Other things to note Terms and Conditions for Highland Lodge Escapes Ltd 1.Highland Lodge Escapes Ltd (“We”, “Our”, “Us” ) act only as agents for the owners of the properties featured on our websites. The hiring contract is between the hirer and the owner. 2. The Hirer. As “the party leader” you must be at least 18 years of age at the time of booking. By making the booking, you confirm that you are authorised to make the booking. Further It is your responsibility as the party leader to ensure that the other party members are aware of and agree to comply with the booking conditions You must ensure that all the information you provide us in connection with your booking is true, accurate, current and complete. If any of your details change, you must promptly update them. As soon as you receive your confirmation, you must check the details carefully. If anything is not correct, you should tell us immediately. 3.Tenants shall mean the customers party 4. Privacy . By submitting your personal information to us, you agree to our use of the information in the ways set out in our Privacy Notice, including sharing your personal information with the Owner for the purposes of the provision of the booking. 5. The Hirer's Details may also be passed to the local property management company, housekeeper or any other person(s) for the purposes of preparing your property or provision of guest services. 6. Purpose of Hire. The Tenant shall be entitled to occupy the Property for holiday purposes only and this agreement shall not confer on the Tenant any security of tenure within the terms of the Housing Act 1988 pursuant to which the occupation shall be deemed to be by way of an excluded tenancy. The Tenant shall not sub-let the premises or any part thereof. 7. Rental Period. All bookings start and finish on the times set out on the booking agreement. 8 Deposit/Payment. A deposit of 25% of the full rental amount is payable when booking unless the booking is made within 8 weeks of the hire commencement date, when the full amount is payable. If the full balance is not received by us 8 weeks (Christmas or New Year week balance is paid by 1st October) prior to the hire commencement date, the deposit will be forfeited and the Property re-let. When you submit a booking via our online reservation system you will receive an automatically generated booking summary by email to the email address you provide in the booking form. This does not form a contract between us. A contract shall only arise when your booking is subsequently confirmed in writing via a letter of confirmation sent by post or email. Payment for extras. Payment for use of the Hot Tub and or Pets will be taken at the time of the final payment 9. Cancellation. Once a booking deposit has been paid and the booking confirmed in writing, the Tenant is liable for the whole amount of the rent for the period booked. In the event of cancellation the charges will be as follows: 0-13 days prior to arrival 100% of the total amount will be forfeited 14-27 days prior to arrival 75% of the total amount will be forfeited 28-55 days prior to arrival 60% of the total amount will be forfeited 56 days or more prior to arrival the deposit will be forfeited 10. Part Cancellations If any person(s) in your party needs to cancel, this will not affect the total cost of your booking. No refunds are payable in the event that you cut short your stay 11. Availability. The booking is made on the understanding that the Property will be placed at the Tenant's disposal on the dates agreed. Should this not be possible through fire, theft or circumstances beyond the Owner or Agent's control, the full amount paid by the Tenant will be refunded. However, note that: a. No alternative accommodation can be provided; b. The Tenant will not have any claim against the Owner or Agent for compensation or expenses. 12. Holiday Insurance. Once booked, the Tenant is liable for the complete Property rental costs. As such, it is strongly recommended that the Tenant take out suitable holiday insurance to cover costs incurred by unexpected holiday cancellation. 13. Maximum Occupancy. The maximum occupancy as specified on the property details must be adhered to. You cannot arrange for visitors to the accommodation without the advance consent of the Owner. You must not hold events such as parties, celebrations or meetings at the accommodation. If you do any of these things, the Owner can refuse to hand over the accommodation to you, or can repossess it. If the Owner does this, we will treat this as you cancelling the booking. In these situations you will not receive a refund of any money you have paid for your booking. We or the Owner will not be legally responsible to you as a result of this situation (for example, for any costs or expenses you have to pay due to not being able to stay in the accommodation, such as the cost of finding alternative accommodation). Neither we nor the Owner are under any obligation to find any alternative accommodation for you. 14. Behaviour You and all members of your Party agree: a. To leave the accommodation in a similar condition as you found it when you arrived b. To behave in a way whilst at the property which does not break any law; c. Not to use the accommodation for any illegal or commercial purpose; d. Not to sublet the accommodation or any part thereof or otherwise allow anyone to stay in it who we have not previously accepted on behalf of the Owner as a member of your party; e. Not to behave in an anti-social manner, breach the peace or otherwise act in a way which may disrupt or affect the enjoyment of others. This includes what could be deemed to be excessive noise. 15. Amenities. The use of the Property includes use of TV's, electricity, water, heating, and oil heating. Bed linen and towels are included in the rental and must remain within the property. 16. Wi-Fi. Where Wi-Fi is an advertised facility, its provision is subject to availability and network conditions. It may not be available 24 hours a day and is provided for pleasure, not for business purposes. 