By submitting a booking request for stays exceeding 28 days, you acknowledge and agree to the terms outlined below. The Haven is a subsidiary of Creekstone Properties LLC established to provide quality lodging accommodation for those seeking Short-Term, Mid-Term and Vacation Rental needs. RENTAL AGREEMENT This Haven Rental Agreement is made by and between Creekstone Property Management, LLC; The Haven and you, our Guests including all persons named in this Agreement and who stay at the subject premises during the booking period . This Agreement shall serve as a legally binding contract. By executing this Agreement, you are acknowledging that you understand and accept all the provisions contained herein. DEPOSIT AND RENT: Guests shall make payments in accordance with the terms and policies of the website or platform under which the booking reservation was made. The Deposit and Rent are exclusive of any other fees or costs related to rental of the Home, including but not limited to fees for rental platforms used to reserve the Home. UTILITIES: The cost of your utilities is included in your rental charges with a cap of $300.00 per month. Monthly utility usage exceeding this amount will be billed to the guest to be paid upon receipt of the invoice. LAWN SERVICES: Lawn services are provided by our service providers every two weeks at no additional cost to the guest. OCCUPANCY TERM: Guest shall be allowed to occupy The Home as follow: Beginning at 3:00 p, m. on the check in date Ending at 1200 noon on the check out date. FALSE REPRESENTATIONS: Any reservation obtained by Host/Creekstone Properties and or The Haven staff under false pretenses will be subject to forfeiture of advanced payment, Deposit or Rent, and the Guest will be prohibited from entering the Home. All false representations by Guest are a violation of this Agreement and will result in termination of the reservation and this Agreement. COMPLIANCE: Guests agree to comply with the terms of this Agreement the Haven’s Home Rules; the Booking Platform Rules; HOA community Rules and local zoning ordinances, including but not limited to occupancy restrictions. MAXIMUM OCCUPANCY: The maximum number of occupants in the home or on the property during Guest contracted stay is limited to the number of named guests listed on the registration. Only the people identified in this Agreement and on the registered Guest registration shall be allowed to occupy the Home. ACCEPTANCE OF PROPERTY/HOME: Guest Acceptance of the Property/Home is “Sight Unseen in Person”: Guest makes the Agreement without first inspecting the Home in person although multiple pictures are available for viewing and is not entitled to inspect the Home prior to occupancy. The Home is completely furnished with furniture, supplies and amenities needed to accommodate the number of registered guests. The Host makes a sincere effort to accommodate Guests, although no refunds or adjustments will be made if Guest determines that the décor or furnishings are unacceptable to their unique tastes and preferences. USE OF THE HOME: The Home shall be used and occupied exclusively by the registered Guest and the number of occupants identified listed at registration and this Agreement. Guest represents and warrants that Guest’s primary residence is not located at the Haven and that Guest is utilizing the Home as a Short Term (STR) or Mid-Term (MTR) for lodging only for the contracted period listed. Guest acknowledges that the stated term limit is the termination of this agreement and will not use the Home as a primary residence and Guest will not be domiciled at the Home. The Home is to be used exclusively, as a private, single-family dwelling for temporary lodging only. No part of the Home/property shall be used at any time during the Term of this Agreement by Guest for the purpose of carrying on any event, business, profession, or trade of any kind, or for any purpose other than as specified in this Agreement. Guests shall comply with all laws, ordinances, rules, and orders of any and all governmental or quasi-governmental authorities affecting the cleanliness, use, occupancy and preservation of the Home. Guests shall use the Home in a careful manner to prevent any damage or loss to the Home and shall always keep the Home in clean and sanitary condition. Guest shall refrain from loud noise and shall not disturb, annoy, endanger, or inconvenience neighbors, nor shall Guest use the Home for any immoral, offensive, or unlawful purposes, nor violate any law, association rules or ordinance, nor commit waste or nuisance on or about the Home. Guests shall make no alterations to the buildings or improvements to the Home, or construct any buildings, or make any other improvements to the Home. Guest shall immediately notify Host/The Haven of any broken or malfunctioning items in or on the home including but not limited to the