Other things to note Terms and Conditions of Your Stay We are delighted to welcome you to our villa. To ensure a pleasant and safe experience, we kindly ask you to review and agree to the following terms and conditions. By confirming your booking, you acknowledge that you have read, understood, and accepted these terms in full. Nature of the Property • This property is a privately owned vacation villa, not a commercial lodging facility. It is not staffed 24/7, and guests are expected to be self-reliant during their stay. • The villa is provided "as-is," with no warranties expressed or implied regarding suitability, fitness, or uninterrupted use. Tropical Environment • The villa is located in a tropical setting where wildlife such as insects, geckos, iguanas, and birds is part of the environment. Pest control measures are in place, but complete elimination of wildlife cannot be guaranteed. • Guests are responsible for taking reasonable precautions, such as storing food properly to avoid attracting pests. Condition of the Property • The villa is regularly maintained; however, normal wear and tear may be present. • Furnishings and appliances may vary slightly from photos due to updates and replacements. • Tropical shutter windows, commonly used in the region, are not completely airtight. Utilities and Infrastructure • The villa relies on local utility services. Occasional interruptions to water, electricity, or internet may occur due to island-wide infrastructure challenges. These events are beyond the host’s control and do not qualify for compensation or refunds. Trash Collection • Trash collection is scheduled weekly by local services, but collection days may vary or be delayed. Guests are asked to compact trash and use the provided bins to prevent pests and wildlife. Safety and Security • Guests are responsible for their safety and the security of their belongings during their stay. • For safety, guests must lock all doors and windows when leaving the property. The host is not liable for any loss, theft, or damage to personal belongings. • Emergency contact numbers for fire, medical, or security assistance are provided in the villa. Guests are encouraged to review these resources upon arrival. Prohibited Activities • Feeding wildlife or leaving food exposed. • Hosting parties, events, or gatherings without prior approval. • Smoking indoors (designated outdoor smoking areas are provided). • Engaging in illegal or disruptive activities on the property. Refund Policy • Refunds will only be considered for issues that significantly disrupt the guest’s stay and are within the host’s reasonable control to resolve (e.g., failure of essential amenities not repaired within 48 hours). • Refunds will not be granted for: o Weather conditions or natural events. o Wildlife or insect encounters. o Temporary utility interruptions or delays in trash collection. o Dissatisfaction with disclosed property conditions. No Exceptions to Cancellation Policy • No major events, including but not limited to hurricanes, political unrest, flight cancellations, pandemics, or illness, will override the cancellation policy. Guests are encouraged to purchase travel insurance or event disruption coverage for protection against unforeseen circumstances. Acknowledgment of Risk • By booking, guests acknowledge and accept the inherent risks of staying in a tropical environment, including: o Wildlife encounters. o Temporary utility interruptions. o Slippery surfaces, stairs, and uneven terrain. o Swimming pool use (no lifeguard is on duty; swim at your own risk). House Rules • Quiet Hours: 10:00 PM to 8:00 AM. Noise levels must be kept low during these hours. • Smoking: Smoking is prohibited indoors. Dispose of cigarette butts responsibly in designated outdoor areas. • Trash Management: Use designated bins for trash. Compact trash to prevent overflow due to potential collection delays. • Maximum Occupancy: Only registered guests are allowed on the property. Approval is required for additional visitors. • Energy Conservation: Turn off lights, fans, and air conditioning when not in use. Use water responsibly. • Pets: No pets are allowed unless pre-approved by the host. • Property Respect: Use furniture and appliances as intended. Do not rearrange furniture. • Security: Lock doors and windows when leaving the property to prevent theft or wildlife entry. Liability and Indemnification • Host’s Liability: o The host and property owner are not liable for injury, illness, loss, theft, or damage incurred by guests during their stay, except in cases of gross negligence or willful misconduct. o Guests accept responsibility for risks such as slippery surfaces, uneven terrain, wildlife encounters, and environmental hazards. • Guest Indemnification: o Guests agree to indemnify and hold the host harmless from claims, costs, or damages arising from their stay, including personal injury, property damage, or disputes caused by guest actions. Force Majeure Clause • The host is not liable for disruptions caused by unforeseeable events such as natural disasters, political unrest, or pandemics. Guests are advised to secure appropriate travel insurance for these contingencies. Dispute Resolution • Any disputes will be resolved under the laws of Curacao, with Willemstad as the exclusive venue for legal proceedings. Guests waive the right to bring claims in jurisdictions outside of this area.
