We want your stay to be amazing and filled with wonderful memories. We strive to exceed the expectations of our guests. Dear 1729 Amanda Guest: Here is the rental agreement for your stay at 1729 Amanda, Canyon Lake, TX 78133. Please take the time to read over the agreement. We remind our guests that this is also our vacation home and ask that you treat this rental home with respect. This rental agreement is a binding legal contract and should be carefully reviewed. By making a reservation, you are entering this contract and therefore, the guest is agreeing to all the obligations and responsibilities outlined in this document. This agreement is entered, by and between Rita & Slade Kellogg (Agents and Owners of this property and (Guest) who is responsible for the actions of their family and guests. The Guest hires from the Owner for use as a vacation home, those premises described in “Rental Property” for a term commencing on “Arrival Date” at 4:00 PM or later and terminating on “Departure Date” before 11:00 AM as specified in this agreement. Please contact the owner if you are going to arrive late on your check-in day or if you will be checking out early. PARKING/ DRIVEWAY There is an oversized driveway which allows for ample parking of cars and trucks. Parking of personal recreational watercraft, motor vehicles, trailers, mobile homes, trucks with camper inserts in the bed must be parked in the driveway as well, not on the side of the road. The use of motor vehicles, trailers, mobile homes, etc are not permitted to be plugged into the house’s electrical system. Our home cannot handle the extra voltage. Doing so will result in loss of your security deposit and/or request for payment of $250. You may use your own generator to power your RV, travel trailer… AGE RESTRICTIONS, MAXIMUM GUEST POLICY & CAPACITY Minimum Age of Renter: 25 This home has a maximum occupancy of 8 guests. This policy is strictly enforced, without prior consent. Security cameras are used to monitor the number of occupants entering and exiting the home. This is for safety purposes, noise issues in a residential area, and most importantly, septic tank capacity issues. Exceeding the maximum number of allowed occupants will result in one or more of the following: a $100 per person per night fee, not returning your security/damage deposit, requesting an additional payment per the policy/contract, an insurance claim on the policy taken out by renters (if applicable), and/or immediate eviction from the home. This capacity is determined by the number of sleeping spaces and the capacity of the septic/water systems. We ask that you do not exceed the number listed either by the size of your overnight guests or by the number of guests you have visit during your stay. Owners have the right to ask you to leave if capacity is exceeded, and you will forfeit all money paid and may be billed and/or have an insurance claim against you. PAYMENT, REFUNDABLE DAMAGE DEPOSIT, & INSURANCE Payment schedule: Full payment is required when booking your reservation. In some cases, we require guests to purchase property damage protection insurance, which covers you for up to $3,000 of accidental damage (cost is $79). This is for bigger situations that a damage deposit would not cover. CANCELATION POLICY/GUEST REFUND POLICY Please refer to your booking site for specific cancellation criteria. Rarely, if ever, might the Owner need to cancel your reservation. The Owner will adhere to the booking site policy as well. CHECK-IN/CHECK-OUT INFORMATION Check in is at 4:00 p.m. We will send you a code to access the front door for you to use throughout your stay the day of your arrival. There is a binder with helpful information including emergency contact information, instructions, things to do, restaurants, etc. This binder also includes a copy of this exact contract as a reminder of the house rules and policies and fees. Check-out time is 11:00 AM. Please ensure you lock the front door, back door and sliding glass door before leaving. Make sure to sign our Guest book, and we ask that you leave a review for us on your booking site. We know reviews are especially important when booking vacation rentals, so we appreciate your input. We strive to exceed each guest’s expectations. Refunds will not be issued for early check out. Please follow all check out procedures in the binder and via message sent to you through the booking site. Failure to do so, could result in guests not receiving a full refund of their damage deposit and/or charges/fees. Check Out Instructions: 1) Write a note in the Guest Book on the bar about your stay. 2) Take your bagged trash outside to the blue trash bin in front. Replace with a new trash bag (found in the laundry room). Saturday or Sunday night guests need to take both blue trash bins to the street for Monday pick-up. Not bagging trash and throwing in loose items into the blue bins outside could result in a $50 fee. 3) Turn off ice maker before leaving please. 