building, furniture, fixture, equipment, and appliance. Guests shall not keep in the Home any item of a dangerous, flammable, or explosive character that might unreasonably increase the danger of fire, or explosion on the Home, or that might be considered hazardous or extra hazardous by any insurance company. MAIL DELIVERY: Guest is expressly prohibited from receiving U.S. Postal Service delivery to the home address. CONDITION OF THE HOME: The Guest acknowledges that the Home is provided in "as is" condition. Host shall use reasonable efforts to ensure the operation of all amenities in The Home such as Internet access, satellite, or cable TV, as applicable. The host shall not be held responsible for such an item’s failure to work but will make every effort to correct any issues as reported as quickly as possible. Guest acknowledges that use of amenities such as kitchen appliances, tubs, decks, and similar ("Amenities") may be potentially dangerous and involve potential risks if improperly used, particularly with regard to children and such use is at the Guest's own risk. If children use or are near the Amenities, such children must be always supervised by an adult. CLEANING: The Home has been cleaned and inspected prior to check-in and will be cleaned after check-out. Guests are encouraged to keep the Home and property clean and to follow our Rules for check out at the end of the stay. Guests booking for 14 days or longer are required to allow the Haven cleaners to clean the home of every 14-day period during the booking period at no cost to Guests. The cleaning will be pre- scheduled with the registered guest and conducted during regular business hours at a time convenient for both the guest and the cleaners. NO PARTIES, NO EVENTS AND NO UNREGISTERED VISITORS: The Haven strictly prohibits and enforces our rules related to No Parties, No Events, and No Gatherings of visitors and unregistered guests. Violation of this rule will result in immediate termination of this Agreement without refunds, and removal from the property. NO SMOKING/NO DRUG USE: The Haven does not allow smoking in the Home and does not allow any drug use including vaporing, marijuana/cannabis in the Home or on the property. PARKING REQUIREMENTS: Registered Guests are allowed to park up to six (6) automobiles on the Haven property driveways at any given time during their stay. Guests may not park on our lawn, in our neighbor’s driveways, in front of their homes, on their lawns or on the street. Commercial vehicles and food trucks are strictly prohibited from parking in the driveways, on the street or near the Home. SECURITY: The Home is equipped with exterior security cameras that are monitored regularly for the protection of the Home, our guests and to always assure compliance to property and community regulations. Guests shall not damage, block or incapacitate our security cameras in any way. DECORATIONS: Guests shall not install, place, set or otherwise use signs or decorations of any kind on the exterior or interior of the Home. These items have been known to cause damage upon removal and are prohibited. TRAVEL INSURANCE: Travel Insurance, Trip Cancellation, and Interruption Protection Insurance (optional): Travel Insurance is available concerning your reservation via third party vendors. Travel insurance may reimburse for pre-paid, non-refundable expenses due to certain unforeseeable circumstances that may jeopardize Guest vacation investment and force Guest to incur unplanned expenses. The host strongly recommends Guest purchase this valuable protection. If declined, Guest acknowledges they have read and understand Host's cancellation policy, and this Agreement, and choose not to purchase Travel Insurance on behalf of all occupants of the Home to protect against cancellations caused by certain unforeseen events, such as pandemic, illness, death, natural disasters, etc. The Host recommends that Guest purchase Trip Cancellation and Interruption Protection insurance via a third party to assure refund of deposits paid and reimbursement of other vacation payments. Guests are encouraged to explore any and all other insurance options available. CATASTROPPHIC EVENTS & EMERTENCY EVACUATIONS: If a catastrophe (e.g., pandemic, hurricane, tornado, earthquake, flood, fire, or wildfire etc.) or any situation simply beyond Host's control impairs the Home or its property, Host is not responsible for finding transportation or alternative accommodations. There will be no refunds or credits for emergency or alternate lodging. evacuations. See "Travel Insurance" above. MAINTENANCE: In the event of equipment, appliances, or utilities' malfunction during Guest's stay, Host will make a reasonable effort to expedite repairs. Guests shall notify the Host in writing as soon as possible of any occurrence. RULES AND REGULATIONS: Guest agrees to comply with all rules and regulations