Your walk-out basement studio, hosted by Stout Rentals LLC, includes use of a 30,000 gallon pool, patio furniture, and floats. You have a private entrance, a queen bed, full en-suite kitchen with cute retro-style appliances and en-suite bathroom with accessible shower. Just off Hwy 72 in Huntsville, less than 15 minutes from Research Park and Gate 9, this 1+ acre property is filled with fruit trees, surrounded by foliage in a quiet subdivision. No children. The space In a quiet subdivision with 1 acre of land, surrounded by trees, but ideally located minutes from a major highway for quick access to the city's amenities. Very little traffic noise. There are NO CHILDREN on the property. Because of the pool depth, lack of pool fence, lack of pool alarm, the creek's moving water, retaining wall, and furniture not secured to the wall, it is not safe for children. This is in a mother-in-law suite on the bottom floor of your hosts' home. You may hear us walking across the floor, talking, cats meowing, or the garage doors, but we are generally quiet. This room is on the same HVAC as the rest of the house. It does not have a separate thermostat. However, because it's on the bottom floor, it is almost always on the cold side. We provide an electric heater and blankets. But if the temperature is still uncomfortable, please don't hesitate to reach out to us - we have multiple methods of controlling air flow, including adjusting the thermostat anywhere from our phones! Guest access Guests have use of the swimming pool (open March - November, swimming season typically mid-May to September), floats, patio furniture, backyard, driveway parking, and the full en-suite kitchen. All outside amenities are shared with hosts, but we generally give you space. Other things to note There are multiple cameras on the property that record video and audio 24/7. One at our front door, one covering the driveway, and two covering the pool. All cameras are clearly visible. There are NO cameras inside your studio, and none of the cameras are capable of recording audio from your studio. By submitting a request to rent our space, you are agreeing to the following lease. Stout Rentals LLC will happily provide you a physical copy of the lease with the specific details of your reservation. The Lease Term is for the days specified in your AirBnB reservation. In the event that Lessee(s) do not evacuate the Premises upon the expiration of the Lease Term, the Lessee(s) shall be construed to be a hold-over tenant subject to a day-to-day lease, subject to eviction process governed by the laws of the State of Alabama. OCCUPANTS: The total number of individuals staying on the Premises during the Lease Term shall be a maximum of 2 adult guests. The Rental of the Premises is for adults over the age of Eighteen (18) only. If more than the authorized number of guests listed above are found on the Premises, this Agreement will be subject to the termination by the Lessor. In the event that an occupant requires the use of a legal Service Animal, this requirement shall be disclosed by the Lessee to the Lessor prior to signing of this Rental Agreement. PROVISIONS: The provisions of this Rental Agreement shall be binding upon and inure to the benefit of the Lessor and Lessee, and their respective successors, legal representatives, and assigns. The provisions of the Alabama Uniform Residential Landlord and Tenant Act of 2006 govern this Rental Agreement. FEES, CHARGES and COLLECTIONS: The Lessee(s) shall pay as the RENTAL FEE in the amount in the AirBnB reservation, that is due on or before the first day of the rental. This fee is inclusive of cleaning fees, taxes, and Airbnb Service Fees, set by Airbnb. This fee will be paid through the Airbnb portal pursuant to the terms set by Airbnb In the event that Lessee(s) do not evacuate the Premises upon the expiration of the Lease Term, the Lessee agrees to pay $200 for every day the Lessee(s) holds over the Lease Term. Lessee(s) agrees to pay an eviction penalty equal to two times the Rental Amount if Lessor must file an eviction action against Lessee. In the event that Lessor must sue for collection of rents, fees or damages eviction, LESSEE may be required by the court to pay all court and collection costs. INSPECTION: The Lessor has the right to inspect the Premises with prior notice as in accordance with State law. Should the Lessee(s) violate any of the terms of this Agreement, the rental period shall be terminated immediately in accordance with State law. The Tenant waives all rights to process if they fail to vacate the premises upon termination of the rental period. The Tenant shall vacate the Premises at the expiration time and date of this agreement. MAINTENANCE AND REPAIRS: The Lessee(s) shall maintain the Premises in a good, clean, and ready-to-rent condition and use the Premises only in a careful and lawful manner. The Lessee(s) shall leave the Premises in a ready to rent condition at the expiration of this Agreement, defined by the Lessor as being immediately habitable by the next tenant. The Lessee(s) shall be charged for maintenance and repairs should the Premises be left in a lesser condition. Unless otherwise stated herein, all maintenance requests and repair demands shall be made pursuant to the Airbnb messaging platform. TRASH: The Lessee(s) shall dispose of all waste material generated during the Lease Term under the strict instruction and direction of the Lessor. QUIET ENJOYMENT: The Lessee(s), along with neighbors, shall enjoy each other’s company in a quiet and respectful manner to each other’s enjoyment. The Lessee(s) is/are