Lihi Kai in Haena... vacation "Hawaiian Style" with beautiful Naue Beach right outside your door. This home has a premium ocean/beachfront location right at Naue Beach. You are surrounded by North Shore beauty. No parking worries for you. It is perfect for watching whales (in season), dolphins and sea turtles right from the house and lanai. The house offers four bedrooms, three ground level and one main on the second floor. A covered back and oceanfront lanai for lounging and dining. *This property is located in a Tsunami Evcauation Zone I am available to help with whatever you need! Booking activities, etc. Haena is the last town on the north shore of Kauai. It's pretty sleepy, quiet, but absolutely gorgeous! Truly, an island paradise. definitely recommend renting a car! We request that you sign our rental contract once you book. Here are the terms: Guest agrees to abide by the Vacation Rental Agreement attached at all times while at the property and shall cause all members of the rental party and anyone else Guest permits on the property to abide by the following rules at all times while at the property. I authorize Stay Kauai to charge my credit card for charged incurred by the Guest during Guest stay. Services to include but not limited to, Grocery stocking fee, Chef, Masseuse, Surf Lessons, Yoga, Pilates, Stand Up Paddle Lessons, Bike/Board/Bed Rentals, and any other services requested by Guests. Gratuity to vendors not included. A convenience fee of 3% will be added to the total charges should I make payment by credit card. If there is no security deposit listed above, in lieu of prepaid security deposit, Guest authorizes Stay Kauai to keep the Guest's credit card on file, and further authorizes Stay Kauai to charge Guest's credit card for any damages beyond normal wear and tear and/or extra cleaning required beyond the normal outclean. Stay Kauai Vacations, LLC -- Overview and Release This Overview and Release is between Stay Kauai, LLC ("SK") and Guest. By signing this Agreement, Guest agrees to abide by the conditions set forth in this: (i) Overview and Release Agreement; (ii) the Vacation Rental Agreement (between Guest and SK). Check in/Check Out. Check-in time is 3:00 p.m. and check-out time is 10:00 a.m. If a late check-out is desired and, if available, Guest may request late check out and pay for a half-day rate for the final day, which payment will guaranty a late check out up to 6:00 p.m. Waiver and Release FORCE MAJEURE. If forces beyond SK's reasonable control, e.g., storms, road closures, transport strikes, etc., cause the Guest’s vacation to be extended or otherwise changed, the Guest is responsible for any extra costs associated with such changes, e.g., extra lodging, meals, and transportation and must reimburse SK for any such increased expenditures made by SK on Guest’s behalf. In the unlikely event that the entire vacation is canceled due to circumstances beyond SK’s reasonable control (including the vacation house being sold, legislation changing vacation rental restrictions, hurricanes, etc.), SK shall refund the payments received by SK to the Guest, less any non-refundable vacation rental home charges and services or other charges incurred by SKV. SK is not responsible for any costs incurred by Guest for airfare/transportation or other travel expenses not arranged by SK. SK will make every reasonable effort to secure another acceptable vacation rental home but due to the unique and exclusive quality of many of the homes we book, SK does not guaranty an exactly comparable home. THIS RENTAL AGREEMENT (“Agreement”) is entered into by and between Stay Kauai (“SK”) and “Guest” (also referred to as “You” and “Yours”). In consideration of the performance of the provisions of this Agreement, SK hereby agrees to rent to Guest and Guest hereby agrees to rent from SK the home subject, in all respects, to the provisions of this Agreement. The home and its appurtenances are referred to as the “Rental Home”. The real property under and around the Rental Home is referred to as the “Property” (the “Rental Home” and the “Property” are collectively referred to as the “Premises”). 1. Maximum Occupancy. The maximum occupancy of the Vacation Accommodation is 6, all of whom must be relatives or friends of Guest identified above. At no time shall more than the maximum occupancy for this booking occupy the Premises overnight; should more than the stated number of Guests occupy the Premises overnight, Guest will incur additional nightly charges and increased cleaning fees. 2. Use of the Premises. This Agreement is for a residential rental home use only. Guest shall comply with all laws, ordinances, rules and regulations governing or otherwise relating to the use and occupancy of the Premises. The Premises may not be used for parties, receptions, luaus, events or gatherings unless disclosed to and approved by Owner or Property Manager. The parties agree that the occupancy covered hereunder is for day-to-day “transient purposes” only and that, as such, the terms, conditions and provisions of this Agreement are not subject to Chapter 521, Hawaii Revised Statutes. 