established by The Haven regulation of the use of the Home during the Term of this agreement. Without limiting the generality of the foregoing, Guest shall: A. Not obstruct or cover the windows or doors. B. Not leave windows or doors in an open position during any inclement weather. C. Not hang any laundry, clothing, sheets, etc., from any window, rail, porch, or balcony, nor air or dry any of same within any yard area or space. D. Not cause or permit any locks or hooks to be placed upon any door or window without the prior written consent of Host. E. Use all lavatories, sinks, toilets, and all other water and plumbing apparatus only for the purposes for which they were constructed. F. Guests shall not allow any personal hygiene products, sweepings, rubbish, sand, rags, ashes, or other substances to be thrown or deposited therein. Any damage to any such apparatus and the cost of clearing stopped plumbing resulting from misuse shall be borne by Guest. G. Guests and other occupants shall always maintain order in the Home/the property and at all places on the Home and shall not make or permit any loud or improper noises, or otherwise disturb other residents and neighbors. H. Guest shall keep all radios, television sets, stereos, etc., turned down to a level of sound that does not annoy or interfere with neighbors. I. Guests shall deposit all trash, garbage, rubbish, or refuse in the locations provided and shall not allow any trash, garbage, rubbish, or refuse to be deposited or permitted to stand on the exterior of any building or within the yard. J. Guest shall abide by and be bound by any and all rules and regulations affecting the Home or the common area appurtenant thereto, which may be adopted or promulgated by the homeowners' association having control over them; and K. Guest shall abide by all federal, state, and local laws and ordinances affecting the Home, including, without limitation to, the use or possession of illegal drugs and substances. SUBLETTING PROHIBITED: Guest may not assign this Agreement, nor sub-let, nor grant any license to use the Home, or any part thereof. An assignment, sub-letting, or license without the prior written consent of Creekstone Property Management/Host, or an assignment or subletting by operation of law shall be absolutely null and void and shall be a Default of this Agreement. ALTERATIONS AND IMPROVEMENTS: Guests shall make no alterations to the buildings or improvements on the Home or its equipment. USE OF OPEN FLAMES: Guest shall not use any open flames including candles in the Home or any part of the property. HAZARDOUS MATERIALS: Guest shall not bring or keep on the property or in the Home any item of a dangerous, flammable, or explosive character that might unreasonably increase the danger of fire or explosion on the Home, or that might be considered hazardous or extra hazardous by any insurance company. NO PETS: No pets of any kind are permitted at any time in the Home or on the property. Service Animals are limited to one per stay and are permitted only as required by ADA with prior written notice to Host that a service animal will be accompanying the registered guest who requires the services of that animal. The service animal must be house trained. Guests requiring the service animal must answer all ADA allowed questions related to the service animal and must agree to always adhere to all ADA Guidelines for that service animal. The guest requiring the service animal must always be present with the animal and have absolute control of the animal at all times. The service animal must not be allowed on the furniture or in the beds. Guests must clean up after their service animal and supply their own waste bags for removing waste and dispose such waste in trash containers in the rear of the exterior of the Home. Violation of any ADA service animal regulations and rules of the Home will result in termination of this agreement and removal from the property. Guests will be liable for all damage caused by the service animal. EMOTIONAL SUPPORT ANIMALS: Emotional Support animals are not covered under ADA Guidelines and therefore are not allowed in our home or on the property. Misrepresentation of an animal as a Service Animal or bringing an emotional support animal or any other animal on our property or in the home is a violation of this Agreement and our rules and therefore, will result in termination of this Agreement without refund and immediate removal from the property. EXERCISE AND PLAY EQUIPMENT: If the Home includes exercise and playground equipment and is used by Guests, the Guest agrees that use of these equipment and participating in physical exercise or training activities is entirely at his/her own risk. Guests agree that you are voluntarily participating in these activities and use of the facilities and facility equipment, and you assume all risks of injury, illness, or death.