17. Pets. One to two dogs belonging to the Hirer are welcome on the understanding that the Hirer is totally responsible for the behaviour and well-being of the dog(s), they are always under control, not left unsupervised in the Property and kept off the furniture, including beds. An additional charge will be made for pets to cover cleaning costs. Rules for dog owners. £30 per pet per stay 18. Smoking. All Properties are strictly non-smoking. The Tenant may not smoke (including the use of E-cigarettes) within the Property or allow any member of their party or other invited persons to smoke within the Property. Any breach of this rule will result in the termination of the Tenant's booking and a request to vacate immediately. All monies paid will be forfeited. Smoking is permitted in the outside areas of the Property; however the Tenant must ensure that all evidence of smoking in the outside areas is removed prior to departure. 19. Cleaning. All equipment, utensils, etc. must be left clean, and the Property must be left clean and tidy at the end of the hire period. Suitable cleaning materials will be found within the Property for this purpose. The Owner/Agent reserves the right to charge for excess cleaning. Note: It is the Tenant's responsibility to ensure the safe storage of cleaning materials, particularly in the presence of children. 20. Nuisance. The Tenant shall not cause a nuisance of any kind to the Property or to its neighbours. 21. Right of Entry. The Owner or Agent reserves the right to enter the Property at any reasonable time, with or without notice, during the Tenant's period of stay. 22. Damages & Breakages. The Tenant undertakes to keep the Property and all the furniture, fittings and contents in the same state of repair and condition as at the commencement of the let. All damages, breakages or equipment failure to the Property or its contents must be reported to the Agent as soon as possible. The Agent will arrange to repair the damage as soon as practical, however there is no guarantee this will be within the period of hire. Damage or breakage caused by act or omission of the Tenant or persons attending the property at the Tenant's invitation must be repaired or replaced by the Tenant at the Tenant's expense within 7 days of the cost of repair or replacement being determined and notified to the Tenant. The cost of repair or replacement shall generally be determined within 14 days of notification. Any repair or replacement shall be to the original standard. Should the damage result in another booking being cancelled, the Tenant will be held liable for all consequential losses to the Owner. All breakages are chargeable. 23. Tenant's Personal Belongings Personal belongings and any vehicles are the sole responsibility of the tenant at all times. 24. Appliance Breakdown. In the event of a breakdown, the Agent will do everything possible to ensure swift repair//replacement of any appliance provided at the property. However, the Tenant must accept that it may not be possible to deal with every eventuality during the course of a booking period. Where a breakdown is determined to be a direct result of misuse, the Tenant will be required to cover the full cost of repair or replacement. 25. EV Charger Each property is furnished with an Electrical Vehicle Charger. The tenant uses this at their own risk. Instructions for use are on the screen of the unit and should be followed exactly. Use is monitored via Zappi App and will be charged at £1 £10.00 per overnight charge up to a maximum usage of 30kwh, any units after that will be charged at 30p per kwh. Cars must not be charged using any other socket at the property as this will deem any insurance nil & void, contravenes the STL licence and may also cause harm/damage to the vehicle or the property as the sockets are not capable of such use. Guests who charge in this manner and cause any damage will be charged the full cost of repair/replacement. In the event of a breakdown, power cut or any other event preventing the use of the EV Charger will not be deemed to be the responsibility of the property owner. It is the tenants responsibility to ensure their car has enough charge to drive to a charging station 26. Items Left Behind. The Tenant will be notified of any of the Tenant's possessions that have been left in the property after it has been vacated. Notice will be made in writing by post or email, generally within fourteen days after the end of the booking period. The Tenant must meet the cost of returning any item and the Agent will also levy a minimum charge of £10.00 to cover handling costs. If the Tenant does not wish for the item to be returned, the Agent will dispose of it as necessary but reserves the right to levy a charge for any items which are hazardous or difficult to dispose of. Please note: any item to be returned will be suitably packed but the Agent accepts no responsibility for loss or damage in transit. 27. Security. The Tenant is responsible for the security of the Property for the duration of the booking period and also immediately after vacating, until such time as the Agent re-enters the Property. The Tenant is expected to take all reasonable care of the property. This includes ensuring that the Property is fully secured when leaving it. No windows should be left open and all locks must be secure. 28. Complaints Procedure. If the Tenant is not entirely satisfied with the Property, they must contact the Agent immediately, and every effort will be made to resolve any issues. If the situation cannot be resolved to the satisfaction of both parties, the Agent will attend as soon as possible to inspect the property. The Agent will not consider claims for problems notified to them after the hire period has ended. 29. Variation to Descriptions. Every care has been taken to ensure the accuracy of details on the Agent's literature, advertising, websites, etc. However, changes to the details may be necessary from time to time and the Agent reserves the right to make any changes without notice. Where changes are fundamental to a booking, notification will be made in writing by post or email. 29. Bookings are all provisional until such times that the booking has been confirmed in writing. All bookings should be made in the name of the guest unless being made by a registered company in which case the booking can be made in the company name with a note of the guest name along with valid contact details on the booking. 30. Hot tub & Saunas. Please ensure that disclaimer for the Hot Tubs is returned to us, marked as read. Please ensure you do not use the hot tub after 9pm. Hot tub Disclaimer 31.