3. Arrival/Departure. The Rental Home will be available for Guest’s occupancy at 3:00 p.m., HST, on the “Arrival Date”. The term of Guest’s occupancy will end at 10:00 a.m., HST, on the “Departure Date”. Subject to availability, and the payment of a half-day Rental Rate, a late check-out may be arranged. 4. Security Deposit. The Security Deposit of One Thousand and 00/100 Dollars ($1000.00) is taken upon booking the Premises. Permitted deductions pertaining to damages or missing items will be taken from the Security Deposit. Guest shall be provided a written explanatory statement detailing all deductions. Typical causes for deductions include, but are not limited to, repair or replacement of damaged or missing furnishings, fixtures and equipment, failure to pay additional rent, key/lock replacement, long distance telephone calls billed to the Rental Home, extra cleaning (as determined by the Property Manager upon Guest's departure), and damages caused by wrongful use of the Premises. If the Security Deposit is insufficient to cover all damages and costs, Guest shall be held responsible for the deficiency. 5. Utilities and Services. SK shall provide and maintain water, sewer, local telephone, electricity, basic TV cable services and high-speed internet connection, where available. SK shall not be liable for any interruption in services beyond SK’s control and Guest may not terminate this Agreement because such services are interrupted. Guest is responsible for paying any long distances telephone charges. 6. Condition of the Rental Home. Before Guest shall be permitted to occupy the Premises, Stay Kauai shall inspect and take inventory of the Premises. When Guest departs, Guest must leave the Premises, and its contents, in the same condition as they were upon the Arrival Date, ordinary wear and tear excepted. Guest will be responsible for all damage to the Premises. 7. Additional Terms and Conditions. Additional Terms and Conditions set forth on Exhibit “A” are incorporated herein by this reference. 8. Property Manager. Stay Kauai is the Property Manager for the Premises. All questions and concerns relating to the Premises should be directed to Lisa Downer. The parties acknowledge that SK may arrange additional services for Guest’s benefit, which additional services are unrelated to the rental of the Premises. Such additional services shall be subject to a separate agreement between Guest and SK only, e.g., Owner shall not be a party to any additional service agreements, and expressly disclaims any liability associated therewith. 9. Confidentiality. Guest agrees to keep confidential and not disclose to any third party (whether during or after the term of this Agreement) information of any kind or nature regarding the identity of Owner, its principals or any person occupying the Property, or the details of their respective personal lives, habits, security measures, or any other information of any kind dealing with their business or personal affairs. Further, Guest specifically agrees to not post any pictures of the Premises on-line or to provide or forward copies of any pictures of the Premises to any third party (including by email or text message). Guest further agrees not to disclose the terms of this Agreement or the identity of the Owner or the Premises addresses, unless required in an emergency or as required by law. Guest expressly acknowledges and agrees that a breach of this provision will necessarily result in irreparable injury to Owner, or its principals, for which no adequate remedy is available at law and which is not fully compensable in money damages alone; thus, Owner shall be entitled to injunctive (and other equitable relief) as may be necessary to prevent, remedy and/or mitigate the adverse effects of any actual or threatened disclosure, in addition to any other legal remedies, such as damages to which Owner may be entitled. Exhibit “A” Additional Terms and Conditions 1. Smoking Policy. Smoking is not allowed inside the Rental Home. 2. Pets. No pets are allowed on the Premises. 3. Garage/Owners’ Possessions. If there is a garage on the Premises, the garage is set aside for exclusive use by the Owner; Guest is not allowed to use the garage or any of its contents without Owner’s express written permission. 4. No Shoes in Rental Home. As per Hawaiian custom, Guests are expected to remove their shoes before entering the Premises. 5. Noise Restrictions. Under no circumstance shall loud noises be allowed after 9:00 p.m. or before 8:00 a.m. This restriction includes use of amplified music and drumming. 6. Care of Premises. Guest is expected to care for the Premises as if they were their own. Guest acknowledges that weekly grounds maintenance will occur one or more days/week. Grounds maintenance includes mowing, weeding and the use of other machinery. 