Tidal Vista is a large summer home that provides the ideal space for family gatherings or quiet getaways. Play in the meadow or on the private beach, with spectacular views of Mount Desert Island. Enjoy long walks on local roads, playing tennis on community courts and dining on local fare (lobster!). Nearby attractions include Acadia National Park, Bar Harbor and Schoodic Peninsula. **PLEASE REVIEW GUIDELINES, HOUSE RULES & GUEST RELEASE AND WAIVER ("Other details to note") BEFORE BOOKING** The space GUIDELINES The following Guidelines (and House Rules) may seem like a lot, but we want to ensure that you a) understand and accept what we can provide, b) help keep the house in good condition and, most importantly, c) stay safe and able to enjoy your time at Tidal Vista. Our hope is that this information will create a mutually beneficial relationship from the start. Please read them in full - and of course feel free to contact us with any queries or concerns. If you decide Tidal Vista is the place for you, please understand that your Reservation will constitute your Affirmation that you understand and will adhere to our Guidelines, House Rules, and the Guest Release and Waiver (see "Other details to note"). 1. DESCRIPTION/LAYOUT 4000 sq ft house, three levels, with stairs (see 6. Stairs). Main Level: Entryway, Living Room, Dining Area, Kitchen, Pantry, 1 enclosed patio, 2 open-air decks with guardrails. 2 Queen bedrooms, 1 full bathroom Upper Level: Loft with Futon, play or work area Lower Level: Bunkroom with 4 single beds, 2 Bedrooms: 2 singles and 1 King (see 8. Lower Level) 2. EARLY ARRIVAL Check-In is 3:00pm or after. Any requests to arrive earlier must be submitted at least 1 week in advance. We will try our best to accommodate the request - it depends on our caretaker’s schedule and when she can clean/prepare the house for your arrival. 3. AS-IS CONDITION This is an active household, which family members use throughout the summer. So while the house will be fully cleaned and sanitized before you arrive, there may be knick-knacks, toiletries and other oddities left behind. We ask your indulgence during your stay in our family home. We also provide basic outdoor furniture on both decks, and an outdoor BBQ grill with utensils for your enjoyment. We will have the grill cleaned in between occupancies, but there may be something stubborn and stuck to the grill regardless. Sorry! 4. EXTERIOR SECURITY CAMERA Please be advised that the house has an exterior security camera for its protection. Trying to cover or alter the device will result in immediate termination of the lease, and no refunds will be granted. There are NO cameras inside the house. 5. PARKING / EVs The parking area can accommodate 3 cars comfortably, 4 if necessary. We also have an Emporia Energy EV Charger with a built-in J1772 charging gun. This connector is used for Level 1 (120 volt) and Level 2 (240 volt) AC charging. Directions and method of payment will be communicated after booking. 6. STAIRS There are 5 steps to the entry porch/front door and 2 full staircases connecting the Main Level to the Upper or Lower Levels. We do NOT have handicap ramps. 7. TEMPERATURE We have heat, but not A/C - instead there are ceiling and table fans and plenty of windows to let air in or keep it out. We also have a working fireplace – and we will leave plenty of firewood for you. (see House Rules for more information) 8. LOWER LEVEL This part of the house is technically below ground, so it can sometimes feel a little damp - especially after a heavy rain; but we have a great dehumidifying system that runs automatically when it senses the air is too moist. 9. WATER IMPORTANT: the house runs off a septic system so PLEASE be mindful of how much water you use. If too many people are running water at the same time (showers, baths, dishwasher, laundry machine) the water pressure will drop and nothing will work - including the toilets – and you will have to wait at least 24 hours before the system restores itself. (see House Rules for more information) 10. ENTERTAINMENT / COMMUNICATION We try to make our home an escape from the everyday - a place where we can spend time together with minimal distraction or interference. Because of this, we do NOT have a TV or a DVD Player, and we do NOT have a landline or ethernet. Of course, none of us could live without some connection to the outside world, so we do have a strong WiFi system. However, since we are on the coast, the signal is weakened if too much bandwidth is used at one time. Streaming is NOT recommended. 11. CHILD SAFETY We have a a high chair, child-gate and crib, and lots of toys and games throughout the house – some with small pieces so please be careful with small children. The outdoor decks are made of wood which is exposed to the elements throughout the year. We recommend everyone – especially children – wear shoes and watch out for splinters. 