expected to behave in a civilized manner and shall be good neighbors with any residents of the immediate area. Creating a disturbance of the area by large gatherings or parties shall be grounds for immediate termination of this Agreement. LIABILITY OF LESSOR: The Lessor shall not be liable to Lessee(s) or Lessee(s) invitees, family, employees, agents, or servants for any loss, personal injuries, bodily injuries or damages to personal property caused by defects, hazards, disrepair, faulty construction of the premises or any action or inaction of Lessor, to the fullest extent permitted under the laws of the State of Alabama. Lessee(s) hereby agree to indemnify and hold harmless the Lessor from and against any and all claims for damages to premises, or to personal property, for bodily injury or personal injury arising from Lessee’s use of premises, or from any activity, work or thing done, permitted or suffered by Lessee in or about the premises, to the fullest extent permitted under the laws of the State of Alabama. If, in Lessor’s judgement, there is substantial damage to the premises, Lessor may terminate this lease by giving written notice to Lessee. The Lessor shall not be liable for personal injuries, bodily injuries or property damage or losses from theft, vandalism, fire, water, windstorm, rain, explosion, or any other causes whatsoever, to the fullest extent permitted under the laws of the State of Alabama. Lessee is and shall be responsible and liable for any and all injuries and damages to, or upon the premises; again, to the fullest extent permitted under the laws of the State of Alabama. USE OF PREMISES: The Lessee(s) shall use the Premises for residential use only. The Lessee is not authorized to sell products or services on the Premises or conduct any commercial activity. ILLEGAL ACTIVITY: The Lessee(s) shall use the Premises for legal purposes only. Any other such use that includes but is not limited to illicit drug use, verbal or physical abuse of any person or illegal sexual behavior shall cause immediate termination of this Agreement with no refund of pre-paid Rental Payment. POSSESSIONS: Any personal items or possessions that are left on the Premises are not the responsibility of the Lessor. The Lessor shall make every reasonable effort to return the item to the Lessee(s). If claims are not made within the State’s required time period or two (2) weeks, whichever is shorter, the Lessor shall be able to keep such items to sell or for personal use. CAPTIONS: Any heading preceding the text of any paragraph hereof is inserted solely for convenience of reference and shall not constitute a part of this Rental Agreement nor shall they affect its meaning, construction, or effect. FACSIMILE AND OTHER ELECTRONIC MEANS: The parties agree that this Rental Agreement may be communicated by use of a fax or other electronic means, including but not limited to electronic mail and the internet, and the signatures, initials and handwritten or typewritten modifications to any of the foregoing shall be deemed valid and binding upon the parties as if the original signatures, initials and handwritten or typewritten modifications here present on the documents in the handwriting of each party. ATTORNEY’S FEES: The Lessee(s) agrees to pay all reasonable costs, attorney's fees, and expenses that shall be made or incurred by the Lessor enforcing this agreement NON-RELIANCE CLAUSE: Both Lessor and Lessee(s) hereby acknowledge that they have not received or relied nor could have relied upon any statements or representations or promises or agreements or inducements by either Lessor or his agents which are not expressly stipulated herein. If not contained herein, such statements, representations, promises, or agreements shall be of no force or effect. This general non-reliance clause shall not prevent recovery in tort for fraud or negligent misrepresentation or intentional misrepresentation unless specific non-reliance language is included in this agreement. This is a non-reliance clause and is neither a merger clause nor an extension of a merger clause. The parties execute this agreement freely and voluntarily without reliance upon any statements or representations by parties or agents except as set forth herein. SEVERABILITY: If any provision of this Renal Agreement or the application thereof to any person or circumstance is held invalid, the invalidity does not affect other provisions or application of this chapter which can be given effect without the invalid provision or application, and to this end the provisions of this agreement are severable. Likewise, this Rental Agreement shall be interpreted under the laws of the State of Alabama, and all parties hereto agree that all actions pertaining to this agreement shall be brought in the county the property is located within, unless otherwise prohibited by law. ENTIRE AGREEMENT: This Rental Agreement contains the entire agreement between the parties hereto and all previous negotiations leading thereto, and it may be modified only by a dated written agreement signed by both Lessor and Lessee. No surrender of the Premises for the remainder of the term of this lease shall be valid unless accepted by the lessor in writing. TIME IS OF THE ESSENCE WITH REGARD TO ALL TERMS AND CONDITIONS IN THIS AGREEMENT. Parties have fully read and understand this Agreement and the meaning of its provisions. Parties are legally competent to enter into this agreement and accept full responsibility. Parties have been advised to consult with counsel before entering into this agreement and have had the opportunity to do so.