7. Prompt Reporting of Problems/Defects. Guest agrees to immediately report any problems, damage, or defects on or about the Premises to SKV or Property Manager. Any damage caused by Guest’s failure to timely report any problems or defects shall be Guest’s responsibility. 8. Subletting; Assignment. Guest may not sublet or allow anyone else to occupy the Premises or replace Guest as Guest unless Guest has procured Owner’s advance written permission. Guest may not assign this Agreement. 9. Keys. Guest will be provided with one (1) set of entrance keys, which keys must be returned to Property Manager, or left in the lock box, or kitchen counter, when Guest vacates the Premises. No duplicate keys may be made, or locks changed or added. I f Guest fails to return the keys, Guest shall be responsible for all replacement costs for new keys and exterior door locks. 10. Currently Listed Property. If the Premises are currently listed for sale, there could potentially be requests made for showings during Guest’s stay. Owner will provide a minimum of twenty-four (24) hours’ notice for any potential showings. In the unlikely event that the Premises are sold prior to the date of Guest’s arrival, Owner and SKV will make every effort to have the new owner honor the existing rental reservation or Owner and SKV will use commercially-reasonable efforts to find a comparable rental home for the dates of Guest's stay. In the event that no comparable home can be found and secured, all monies previously paid by guest will be refunded to Guest. 11. Insects, Etc. Guest understands that there is a wide variety of plant, animal, and insect life on Kauai. Guests may encounter more insects, frogs, toads, centipedes, small lizards (geckos), roosters and chickens during Guest's stay than Guest is normally accustomed to seeing and hearing. Guest is advised that these encounters are commonplace and do not warrant relocation or reimbursement of rental payments. 12. Indemnification; Hold Harmless. Guest agrees to indemnify and hold harmless Stay Kauai, LLC, Owner and Owner’s members, agents, employees, independent contractors and invitees from and against any liability for personal injury or property damage sustained by any person (including Guest’s visitors or invitees), as a result of any cause, unless caused by the gross negligent or willful misconduct of Owner. Guest agrees that SK may enter the Premises during reasonable hours to inspect the Premises, to make such repairs, alterations or improvements thereto as SK may deem appropriate. Severability. If any part of this Agreement shall be declared illegal, void or ineffective for any reason, then the same shall be deemed null and void and the remaining provisions of this Agreement shall continue in full force and effect. Attorney’s Fees. In any legal action brought by either party to enforce the terms hereof or relating to the Premises, the prevailing party shall be entitled to all costs incurred in connection with such action, including reasonable attorney’s fees and costs. Waiver. The failure of SK to enforce any term of this Agreement shall not be deemed a waiver. The acceptance of rent by SK shall not waive SK's right to enforce any term hereof. 13. Legally Binding. Guest agrees to abide and fulfill all parts of this Agreement, and furthermore agrees that it is a legally binding agreement. If Guest does not understand any portion of this Agreement, Guest should consult an attorney. This Agreement supersedes all prior oral discussions, written information, emails, or fax communications. All parties agree that in the event of a dispute, this Agreement will be interpreted in accordance with Hawaii law. All parties agree to exclusive jurisdiction of the courts located in the County of Kauai, State of Hawaii, for any dispute arising out of this Agreement. The parties waive their right to bring a claim elsewhere. 14. Facsimile & Electronic Signatures. Facsimile and electronic signatures on this Agreement and any addenda or other documents related to this Agreement shall be binding and effective for all purposes and treated in the same manner as physical signatures. 15. Construction. SK and Owner are not responsible for any inconvenience caused by construction noise and/or activity in the vicinity of the Premises. Guest may call SK to inquire as to the status of any neighboring construction. Any refunds due to a cancellation resulting from construction activity shall be subject to the Cancellation Policy. 16. Ocean Risks. The Property is located adjacent to the beach. Guest understands that there are risks inherent to persons and property located adjacent to the ocean. Guest and Guest's family, invitees, and guests shall make use of the ocean at their own risk. Ocean waves and undercurrents can be especially strong. Caution should be exercised when near or in the ocean. END OF EXHIBIT “A”