12. PETS / SAFETY Pets are welcome - provided you notify us when you make a reservation. We charge a one-time fee of $50 to pay for extra cleaning (subsequent guests may be allergic, and some family members are). Failure to notify us will result in immediate termination of the lease. Please be advised that the property is NOT fenced and we recommend you keep your pets in at night. We cannot be responsible for their care and safety. 13. HEALTH CONCERNS The house is located in a remote wooded area. As such, the external part of the house (porches, decks) will be exposed to pollen and insects. There are also deer, porcupine, raccoon, rabbits and mice in the meadow and woods. Personal health issues or phobias should be taken into consideration. 14. BEACH The private beach will be yours to enjoy. But it is rocky so you must wear shoes at all times. We also CANNOT provide any aquatic equipment (snorkels, boats, etc.). If you choose to rent such equipment from an outside source, any water activities you participate in (including swimming) will be your choice and not our responsibility. Guest access Guests will have full access to the house, the meadow, and the beach. There are signs on the road and on the beach showing where our property ends and the neighbors' begins, and we ask that guests respect those boundaries. Other things to note GUEST RELEASE AND WAIVER In order to book your stay at the property called “Tidal Vista” through AirBnB, your Host(s) require(s) you to accept this Guest Release and Waiver, which is effective between you and your Host(s) as of the date you make your reservation. You represent that you are 18 years of age or older. If you are bringing a minor as a Guest, you acknowledge and agree that you are solely responsible for the supervision of that minor throughout the duration of your stay and have read this Guest Release and Waiver and agree to it on the minor’s behalf. If you are booking on behalf of other Guests, you will ensure, and you represent and warrant, that each Guest on whose behalf you book has read and agreed to this Guest Release and Waiver, which shall apply to each of them as if the reference to "you" was a reference to him/her. ASSUMPTION OF RISKS You understand and acknowledge that your stay may carry the risk of injury or illness, including sickness, physical injury, property damage, disability, permanent paralysis, and death. To the maximum extent permitted under applicable law, you knowingly, voluntarily and freely assume all risks, both known and unknown, even if they arise from the perceived negligence or carelessness of the hosts or others, or defects in the equipment, premises or facilities, or otherwise, and you assume full responsibility for the duration of your stay. RELEASE AND WAIVER You acknowledge and agree that: • You have reasonably assessed the information provided and risks described and have made an informed and voluntary choice to make this reservation. • You alone, and not your Host(s), are responsible for determining your ability to fully understand any directions or warnings presented. • You will act reasonably and responsibly and will comply with any provided and customary guidelines, house rules, conditions, directions, and/or precautions for the duration of your stay. . To the maximum extent permitted under applicable law, you release and promise not to sue your Host(s) for any claims, demands, causes of action, losses (economic or non-economic), damages, expenses, costs or liability of any nature whatsoever arising from or in connection with your trip, whether based on warranty, contract tort (including negligence), product liability, or any other legal theory. You intend this Guest Release and Waiver to be a complete and unconditional release of all liability to the greatest extent allowed by law. You agree that if any portion of this Waiver and Release is held to be invalid, the balance notwithstanding shall continue in full force and effect. DISCLAIMER AND WARRANTIES To the maximum extent permitted under applicable law, Host(s) provide the property "As Is," without warranties of any kind, whether express or implied. Without limiting the foregoing and to the maximum extent permitted by law, Host(s) expressly disclaim any warranties of safety, fitness for a particular purpose, quiet enjoyment and as to the adequacy of the directions and warning provided to you. (See Guidelines and House Rules) INDEMNIFICATION You agree that if, despite this Guest Release and Waiver, you or anyone on your behalf make a claim against the Host(s) relating to your stay, you will indemnify and hold the Host(s) harmless from any liability, demand, loss, damage, or costs which the Host(s) may incur as the result of such claim. AFFIRMATION You affirm that you have read the Guidelines, House Rules and this Guest Release and Waiver and fully understand the assumption of risk, release, waiver and consent contained therein. You further understand that you have given up rights by agreeing to these terms and have done so freely and voluntarily and without inducement.