4) Please start a load of all used towels in the washing machine. Remove all used sheets from the beds and leave on the bedroom floors. 5) Turn off all lights & fans. Turn AC to 75. 6) Put dirty dishes in the dishwasher & start it (pods under sink). 7) Lock the sliding glass door (master bedroom), the back-patio door, & the front door (close door completely & press “ ”). 8) Rate your stay and write a review online & post on social media too. We appreciate your input! THIS IS A NON-SMOKING HOME. Anyone who fails to adhere to this policy will be asked to leave immediately and forfeit any monies paid. If we discover evidence that smoking occurred on the property during your stay, your damage deposit will not be refunded and/or you will be charged a $250 deep cleaning fee. ACCOUNT SUMMARY The account summary on your reservation will list the rental fee for the property, sales tax, cleaning fee ($400, which includes a fully refundable $250 extra cleaning/damages deposit and a $150 nonrefundable basic cleaning fee), damage protection insurance (if applicable, $79) and any other fees charged by the booking company. ITEMS SUPPLIED The Owners have supplied linens for each bed (including the bunk bed pull out trundle and the queen air mattress if desired.) We have also included plenty of bath towels for each guest. We have supplied beach towels in the cabinet above the washing machine. We supply toilet paper, Kleenex boxes, paper towels, trash bags, laundry detergent, fabric sheets, dishwasher/dish soap, hand soap, foil, coffee filters, Ziploc bags, koozies and a bunch of other items that will make this vacation home feel like you are right at home. Please do not be wasteful, and do not take items with you. There are swim floats, noodles and ice chests available for your use. All items supplied are the property of the Owners so please clean and return to their original location. Contact the Owner to inquire about other items there for the Guest to use. WATER USAGE & CONSUMPTION TIPS + ICE MAKER Water quality is fine for drinking. The refrigerator has an automatic water & ice dispenser with filter. Please limit the use of the washing machine and dish washer to once per day, if used, due to the limitations of the septic system. Also keep shower times to a reasonable amount. Prolonged water usage can fill the septic tank up quickly, causing serious damage and repairs, thus resulting in loss of deposit and/or an insurance claim. Please remember to turn off the ice maker when checking out. Failure to do so, could damage the freezer, and your deposit may not be refunded and/or an insurance claim may be filed or a charge of $150 could result. TRASH REMOVAL & CURB SERVICE All trash must be bagged. Do not put any loose trash items in the blue bins without putting it in a bag first. Please gather your trash and take it outside to the blue trash bins in front of the house before checking out. There are additional trash bags in various sizes available above the washer and dryer. Guests staying Saturday or Sunday night, should take the 2 blue trash bins to the street for pick up early on Monday. Failure to abide by these trash rules could result in full or partial loss of deposit and/or a $50 fee. GAS GRILL & GAS FIRE PIT The property has a GAS GRILL and a propane gas tank is provided. This property also has a GAS FIRE PIT with a separate propane tank for it. You are responsible for turning off the propane tanks and burners and for cleaning up after yourself if you use the gas grill, otherwise your damage deposit may be retained or a charge of $100 could incur. If the grill looks dirty or there is access grease below, please notify owners with photos immediately. Renters assume full responsibility for any risks associated with use of grill and will be held financially responsible for any damages that may result. For problems or questions, please contact the Owner immediately. REPAIRS Contact the Owners immediately should you discover a problem in the home. The Owner and/or Agency are not responsible for compensation of any part of the Guest fees due to failure of appliances, fixtures or HVAC system resulting in short term inconvenience. We always do our part to remedy problems to the satisfaction of our guests. Reporting issues will help us ensure that each guest has a fully functioning vacation home. Failure to report problems during your stay, could result in loss of deposit and/or an insurance claim against your policy. POOL, TENNIS COURTS & PRIVATE LAKE ACCESS There is a private gated neighborhood pool and clubhouse available for use during your stay. Pool is open May 1st-October 3rd, 2021. Pool hours are from 10 am - 8 pm. Pool rules from POA will be adhered to and include: no glass containers, no alcohol, no