From the moment you descend its driveway – you and your guests will be enveloped in this magnificent private estate. Once inside the castle, you will marvel at its cathedral ceilings, glittering chandeliers, fireplaces, floor to ceiling windows (with forest views) and custom-made, gothic architectural features. Situated on multiple levels (Including a tower wing)· the Castle has several dozen rooms, including seven luxurious suites, an acoustically perfect great room with balcony, custom kitchen, a formal dining room and several salons – plus multiple themed rooms: study, game room, and even a Bavarian-style pub with a sunken bar. Finally, multiple lower and upper terraces complete this spectacular edifice. Access to the whole property Homes are nestles in a forest, quite neighborhood surrounded with dogwood trees. Easy access off of HWY 18, 7 minutes away from major market andLake Arrowhead. 3 minutes away from Santa's Village/skypark which has ample hiking and bike paths 7 minutes away from Lake arrowhead village where there are many restaurants, shops and summer concerts, 5 minutes away from Skypark * Tenant must sign Rental Agreement before check-in * Cleaning fee $750 * $100 per person per night after 20th guest * Day visitors are included in the total guest count for the full stay even if they visit only one day. * NO MUSIC CAN BE PLAYED OUTSIDE THE HOUSE...music is allowed only inside until 10:00 PM and not to surpass 55 decibels * Noise notification and/or disturbance will trigger forfeiture of deposit * Property is monitored by noise sensors and external security cameras * NO PARKING IS PERMITTED ON THE STREET * No accessibility for trailers / trucks * No events allowed * RESTRICTIONS: No fog machine, bubble machine, confetti, glitter, DJ, amplified music, pyrotechnics, hired entertainment, open fire pits, smoking, decorations on walls affixed via nails, velcro, tapes or other means * Trash must be kept in garage during stay to keep it away from wildlife * All trash must be dropped-off at the high school upon check-out * The client will be charged a $250 fee if all trash is not removed from the Castle * CITF provides a grill with gas tank, no open grills allowed * Furniture and mattresses may not be moved to outside or rearranged in the house * All dishes must be washed in dishwasher prior to check-out * Toilet papers (2) and kitchen towels (2 ) are provided * Linen room carries blankets, extra pillows, towels, and sheets * Only 7 cars allowed to park on the long driveway * No Parking allowed on the top driveway *7 tankless water heaters are on timers and go off from 12 AM to 5 AM *$2000 security deposit withheld by airbnb to cover additonal cleanup fee, excessive clean up fees, missing items, damged items and violation of rules listed in Airbnb Please read the copy of the rental agreement This Rental Agreement is dated ________________ by and between Arsine Shirvanian (landlord), and _________________ (tenants). No events are allowed through Airbnb rentals. The parties agree as follows: PREMISES: Landlord, in consideration of the lease payments provided in this Lease, leases to tenant, Castle In The Forest, with a maximum of 20 guests (the premises) located at 900 Blue Ridge Drive, Skyforest, CA. 92385. NIGHTLY FEE: Please refer to Airbnb rates. TERM: The tenant will have full control and use of the premises, beginning on _____________ at 3:00 p.m. and will terminate at 11:00 a.m. on ______________. LEASE PAYMENTS: Please follow Airbnb payment schedule. SECURITY DEPOSIT: A security deposit of $2,000.00 to be held by Airbnb and disbursed for tenant damages to the premises or other defaults under this agreement (if any) as provided by law. Security deposit will protect owner against damage or theft to the property and timely return of the door key. Deposit may be applied by landlord to satisfy excessive cleanup, repairs caused by renter or to replace stolen items and such act shall not prevent landlord from claiming damages in excess of the deposit. The tenant is held financially responsible for damages to the rental property, whether made by themselves, their family, and / or another guest in their group or invitee. Notification of noise disturbances will automatically trigger a forfeiture of the security deposit. POSSESSION: Tenant shall be entitled to possession on the first day of the term of this rental agreement and shall yield possession to landlord on the last day of the term of this rental, unless otherwise agreed upon by both parties in writing. At the expiration of the term, tenant shall remove their goods and effects and peaceably yield up the premises to landlord in as good a condition as when delivered to tenant, ordinary wear and tear expected. USE OF PREMISES / ABSENCES: Tenant shall occupy and use the premises as a dwelling unit. Tenant shall notify landlord of any anticipated extended absence from the premises not later than the first day of the extended absence. Tenant will maintain the premises in good order and appearance including keeping the premises free of trash and garbage. Reasonable wear and tear are the only exceptions of damage to the premises. Tenant Initials: _________ Rental Agreement OCCUPANTS: No more than 20 people may occupy the premises at any one time unless the prior consent of the landlord is obtained. All guests, except infants, are counted towards the maximum number. Any party falsely representing the number of people, or exceeding the maximum (20), will incur a charge of $100 per guest per night fee. Failure to notify the landlord may be subject to immediate eviction without refund. No more than 30 guests are allowed. CITF has bedding for only 21 overnight guests. PETS: No pets shall be allowed on the premises, unless prior consent of landlord is obtained. Additional fees may apply. PARKING: The maximum number of cars allowed at the property at any