk. I am aware of the associated HOT TUB RISKS which may include but are not limited to drowning, heat exhaustion, heat stroke, skin/ear/bladder/lung or other infections, chemical burns or irritations, physical/psychological injury, pain, suffering, illness, disfigurement, disability, economic or emotional loss, paralysis or death. I understand that these injuries or outcomes may arise from my own or others’ negligence, including that of Nancy, or from the conditions at the Activity location. Nonetheless, I assume all related risks, both known and unknown to me, of my participation in this activity. Some of the known risks and precautions are noted below and I have read and understand. Pregnant women, children and those with heart disease ARE NOT ALLOWED IN THIS HOT TUB. If you are taking medication of any kind, or being treated for diabetes, low or high blood pressure, strokes, epilepsy, weakened immune system or other conditions, or are a frail elderly person, consult your physician prior to use of the hot tub. It is advised to limit your soak in the hot tub to no more than 15 minutes at a time. If you overheat and faint, you can drown. Shower after use to rinse off hot tub chemicals.. Keep your head, arms and upper chest out of the water to avoid overheating. Get out if you feel dizzy, overheated, nauseous, or unwell. Stay hydrated before getting into the hot tub. Check the chemical strip yourself before getting in to be sure the pH and chlorine levels are at the recommended levels. If not, or if the water looks murky or slimy, don’t get in. Alert us. Check the temperature. Do not get in if over 104˚. DO NOT DRINK ALCOHOL or USE DRUGS before or during hot tub use. Please KEEP the hot tub CLEAN and CLEAR: Shower before you get in to get off most particles, oils, cosmetics and hair and skin products. No shoes, street clothes, pets or glass containers in or around the hot tub. Do not eat, or drink, or use soap and shampoo while INSIDE the hot tub. Do not urinate or spit into tub. And please, no “adult activity” while inside the hot tub. At check-out, if the hot tub water is unsanitary, extremely cloudy or has bubbles and/or strong odor that results in additional maintenance and cleaning (drain & refill), guest agrees to a $50.00 fee. Don’t get in tub if you have open sores or wounds, or cuts, or diarrhea. Close the lid when you are finished. Do Not sit, lay or stand on the hot tub cover – it will collapse into the hot tub. Be careful when getting out so you don’t slip and fall. I FURTHER AGREE to INDEMNIFY, DEFEND AND HOLD HARMLESS the releasees against any and all claims, suits or actions of any kind whatsoever for liability, damages, compensation or otherwise brought by me or anyone on my behalf, including attorney’s fees and any related costs. I FURTHER ACKNOWLEDGE that Releasees are not responsible for errors, omissions, acts or failures to act of any party or entity involving this Activity on behalf of the Releasees. I am aware and understand that I should carry my own health insurance. COVID 19 has greatly impacted the service industry related to visits from technicians in the event of a hot tub malfunction. If such a malfunction occurs and cannot se repaired during your stay, you may receive a refund. The amount of refund may not exceed $25.00 per night unless your host, Nancy Krantz, authorizes a higher amount. I hereby acknowledge that I have carefully read this “waiver and release” and fully understand that it is a release of liability. I expressly agree to release and discharge Nancy and their Releasees from any and all claims or causes of action and I agree to voluntarily give up or waive any right that I otherwise have to bring a legal action against Nancy for personal injury or property damage. To the extent that statute or case laws does not prohibit releases for ordinary negligence, this release is also for such negligence on the part of Nancy and Releasees. I agree that this Release shall be governed for all purposes by California law, without regard to any conflict of law principles. This Release supersedes any and all previous oral or written promises or other agreements. This waiver and release of liability shall remain in effect for the duration of my participation in the Activity, during this initial and all subsequent events of participation. In the event that any damage to equipment or facilities occurs as a result of my or my family’s, guests, or agents willful actions, neglect or recklessness, I acknowledge and agree to be held liable for any and all costs associated with ay such actions of neglect or recklessness. In the event that any provision contained within this Release shall be deemed to be severable or invalid, or if any term, condition, phrase or portion of this agreement shall be determined to be unlawful or otherwise unenforceable, the remainder of this agreement shall remain in full force and effect. Waiver of Liability Relating to Coronavirus/COVID-19 The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is reported to be extremely contagious. The state of medical knowledge is evolving, but the virus is believed to spread from person-to-person contact and/or by contact with contaminated surfaces and objects, and even possibly in the air. People reportedly can be infected and show no symptoms and therefore spread the disease. The exact methods of spread and contraction are unknown, and there is no known treatment, cure, or vaccine for COVID-19. Evidence has shown that COVID-19 can cause serious and potentially life threatening illness and even death. Your short-term rental host, Nancy Krantz, otherwise referred herein as The B’s Hive, cannot prevent you from becoming exposed to, contracting, or spreading COVID-19 while utilizing The B’s Hive services or premises. It is not possible to prevent against the presence of the disease. Therefore, if you choose to utilize The B’s Hive services and/or enter onto Nancy Krantz’ premises you may be exposing yourself to and/or increasing your risk of contracting or spreading COVID-19. ASSUMPTION OF RISK: I have read and understood the above warning concerning COVID-19. I hereby choose to accept the risk of contracting COVID-19 for myself and/or my children in order to utilize The B’s Hive services and premises. These services are of such value to me that I accept the risk of being exposed to, contracting, and/or spreading COVID-19 in order to utilize The B’s Hive’s services and premises in person. WAIVER OF LAWSUIT/LIABILITY: I hereby forever release and waive my right to bring suit against Nancy Krantz and The B’s Hive and its owners, officers, directors, managers, officials, trustees, agents, employees, or other representatives in connection with exposure, infection, and/or spread of COVID-19 related to utilizing Nancy Krantz’ services and premises. I understand that this waiver means I give up my right to bring any claims including for personal injuries, death, disease or property losses, or any other loss, including but not limited to claims of negligence and give up any claim I may have to seek damages, whether known or unknown, foreseen or unforeseen. I agree to the mandates and orders under the state of California and hereby certify that in the event of state closures, I will only be traveling for essential purposes and am not traveling for recreation, gambling or for the purpose of gatherings. CHOICE OF LAW: I understand and agree that the law of the State of California will apply to this contract. The dog must be healthy and up to date (required every 3 years) on rabies and DHPP (vaccines for Distemper, Adenovirus (Hepatitis), Parainfluenza and Parvovirus). The dog must be flea and tick free and current on prevention treatment. Guests will always keep the dog on a leash outside the room. Guests will not leave the dog unattended in the room. Guests are responsible for cleaning up any and all dog refuse, as well as cleaning dog before he/she comes indoors. Please bag and dispose of waste in the can outside. Guests will use either the The B’s Hive side lot or the trail/street to walk the dog to urinate and defecate. Please do not allow your dog to urinate on the lawn. Guests will not let the dog relieve itself in the neighbors’ yards. The dog is not allowed on the guest beds at any time. Evidence any pet soiling/damage on bed or bedding may incur extra cleaning or replacement fees. As responsible pet owners, Guests agree to accept full and complete responsibility for any personal injury or property damage caused by the dog or suffered by any person during Guests’ stay at The B’s Hive, and agree to release Host of any and all liability from any damage associated with the dog’s behavior or injury caused by the dog to anyone on or near the B’s Hive property. Guests understand that The B’s Hive will charge accordingly for the repair of any damages, additional cleaning requirements, or flea treatment caused by dog’s presence or behavior.