smoking, no littering (take your trash with you), no loud music, no profanity, no diving or running or horseplay, and no lifeguard on duty. There is only one key to access the gated pool area/clubhouse located on Amanda Drive. This is the same key to access the gate for the tennis courts and the private lake access area. Guests assume responsibility for this key and will leave it in the guest binder. Failure to do so will result in a new key fee of $100. Tennis courts and private lake access requires the gate key. Location is at the bottom of the hill on Irene (about a 5 min drive). Look for posted sign on gate saying Village West POA private access. No parking lot for this area so only side of street parking available. Tennis equipment not provided. Rough path to lake access located behind tennis courts and to the left with sharp decline so use caution esp with elderly and little ones. Access at your own risk. No responsibility assumed by owner for injury or behavior. Obey all rules posted and all local laws. This area is open from sunrise to sunset. Same rules for pool apply here as well. PETS Pets are not allowed on this property. Should we discover evidence that a pet was on this property, your deposit will not be refunded and a charge of $150 will incur. This is to cover special cleaning costs for hair, dirt, fleas, urination stains, chewed items, etc. You will be asked to leave the home and forfeit all money paid. Please message us regarding service dogs before making a reservation. TELEVISION/MUSIC/SPEAKERS The home has TVs in the main living room, guest room (2nd bedroom) and kids’ room (3rd bedroom). The home is set up using Roku TV, so you will need to log into your account to access your personal Roku services, including Netflix, Direct TV Now, etc. This house has outdoor speakers on the back patio. You will need to turn “ON” the Bluetooth button located inside by the patio door. Turn on your Bluetooth (make sure you are connected to the wireless internet), then play your music from your mobile device. Please respect your neighbors and keep the volume at the reasonable level. Do not play loud music after 10 pm. Please refrain from blasting music with profanity. Thanks! INTERNET SERVICE/TELEPHONE The binder inside the house will provide internet service information. If you should have issues with the internet, contact the Owners to let them know. There is not a telephone located on the property. Cell phone reception varies according to location and service carrier. Sprint and Verizon work for sure. SECURITY CAMERAS The home has security cameras for the safety and protection of our guests. They also help ensure that the number of allowed occupants is not exceeded and to ensure the pet policy is being followed. Covering or blocking the cameras view or disconnecting the connection is a violation of the house rules. If there is evidence of a meddling with the security devices, you will be asked to unblock them. Failure to do so will result in immediately eviction from the home without refund and/or losing your security deposit, and/or a $250 charge/fee. HVAC UNIT The AC unit is a residential unit and not a commercial grade unit. Therefore, the AC cannot be set to lower than 70 degrees. The unit is monitored via app. Also, do not leave the AC on if you open the windows or having the sliding glass door open (using the screen instead). This will cause the AC to be stressed and will freeze up, causing either immediate damage or future damage. The house will not cool off quickly as a result. A $250 fee/charge could result, loss of your security deposit, and/or an insurance claim against your renter’s policy could apply. We thank you for treating the HVAC unit like you owned it. Texas is hot so be kind to it. CAMPFIRES Campfires are PROHIBITED. DO NOT create a fire pit on the property either. A $250 fee will incur for violating this policy. There is a GAS FIRE PIT on the back patio for your use. Instructions on how to ignite the fire pit are on the pit itself. FIREWORKS Fireworks ARE NOT permitted on this property. Doing so, could result in loss of deposit and/or an insurance claim on your policy, and/or a $250 fee charged. If it is during a holiday time, you will likely see fireworks from the back patio. Enjoy the free show! FEDERAL, STATE & LOCAL LAWS It is understood that all renters must abide by all federal, state and local laws. Violating any law will result in loss of your deposit and/or a $250 fee, and/or an insurance claim against your policy, if necessary. This includes any illegal drugs, drug paraphernalia, underage drinking, sexual crimes, homicide, prostitution, among many other illegal activities. These rules are considered common sense, however, it is important to reiterate that ANY unlawful activity or possession of illegal substances is not permitted, and a full loss of deposit will occur.