one time is 7. Parking exceeding this limit may result in immediate eviction and forfeiture of all amounts paid. Parking is allowed inside the Castle gates on the Castle’s long driveway ONLY. No parking is permitted on the upper level. No street parking is permitted. Violation of this rule will result in the forfeiture of deposit and/or immediate eviction. The Castle does not have accessibility for trailer-trucks. Tenant must provide CITF with license plate number of all vehicles. NON-DISTURBANCE CLAUSE: Tenant and their guests shall not disturb, annoy, endanger (fireworks), or inconvenience neighbors nor use the premises for any unlawful purposes. Per San Bernardino noise ordinance, noise levels must be kept under 55 decibels until 10:00 PM. Notification of noise disturbances will automatically result in a forfeiture of the security deposit. No events, amplified music, blocking of street, or day visitors are allowed. Second notice of noise disturbance will result in power shut off. CANCELLATIONS: Please refer to cancelation policy on Airbnb listed under the “Property” tab. SMOKING: Smoking is strictly forbidden on the property. Evidence of smoking will result in immediate eviction and forfeiture of all security deposit amounts paid. Additional cleaning fee charges may incur to the tenant as a result of smoke damages. COOKING: Tenant may cook only in the specific areas set aside by landlord for cooking (main kitchen only). No open fires are allowed. A gas grill is provided to the tenant which is located on the patio adjacent to the family room. CLEANING: The property will be inspected and cleaned after departure. The rental fee includes laundry service for the towels and linens. Tenant is required to leave the property in the same general condition that it was received in by making sure that the dishes are washed and put away, and the house is generally ready to be vacuumed, dusted, and laundered. All trash must be taken off of the premises by the tenant. RESTRICTIONS: Day visitors, amplifiers, speakers, DJ equipment, smog machine, bubble machine, pyrotechnics, confetti / glitter, hanging fixtures on walls (via tape, velcro, nails, or any other means), real candles, open fires, makeshift open fire pits, smoking are STRICTLY PROHIBITED and will result in immediate eviction and severe fines. Tenant Initials: _________ Rental Agreement CASUALTY OR DESTRUCTION: Should the property or its contents be destroyed or the property be rendered uninhabitable as above during occupancy, the tenant may incur additional charges and legal actions may be taken against the tenant. ASSIGNABILITY / SUBLETTING: Tenant may not assign or sub-rent any interest of the premises. DISCLOSURE: CITF is monitored by security patrol, caretaker, surveillance cameras on the outside areas, and contains noise sensors. LANDLORD: TENANT(S): Arsine Shirvanian 900 Blueridge Drive Skyforest, Ca., 92385 ENTIRE AGREEMENT / AMENDMENT: This rental agreement contains the entire agreement of the parties and there are no other promises, conditions, understandings, or other agreements, whether oral or written, relating to the subject matter of this rental agreement. This rental agreement may be modified or amended in writing, if the writing is signed by the party obligated under the amendment. SEVERABILITY: If any portion of this rental agreement shall be held to be invalid or unenforceable for any reason, the remaining provisions shall continue to be valid and enforceable. If a court finds that any provision of this rental agreement is invalid unenforceable, but that by limiting such provisions it would become valid and enforceable, then such provision shall be deemed to be written, construed, and enforced as so limited. WAIVER: The failure of either party to enforce any provisions of this rental agreement shall not be construed as a waiver or limitation of that party’s right to subsequently enforce and compel strict compliance with every provision of this rental agreement. BINDING EFFECT: The provisions of this rental agreement shall be binding upon and inure to the benefit of both parties and their respective legal representatives, successors, and assigns. DISPUTE RESOLUTION: The parties will attempt to resolve any dispute arising out of or relating to this rental agreement through friendly negotiations amongst the parties. If the matter is not resolved by negotiation, the parties will resolve the dispute using the below Alternative Tenant Initials: _________ Rental Agreement Dispute Resolution (ADR) procedure, unless the dispute or controversy meets the requirements to be brought before California’s small claims court or is an unlawful detainer proceeding. Any controversies or disputes arising out of or relating to this rental agreement, other than those expected above, will be submitted to mediation in accordance with any statutory rules of mediation for the state of California. If mediation does not successfully resolve the dispute, then the parties may proceed to seek an alternative form of resolution in accordance with any other rights and remedies afforded to them by law. CAUSE FOR EVICTION: The tenant and all parties with the tenant will be subject to immediate eviction from the property if the tenant or parties of the tenant violate any terms of this agreement, including but not limited to, violation of the occupancy limits, per provision, smoking, noise ordinance, or parking. In the event of eviction from the property, the tenant shall forfeit all amounts paid and there will be no refund of money. ATTORNEY’S FEES AND COSTS: If landlord employs the services of an attorney to enforce any conditions of this rental agreement, to collect any amounts due, the eviction of the tenant, or because tenant takes any action to recover deposits not due, tenant shall be liable to landlord for reasonable attorney’s fees and costs incurred by landlord.
